AN ORDINANCE PROVIDING THAT A WATERWAY EASEMENT ACROSS LOT 7, BLOCK 16, GLENWOOD ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE VACATED, ABANDONED AND CLOSED, CONDITIONED THAT IF A BUILDING IS CON- STRUCTED ON LOT 6 OR 7 OF SAID ADDITION, THE OWNERS THEREOF SHALL BEAR THE EXPENSE OF REPLACING EXISTING SANITARY SEWER MAIN BETWEEN SAID LOTS; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. (a) That the waterway or water-drain easement over the west six (6) feet of Lot 7, Block 16, Glenwood Addition to the City of Fort Worth, Tarrant County, Texas, as appears in deed from R. Vickery to C. Cummings dated January 24, 1905, and recorded in Book 402, at page 475, of the Deed Records of Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently vacated as a waterway or water-drain easement. (b) This abandonment and closing of the aforedescribed waterway easement is conditioned that in the event a building is constructed on Lots 6 and 7, Block 16, Glenwood Addition, the builders of such build- ing shall bear the expense of replacing the existing sanitary sewer line lying between Lots 6 and 7, Block 16, with cast iron pipe, or, in the alternative, the expense of rerouting said sanitary sewer line under the direction of the City Engineer. SECTION 2. That the fee to the land in said easement above described be here- by released except where a reservation or condition is made, and that the land revert to the adjacent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4* That this ordinance shall take effect and be in full force and ef- fect from and after the date of its passage. PROVED AS TO sistant City Attorney
