AN ORDINANCE VACATING AND EXTINGUISHING A PORTION
OF WEST HUMBOLT STREET, BETWEEN ST. LOUIS AVENUE
AND GALVESTON AVENUE, SITUATED ADJACENT TO LOT 1R1R
BLOCK 1 IN THE VANDERVOORT ADDITION AND BLOCK 4
MULKEY SUBDIVISION IN THE CITY OF FORT WORTH,
TAI2RANT COUNTY, TEXAS AS RECORDED IN CABINET B, SLIDE
3156 AND VOLUME 31, PAGE 278, OF THE PLAT RECORDS OF
TA1tRANT COUNTY TEXAS; AND CONTAINING
APPROXIMATELY 0.287 ACRE OF LAND, MORE OR LESS;
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE
RETAINIVIENT OF EXISTING UTILITY EASEMENTS; REPEALING
.ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of West Humbolt Street, between St. Louis Avenue and Galveston Avenue,
situated on the adjacent to Lot 1R1R, Block 1 Vandervoort Addition, an addition to the City of
Fort Worth, Tarrant County, Texas as recorded in Cabinet B, Slide 3156 of the Plat Records of
Tarrant County and Block 4 of Mulkey Subdivision, a subdivision in the City of Fort Worth, as
recorded in Volume 31, Page 278 of the Plat Records of Tarrant County Texas; and containing
approximately 0.287 acre of land, more or less, and as more specifically described in Exhibits
"A" and "B" attached hereto and incorporated herein by reference, be and the same is vacated
and extinguished.
SECTION 2.
That the fee to the land in the above-described street and alley rights-of--way is released and
shall revert to the adjacent owner as provided bylaw.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect upon adoption.

A portion of West Humbolt Street and Galveston Avenue situated an the southwest side of Lot 1 Rl R
Block 1 VANDERVOORT ADDITION, an addition to the City of Fart Worth Tarrant County, Texas
according to the plat thereof recorded in Cabinet B, Slide 3 I S6 of the PIat Records of Tarrant County,
Texas and on the north side of Block 4 of MULKEY SUBDIVISION, a subdivision in the City of Fort
Worth, Tarrant County, Texas according to the plat thereof recorded in volume 31, page 278 of the said
Plat Records, said portion of West Humbolt Street lying between St. Louis Avenue and Galveston
Avenue and described by metes and bounds as follows:
Beginning in the most southerly west line of said Lat 1R1R in the east Line of said Galveston Avenue
from which the southwest corner of said Lot 1R1 R bears south 20$-19/100 feet.
Thence west, crossing said Galveston Avenue to and along the north line of said Block 4 and the south
line of said West Humbolt Street, 2S0 feet to the northwest corner of said Block 4 in the east line of St.
. .
Loins A"venue.
Thence earth, crossing said West Humbolt Street, SO feet to the southwest corner of Stock 1 of said
MULKEY SUBDNISION.
Thence east, along the south line of said Block 1 and the north line of said Humbolt Street to and along
the south line afsaid Lot 1RIR, 2S0 feet to a mark "Y" in concrete recovered for a re-entrant corner of
said Lot 1 RIR in the east line of said Gavveston Avenue.
The south, along the west line of said Lot 1R1R and the east line of said Galveston Avenue, SO feet to the
place of beginning and containing 12,500 square feet.
The basis for bearings is the east line of Block 1 per plat call.

Adopt an Ordinance Vacating a 0.287 Acre Portion of West Humbolt Street between St. Louis
Avenue and Galveston Avenue in the City of Fort Worth
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a portion of West Humbolt Street right-of-way between St. Louis Avenue
and Galveston Avenue, being approximately 50 feet wide by 250 feet long (consisting of 0.287 acre of land)
adjacent to lot 1 R1 R, Block 1, in the Vandervoort Addition, located in the City of Fort Worth, as filed in
Cabinet B, Slide 3156 of the Plat Records of Tarrant County, Texas, and Block 4, in Mulkey Subdivision,
located in the City of Fort Worth, as filed in volume 31, page 278 of the Plat Records of Tarrant County,
Texas; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (MC G-15624).
DISCUSSION:
Brookes Baker Surveyors of Fort Worth, on behalf of Kroger (Vandervoort's Dairy Foods) requests to
vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property for
the purpose of developing secured parking areas as encouraged by the Department of Homeland Security.
The City Plan Commission recommended approval of this request at its meeting on November 17, 2006. An
acceptable replat (FS-06-178) has been received. Any existing utilities will be relocated at the applicant's
expense, or retained within a designated easement, along with an appropriate plat note that no permanent
structures may be constructed or placed thereon.
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under or adjacent to the above referenced right-of-way. Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived.
This request is in COUNCIL DISTRICT 8.

The Finance Director certifies that this action will have no material effect on City funds.
