WORTH, TEX. A SAVI1US CLAUSE; K41(INTG THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES PROHIBITING CRUELTY TO ANIMALS; RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; AND NAMING AN EFFECTIVE DATE. WHEREAS, it appears to the City Council of the City of Fort Worth that during certain seasons of the year in the City of Fort Worth, persons have engaged in the business of bartering, selling or giving away baby chicks, ducklings and other fowl, rabbits and hamsters as pets for children; and, WHEREAS, it has been brought to the attention of the City Council that as a result of such sales, said fowl and animals are abandoned or wander onto public property or private property not the owner's, or come into the hands of children incapable of caring for them; and, WHEREAS, in view of the foregoing causes, the City Council of the City of Fort Worth has determined that the sale, gift or barter of such fowl and animals constitutes, in effect, cruelty to animals, and is con- trary to the peace and good order of the community; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: Section 1. That it shall be unlawful for any person, firm or corporation to sell, offer for sale,,barter or give away baby chicks, ducklings or other fowl, rabbits or hamsters as novelties, whether or not dyed, colored or other- wise artificially treated; provided, however, that this ordinance shall not be construed to prohibit the display or sale of natural chicks, ducklings, or other fowl, in proper brooder facilities for hatcheries or stores engaged in the business of selling the same to be raised for commercial purposes,or the sale of rabbits or hamsters as pets. Section 2. Should any section, clause or provision of this ordinance be de- clared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this ordinance as a whole or any part thereof other than the part so declared to be iny�lid. Section 3- That this ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. Section 4. That any person, firm or corporation who violates, disobeys, omits, neglects or rePuses to comply with any provision of this ordinance shall be guilty of a misdarmanor and shall be p-Luiished by a fine not to exceed Two Hundred and No/100 Dollars ($200.00). Section 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. AIPROVED AS TO FORM: City Attorney
