HomeMy WebLinkAboutOrdinance 1878 ORDINANCE NO. 9 AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 4, RECTORIS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED, AND EXCEPTING THE RIGHTS OF ALL PUBLIC UTILITIES HERETO- FORE ACgi?IRED IN SAID ALLEY, AND PROVIDING FOR THE REVERS1014 OF THE FEE TO SAID LAND, AND PROVIDING THAT THIS ORDINANCE MALL BECOME EFFECTIVE IMMEDIATELY. WHEREAS, it appearing to the City Council of the City of Fort Worth, Texas, that the alley running east and west through Block 4, Rector's Addition and between Henderson Street and Lexington Street, although a duly dedicated and accepted alley for use by the public, bas in fact never been used by the public and that it is to the best interest of the public that said alley be closed, abandoned and vacated as an alley or public thoroughfare and the fee to the land in said alley revert as provided by law, NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That the alley in Block 4, Rector's Addition to the City of Fort Worth, Tarrant County, Texas, which runs east and west through said block and between Henderson Street and Lexington Street, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION II. That the rights of all public utilities heretofore acquired by said utilities for the purpose of constructing and maintaining service lines shall not be disturbed, destroyed, revoked or abrogated by any of the provi- sions of this ordinance, that said rights as above set out shall remain in full force and effect. SECTION III. That the fee to the land in said alley is hereby released and will revert to the owners as provided by law. SECTION IV. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION V. This ordinance shall take effect and be in hull force and effect from and after the date of its passage. APPROTED AS TO FORM AND LEGALITY: its A R-a
