WORTH, TEXAS, AND FIXED THE TIME AND PLACE FOR
TEARING TO THE OWNERS OF ABUTTING PROPERTY AND
OWNERS OF RAILWAYS AND ALL OTHERS INTERESTED,
AND DI13ECTED THE CITY SECRETARY TO GIVE NOTICE
OF SUCH HEARING; AND DIRECTING TEE PUBLIC WORKS
DIRECTOR OF THE CITY OF FORT WORT", TEXAS TO
PREPARE NEW ESTIMATES OF THE COST OF THE IMPRCI L'IM NTS
TO BE CONSTRUCTED ON A PORTION OF EAST BERRY STREET
IN SAID CITY,
WHEREAS, the Public Works Director of the City of
Fort Worth, Texas prepared estimates of the cost of street,

improvements on a, portion of East Berri Street in said City; and,
WIT EREAS, said estimates incorrectly describe the
owner of the railroad or the name of the railroad which occupies
a portion of East Berry Street and against which assessments
were to be levied; and,
WITEREAS, by resolution passed by the City Council on
the 24th day of November, 1954, the estimates prepared by the
Public Works Director were adopted and approved and a. time
and place for hearing to the owners of abuttinE; property; and
owners of railways and others interested was fixed and the
City Secretary was directed to ;give notice of such hea.rinE,; and,
W-riEREAS, the City Secretary did give such notice by
publication of said notice in a newspaper of E,�eneral cir-
culation in the City of Fort Worth, Texas, and in such notice
the Texas !s Pacific Railway Company was named as the owner-
of the railroad occupying a portion of East Berry Street to
be improved; and,
WHEREAS, in order to correct the estimates prepared by
the Public Works Director the resolution approving and adopting
said estimates and the published notice of the hearing here-
ina:oove mentioned, it is necessary to cancel, annul, repeal

and rescind the resolution passed on November 24, 1'954 herein-
above mentioned and to direct the P-L;Cclic Works Director of the
City of Fort Worth to file new estimates of the cost of improve-
ments on East Berry Street; TIEEREFORE,
BE IT ORDAINED BY T_IiE CITY COTJJECIL OF THE CITY

I.
The resolution heretofore passed by the City Council
of the City of FortWorth, Te.-,,as on November 24, 1954, styled:
"RESOLUTION APPROVING AND ADOPTING ESTIMATES OF
THE COST Or IMPROVEMENTS AND OF AMOUNTS TO BE
ASSESSED FOR IMPROVEMENTS ON A PORTION OF EAST
BERRY STREET IN ThE CITY OF FORT WORTE-, TEXAS,
FIXING TIME AND PLACE FOR :TEARING TO TiHE OWNERS
OF ABUTTING PROPERTY AND OWNERS OF RAILWAYS AND
TO ALL OTHERS INTERESTED, AND DIRECTING TITE CITY

SECRETARY TO GIVE NOTICE"
relating to the improvement of the following described portion
of East --Perry Street, to wit:
EAST BERRY STREET, from the easterly line of
North-South Freeway to the westerly 'Line of
Riverside Drive,
1u-e, and the same is :-ereby cancelled, annulled, repealed and
rescinded.
II.
The Public Works Director or the City of Fort Worth,
Texas be, and he is hereby, directed to prepare and file w--'-,h
the City Council new estimates of the cost of improvements on
the nereina-oove described portion of East Berry Street in
accordance with the terms of the powers and provisions of
Chapter 10110 of the Acts o,' the First Called Session of the
Fortieth Legislature of the State of Texas, now shown as
Article 1105b of Vernon's Texas Civil Statutes, which law
has been adopted as an amendment to and made a part of the
Charter of the City of Fort Worth, Texas.
