Assessing a portion of the cost Qf �Wrovement on Lipscomb Street, in the City of Fort Worth, Texas, between its intersection with the south line of Railroad Avenue and its intersection with the north line of the street forming the north boundary of Capps Park, against the ovmers of property abutting thereon and their property; and against the T1orthern Texas fraction Company, a corporation, and its property, and providing for the eollec, ion of the said assessment and the assignable certificates evidencing the same. � t f f BE IT ORDAITTED BY THE BOARD 01' COIXIS ',I0313723 OF THE CITY OF FORT TORTH; WHAT: '"h'EREAS, on the, 'y_day of 19 r_,, the Board of Commissioners of said City by resolution directed the improvement of Lipmeomb Street between its intersection with the line of �wst and its intersection with the -one 0? /`' txeet, by rais- ing, filling , grading and paving the same; and whereas, in accordance with said resolution, specifications for said work were duly prepared by the said Board; and whereas, bids for said improvement were duly advertised for as required by the City Charter; and whereas, said bids were received, opened and considered by the Board of Commissioners, and the bid of the Metropolitan Construction Company, a corporation, for the im- provement of said street was accepted by said Board of Com- missioners; and whereas, the said Cerny ha-,- entered into contracts with the Oity of Fort , orth, as provided by the Charter, for the improvement of said streets within said limits by craising, grading and filling the same, and by paving same with Mineral Rubber Asphalt pavement upon a five inch gravel concrete base; and whereas, the said Company has executed its bonds to the City of Fort Worth for the maintenance of the said improvements and for the construction thereof in accord- ance with said contracts and specifications, with sureties as required by the said City Charter, which contract and bonds with the sureties thereof have been duly approved by the said Board of Commissioners; and, vir.iereas, thereafter, the C '.,„ Engineer of said City filed his written statement with the Board of Commissioners concerning the said improve:;rents, and the cost thereof as provided by Section a, Chapter XIV, of the Charter of said City, which staterren'. -.-s considered -y the ti said Board, corrected and approved, and 'whereas, thereafter, the said Board did, by resolution of date the lday of find and declare the necessity of assessing a portion of the cost of said improvements against the owners of property abutting thereon, and their property, and did prescribe a hearing to the said owners, their agents and attorneys, and fix a date therefor, and direct the City Secretary of the said City to issue notice of the said hear- ing by advertisement as provided by the said City Charter and also by posting said notices as therein provided, and whereas, in accordance with the said resolution the said City Secretary did issue a notice of the said hearing to the said property owners by publication thereof for the time and in the manner prescribed by the City Charter in "The Star-Telegram," a daily paper of general circulstion in the City of Fort Worth, for five (b) consecutive days prior to the said hearing, and did also notify the said owners of the said hearing by posting a copy of the said notice to each of them at the postoffice in the City of Fort or th, more than ten (10) days prior to the date of the hearing; and, whereas, the said hearing, in ac- cordance with the said resolution and notice, was held by the Board of Commissioners, on thsde of ,� at `l' o'clock, A. Ai. at which ti v and p_rce no owners of property appeared to contest the said assessment or the benefits of said improvement or any other matter or thing connected with the said improvement or any irregularity with reference thereto, except S � BE IT, THEREFORE, FURTHER ORDAINED BY THE SAID BOARD OF COTZ,1133I0NERS AS FOLI0,73, TO. 7Il: FIRST: That the benefits to each parcel of prop- erty of each rnvner hereinafter named, in the enhanced value of the said property exeoed in each case, the amounts herein- after assessed against such owners, and their property. And the Board having considered the evidence, and it appearing therefrom that the strict application of the front foot rule or plan whereby each owner is to be sssessed in proportion as the frontage of his property is to the whole frontage improved, would be in particular cases unjust and inequitable, and not in accordance with benefits received, and that the apportion- ment of the cost of said improvements between prof arty owners and the assessments hereinafter made, will effect substantial equality and justice between property avners having in view benefits received by and burdens imposed on such osn-)ers. SECOND: That there is and shall be assessed against each of the owners of property herein below named and against the several parcels of property of the said owners herein be- low described as their proper pro rats part of the cost of the navies of the said owners and their said property. THIRD: That the said Board, having ascertained the cost of con -'sting improvements upon�� Street from W280t __ Lt /,,, 94regt, named to be AA improved between the rails and tracks and 18 inches on the outside thereof of The Northern Texas Traction Company, a cor- poration, operating a street railway over a portion of s. id 97 Street, to be the sum of_jj&vrO_ ' Dollars, the said Board does hereby levy a special tax against the road- bed, ties, rails, fixtures, rights and franchises of said Company, of said amount and does hereby declare the said sun to be secured by a lien upon the said road-bed, ties, rails, fix- tures, rights and franchises of said railway company from the date hereof, prior and superior to all inoumbrances thereon ex- cept lawful taxes; that said taxes hereby assessed shall become due upon the completion of the said improvement by the said Metropolitan Construction Company and its acceptance by the City of Fort 19orth, and if not paid when due, shall inned- ia.tely become delinquent and shall be enforced as in the case of the collection of taxes under the Charter of the City of Fort Worth -by advertisement and sale of the said property rights and franchises herein levied on.
