Soo# 3r This ordinauae shall take effeot and be in foroe, from and after Its paassap, • rr THE STkTE OF TEXAS COUNTY OF TARRANT TIHEREAS, the City of Fort Vorth has about completed ' the construction of a sewage disposal plant; and, WMIMS, in such construction, so far as the mame has now progressed, provision has not been made for the disposal of the sewage from the packing plants of Swift & Company, Armour & Company, of Delaware, the Fort Worth Stock Yards Company and the Fort Worth Belt Railway Company; and, WHEREAS, it is desired that such provision be made and that such sewage be turned in from such plants and such � concerns into the main sewage system pipe and line running ram. iptq_ such disposal plant and disposed of in and by the same; and, 4'IBEREAS, some doubt has been expressed that the sewage disposal system in use in said disposal plant v.-rill not take care of and provide means for the disposal of the sewage from the plants and premises of the above named concerns; and, WHEREAS, it is desirable that an experimental operation of such disposal plant shall be conducted so as to determine whether or not such sewage from such concerns can be disposed. of b7 sai „-sy-vttw. NOW, THEREFORE, This Memorandum of an Agreement made and entered into on this the 19th day of May, A. D. , 1924, and by and between the City of Fort Worth, acting by and through its Mayor and Board of Commissioners, hereinafter called party of the first part, and Armour & Company of Delaware, Swift & Company, the Fort Worth Stock Yards Com- t � 2. pany, and the Fort Worth Belt Railway Company, hereinafter called parties of the second part, r I T N E S S E T H Z. That said parties of the second part will at once and as speedily as the work can be concluded, con- struct and install a system of screening so as to remove as far and as much as possible of the solids from the sewage and waste from the plants and premises of said parties of the seconft part, and a detention tank to equalize the flow of sewage, and upon the completion of such construction of such screening and the installation of the same, that said party of the first part, the said City of Fort Worth, will cause to be turned into the main line of its sewer ,.Ape extending to LaLcii disposal piano; at or near the point of present intersection, the water and sewage from all of the plants and premises of the above named parties of the second part, and that said party of the first part will at once, in conjunction with and with the co- operation of the representatives of said parties of the second part, begin operating the disposal plant with the combined sewage in order to determine whether or not the mizture created by the sewage from the City of Fort Worth proper and that from the plants and premises of the said parties of the second part can and will be disposed of satisfactorily in such sewage disposal plant. 3. 2. That such operation shall be concluded as speedily and as quic'My as possible and shall be completed in not more than sixty (60) days, and in the event that the same demonstrates that such sewage so created by such mixture as aforesaid, can be satisfactorily handled and disposdd of in and by such sewaE:e disposal plant without damage br injury to the same, except such as is usual and customary in the operation of sewage disposal plants properly operated, that then said party of the first part will continue to permit the sewage and discharge from the premises and plants of said parties of the second part to flow into such main pipe and mower line and from thence into said dewage disposal plant, there to be disposed of by the same under the super- vision and maintenance of said party of the first part. 3. Parties of the second part hereby agree that if in the experimental operation hereinabove provided for, or at any subsequent time on account of such mixture, any injury or damage should ensue to the sewage disposal plant of the said party of the first part, other than that which is usual 9 -Ueh -plants air--reted in a careful and proper manner, or from any negligent handling of the screening system, that said parties of the second part will hold harmless said party of the first part and reimburse said party of the first part in the amount of such injury and damage. IN 71ITNE'SS WHEREOF, the parties hereto have caused these presents to be signed, the City of Fort Worth by its Mayor, authorized thereunto by resolution adopted by the Board of Commissioners in regular session, and the parties of the second part by tlieir officers duly authorized thereunto, with the Seal of all parties hereto affixed, this 19 th day of May, A.
