GRANTING -R. HART THE RIGHT AND
FRANCHISE TO CONSTRUCT, MAINTAIN AND OPER-
ATE A RAILWAY TRACK OVER AND UPON EAST 20TH
STREET IN THE CITY OF FORT WORTH.
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF FORT WORTH:
SECTION I
The City of Fort Worth, a municipal corpor-
ation in Tarrant County, Texas, does hereby give and
grant unto D. Hart of Fort Worth, Tarrant County,
Texas, and his heirs and assigns, the right, privi-
lege and franchise to construct, maintain and oper-
ate a railway track of standard gauge as an exten-
sion of, connection with or branch of a line hereto-
fore constructed by the grantee and to whom a fran-
chise was heretofore granted, and said spur track
to extend from the terminus of the line heretofore
constructed at said point on 20th Street west on the
north side of 20th Street across Grove Street to the
southwest corner of block 182.
SECTION II
This franchise and grant of the right and
privilege to extend said line of railway over the

streets just above mentioned, to be subject to and
run current with the franchise heretofore granted by
the City Q_.$Y_DZt_ worth for the construction, main-
tenance and operation of the spur track heretofore
constructed and above described.
SECTION III
All tracks laid under the provisions of
this ordinance shall be located, laid and maintained
in such manner as shall be designated by the city
engineer.
SECTIOY I
The said D. Hart or his heirs or assigns
shall at his own cost and expense pave and repave
or otherwise surface and resurface and keep con-
stantly in good order and condition, with the same
material with which the street on the outside is
paved and surfaced, all that part of said street
occupied by said lien or that which lies between
the rails of said track and for eighteen inches on
each side thereof, and said D. Hart, his heirs or
assigns shall conform his or their tracks or any
part thereof to the proper grade of each street and

change the level of said tracks as often and when-
ever the grade of any such street is changed, so that
every part of such track shall always be kept at the
duly established grade line or as near thereto as
the surface of the grade of the street outside there-
of will permit.
SECTION V
The said D. Hart, his heirs and assigns,
do hereby agree to indemnify and hold the said City
of Fort Worth harmless because of, and promptly to
pay off and discharge,_ or repay to the said city,
all damages, claims, judgments, attorney's fees
and other costs and expenses rendered against, or
incurred or paid out by the said city by reason of
injuries either to persona or property occasioned
as the proximate result of anything done or per-
mitted or in any way proximately arising out of the
construction, operation or maintenance upon the above
streets and thoroughfares of the tracks of said
grantee.
SECTIOA VI
All of the conditions, limitations and
provisions contained in the ordinance granting the

franchise now owned by the said D. Hart on East 20th-
Street and in the original franchise granting him the
right and privilege to construct and operate a spur
track -hall _a=#..inue in force and.govern and control
(in addition to the provisions of this ordinance) the
operation and construction of the contemplated ex—
tension of the present line of railway as herein and
hereby granted respectively.
SECTION VII
That this ordinance shall take effect and
be in force from and after the date of its passage.
