COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (CITY) and Freese & Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 34445, (the CONTRACT) which was authorized by the City Council by M&C C-21884 on the 12th day of December, 2006; and subsequently revised by Amendment Number 1 which was authorized by the City Council on the 9th day of October, 2007 (M&C C-22439) ; WHEREAS, the Contract involves engineering services for the following project: Precinct Line Road from Hurst Boulevard to Concho Trail (Project No. 00147) ; WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in the proposal letter dated July 25, 2007, copies of which are attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $576, 320 . 00 . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $839, 666 . 00 . _ i 7 ' v IKE, aoiu ? The overall project is approximately 4200 linear feet in length. Precinct Line Road will be designed as a Major Arterial in accordance with the Master Thoroughfare Plan, which will provide a 4-lane divided roadway section. TxDOT is designing the Precinct Line Rd bridge over Walker Branch located just north of the Trinity Boulevard intersection. The bridge is approximately 300' in length with 150' on the north side of the bridge and 250' on the south side of the bridge for an overall length of 700'. The Precinct Line Rd/Trinity Blvd intersection improvements and the bridge upgrades are the responsibility of TxDOT (CSJ 0902 48 539). The CONSULTANT is responsible for the limits of Precinct Line Rd less the TxDOT project and will be referred to as the CITY project. CONSULTANT is also responsible for widening Trinity Blvd at Precinct Line Rd to provide left turn lanes on Trinity Blvd. The widening of Trinity Blvd. will be locally let as a separate project following the Precinct Line Road project. This scope of services is for CONSULTANT to provide a final engineering design (plans specifications, and estimate) in accordance with TxDOT requirements for CITY Project. Cross sections of the CITY Project will be prepared as well as design of necessary water and sewer adjustments, coordination with the TxDOT Project, opinions of probable construction costs environmental permitting and a project schedule. All design plans shall be prepared by, or under the direct supervision of a Texas licensed professional engineer who is a regular full-time employee of a firm registered in Texas. It shall be the responsibility of the CONSULTANT to provide plans, specifications and opinion of probable construction costs in accordance with TxDOT criteria for this project consistent with the following Scope of Services: A. Additional FIELD SURVEYING: 1. Topographic survey west of Precinct Line Rd starting from approximately 100 feet west of the second box culvert under the THE railroad and extending southerly to the north ROW line of Trinity Boulevard. The westerly limits of the of the topographic survey shall extend to the top of the west & southerly bank of Walker Creek and encompass approximately 19 acres of land. 2. Provide topographic survey east of Precinct Line Rd beign approximately 175' wide and starting from the south ROW line of the THE railroad and extending southerly to the channel flowline of the Calloway Branch just north of the Trinity Blvd ROW. 3. Provide a tree survey for approximate 19 acre tract described in item 1 above, to include all trees six (6) inches and larger in diameter. Page 1 AMMENDMENT TO ATTACHMENT A CITY CONTRACT NO. 34445 30% DESIGN THROUGH FINAL DESIGN SCOPE OF SERVICES 4. Subsurface Utility Engineering Level 'B' for all additional topographic survey areas. 5. Provide 10 post construction cross sections along Walker/Calloway Branch. Seven sections will be taken upstream of the bridge and 3 will be taken downstream. The sections shall include the upstream and downstream bridge face. Prepare a digital design drawing file showing the cross sections and the topographic information located on the bridge. 6. Provide topographic survey along Trinity Boulevard extending west 1000-feet and east 800-feet from the previous survey. Provide deed research and obtain deeds and plats of properties along the new limits of the topographic survey. Provide Subsurface Utility Engineering (SUE) within the right-of-way along the new limits of the topographic survey in accordance with ASCE Cl/ASCE 38-02. B. ENVIRONMENTAL PERMITTING AND COORDINATION: Preparation of an Individual Section 404 Permit Application including a conceptual mitigation plan, archeological investigations based on existing information. Wildlife Habitat Appraisal Procedures and a presence/absence survey for federally listed threatened or endangered species are not included in this scope. C. GEOTECHNICAL INVESTIGATIONS AND PAVEMENT DESIGN ALTERNATIVES: 1. Four pavement design alternatives will be developed using the traffic projection information provided by TxDOT. The pavement alternatives will include two Asphalt and Concrete sections one in accordance with TxDOT criteria and one in accordance with CITY criteria. The two concrete designs were included in the 30- percent design. The two asphalt designs are included in this amendment. 2. Perform subsurface explorations for borrow locations resulting from channel excavations. A maximum of 5 borings will be performed to a depth of 10'. The soil investigations will be performed to determine suitability of material for use as borrow material. 3. Provide language for embankment material recommendations. 4. Provide recommendations for the maximum stable side slope for the raised pavement section, based upon soil type. Page 2 AMMENDMENT TO ATTACHMENT A CITY CONTRACT NO. 34445 30% DESIGN THROUGH FINAL DESIGN SCOPE OF SERVICES D. HYDRAULIC AND HYDROLOGIC ANALYSIS A hydrologic and hydraulic analysis will be performed to evaluate the effects of the roadway improvements on Walker and Calloway Branches and, conversely, determine what effect the creek hydraulics have on the design of the roadway. The hydrology and hydraulic scope of services includes the following: 1. Hydraulic Analysis Analyze a maximum of three (3) alternatives to minimize the water surface elevations and environmental impacts. The analyses will include various channel/pond configurations to decrease the water surface elevations. 2. Hydrology Develop new hydrology for each of the channel alternatives using the effective SWFHYD models. This includes the redefining the storage outflow characteristics to reflect the effects of the channel improvements and recalculating flows. 3. Economic Analysis of Alternatives Develop a cost analysis of each alternative to compare channel/pond improvement cost to roadway fill costs. 4. Channel/Pond Design Plan Preparation Prepare plans and details in accordance with regulatory requirements and CITY criteria, prepare quantities in accordance with TxDOT criteria for selected channel/pond alternative chosen for construction. 5. Coordination Coordinate with CITY, USACE, FEMA and other authorities having jurisdiction as needed during final design and plan preparation. 6. CLOMR Preparation Develop the CLOMR submittal for the City of Fort Worth in accordance with FEMA guidelines and NFIP regulations. 7. LOMR Preparation Analyze post construction cross sections for plan compliance. Develop new hydrologic and hydraulic model if cross sections reveal as-built conditions differ from plans. Create a topographic workmap, and prepare submittal documents to include annotated firm, MT-2 forms, and report. E. RAILROAD CROSSING SIGNAL ENGINEERING PLANS 1. Review existing railroad signal and proposed roadway plans and develop preliminary signal plans to address vehicular and pedestrian traffic. 2. Secure concurrence of preliminary signal plans 3. Develop final signal plans and budget level cost estimate for the gate installation 4. Prepare technical specifications for RR signal portion of the project 5. Signal adjustments or temporary signal plans for construction phasing of the project. F. FINAL DESIGN SERVICES: 1. Address all comments from Schematic Design submittal. Prepare subsequent design interval submittals in accordance with TxDOT criteria. Address all comments from each of the subsequent submittals 2. Finalize roadway and drainage design documents based on applicable TxDOT and CITY design standards. 3. Prepare final design documents for the roadway plan and profile, drainage plan, and estimated construction costs for CITY project to be included with TxDOT project which will include: a. Evaluation of pavement design options; b. Roadway cross sections at 50' intervals for CITY project and at all drive entrances or crossing transportation facilities c. Technical specifications for utility appurtenance adjustments during construction. d. Quantity summary for CITY project in accordance with TxDOT criteria for each submittal Page 4 AMMENDMENT TO ATTACHMENT A CITY CONTRACT NO. 34445 30% DESIGN THROUGH FINAL DESIGN SCOPE OF SERVICES e. Opinion of probable construction cost for each submittal f. Existing utility plan sheets g. Intersection layout and grading plan for THE railway crossing without consideration of a future rail. h. Horizontal control for Precinct Line Rd i. Typical sections j. Hydraulic data sheets k. Pavement marking layout 4. Work with adjacent property owners to provide a maximum of 3 alternatives for driveway and entrance options. 5. Prepare Traffic Control Plans and sequence of construction plans for CITY project. 6. Provide layout plan for street light locations at street intersections as well as conduit and pull boxes for future street lighting. 7. Railroad Crossing Plan Exhibit A Layout. 8. Storm Water Pollution prevention plan. 9. Prepare plans and specifications for intersection improvements associated with adding left turn lanes on Trinity Blvd at the Precinct Line Rd intersection. G. BID PHASE SERVICES Attend pre-bid conference and prepare Addendum during the bidding phase. H. ADDITIONAL SERVICES Providing support for a Public Hearing is not included in the scope of services as it is not known at this time if one will be warranted by the stakeholders or the level of effort that TxDOT will request from CONSULTANT in conducting the meeting Level of Service analysis is not included in the scope of services. Blanton and Assoc. will be providing 404 permitting services. This will result in a 33.9% ($284,460.00)portion of the contract that will be performed by approved M/WBE firms, which exceeds our goal of 28.0%for the Project. ATTACHMENT B COMPENSATION AND SCHEDULE SCHEMATIC DESIGN(30%)TO FINAL DESIGN OF RECINCT LINE ROAD SOUTH OF HURST ROAD TO SOUTH OF CONCHO TRAIL (EXCLUDING TXDOT BRIDGE) I. COMPENSATION A. The ENGINEER hall be compensated at a lump sum fee of$576,320.00 for Basic Services as summarized on Exhibit `B-1." Payment of the fee shall be considered full compensation for the services described in Attachment A for all labor, materials, supplies, and equipment necessary to complete the project. B. Partial payment shall be made monthly upon receipt of an invoice from the ENGINEER, prepared from the books and records of the ENGINEER. Each invoice is to be verified as to its accuracy and compliance with the terms of this contract by an officer of the ENGINEER. Payment according to statements will be subject to certification by the Director of Transportation Public Works or his authorized representative that such work has been performed. H. DISCUSSION: The 2004 Capital Improvement Program (CIP) contains $635,000 for design and construction of this four-lane divided roadway 1,000 feet north and south of Trinity Boulevard, and $1,650,000 for the reconstruction of the bridge over Walkers Branch. In addition, $444,000 was set aside in the Special Assessments Fund for the project. Subsequently the 2006 Tarrant County Bond Program approved $2,729,000 to supplement City of Fort Worth funding for Precinct Line Road with extended limits on the north to SH-10; and $800,000 additional Federal transportation funding has been earmarked for Precinct Line Road with extended limits on the south to Trammel Davis Road. On December 12, 2006, (M&C C-21884) the City Council adopted Ordinance No. 17315 finding that a material change had occurred for the 2004 Capital Improvement Program street reconstruction project, Precinct Line Road from 1,000' North of Trinity Blvd to 1,000' South of Trinity Boulevard, to extend the limits from Hurst Boulevard (SH 10)to Trammel Davis Road; and authorized the City Manager to execute an Engineering Services Agreement with Freese & Nichols, Inc. in the amount of$263,346.00 for the schematic design of Precinct Line Road from Hurst Boulevard to Trammel Davis Road (City Secretary Contract No. 34445). This engineering services amendment is needed for the preparation of surveys, environmental documents, final construction plans and specifications for the reconstruction of Precinct Line Road from Hurst Boulevard to Concho Trail. During the schematic design phase, it was determined that the southern project limit needed to be shortened from Trammel Davis Road to Concho Trail because of additional expenses required for file://C:\Documents%20and%20Settings\weissm\My%20Documents\Precinct%20Line%20Road\C-22439... 10/12/2007 M&C Request Review Page 2 of 2 environmental mitigation, right-or-way acquisition, and roadway construction. The existing two-lane rural roadway will be improved to a four-lane divided roadway with curb and gutter. The initial scope of work was for initial planning and schematic design services. Freese & Nichols, Inc. did quality work in preparing the schematic design, and are best qualified to continue with the final engineering services. Freese & Nichols, Inc., has proposed to perform the necessary surveys, environmental documents, final plans and specifications for a lump sum fee of$576,320.00. City Staff considers this fee to be fair and reasonable for the scope of services to be performed. Freese & Nichols, Inc., is in compliance with the City's M/WBE Ordinance by committing to 32 percent M/WBE participation on this amendment. The City's goal on this amendment is 32 percent. This project is located in COUNCIL DISTRICTS 4 and 5, MAPSCO 52Z, 66D, and 67A. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinances , funds will be available in the current capital budget, as appropriated, of the 2004 Street Improvements Fund.
