AN ORDINANCE CLOSING, VACATING AND PERMANENTLY ABANDONING AN ALL4YWAY LOCATED BETWEEN THE NORTH LINE OF NORTH TWENTY FIRST, STREET AND THE SOUTH LINE OF NORTH TWENTY SECOND STREET MORE PARTICULARLY DESCRIBED HEREIN; DECLARING THAT THE PUBLIC NECESSITY AND CONVENIENCE DE7:1AND SUCH ACTION AND THAT A FURTHER CO;LCITfATION OF SAID AILLYWAY CONSTITUTES A NUISANCE; PROVIDING THAT THE EFb'ECT OF THIS ORDINANCE SHALL OPERATE AS A QUITCLAIM DEED TO THE ABUTTING PROPERTY OWNERS AS 'TO THE ALLEYWAY CLOSED; PROVIDING THAT THE CITY SHALL AT ALL TIMES HAVE THE PRIVILEGE OF A RIGHT OF WAY IN, TO AND THROUGH SAID ALLEYWAY SO CLOSED VACATED AND ABANDONED WITHOUT CHARGE; PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE DZZDIATELY FROM AND AFTER THE DATE OF ITS PASSAGE. WHEREAS, It appearing to the City Council of the City of Fort Worth, that the alleyway now existing between the North line of North Twenty-first Street and the South line of North Twenty-second Street, through Block 175 of the M. G. Ellis Addition to the City of Fort Worth, Tarrant County, Texas, is not now being used as a public thorough- fare and never has been used as such; that it constitutes a nuisance and that the public necessity andconvenienoe demand that such alleyway be closed, said alleyway being more particularly deaoribed as follows, to wit: Beginning at the Southwest corner of Lot 1, Block 175 of the G. Ellis Addition to the City of Fort Worth; Thence North through said Block to the Northwest corner of Lot 11 of said Block; Thence West a distance of 20 feet to the Northeast corner of Lot 12 Block 175; Thence South to the Southeast corner of Lot 22 Block 17b; Thence East 20 feet to the place of beginning; and, WHEREAS, all of the property owmers fronting West on North Main Street in the block mentioned and all of the property owners fronting East on North Commerce Street in the Block mentioned, being all of the property owners abut- ting on said alleyway described above, which is designated to be closed, have assented to the closing of the same and have petitioned the City Council in writing that said alley- way be closed, and have assented to the closing of the same and have accepted a reversion and repeal of any and all rights in and to said alleyway from the City of Fort Worth except that the same shall revert one half to each of said property owners abutting theron. NOW THEREFORE, �E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION ONE. That the follovd ng described sections and portions of an alleyway within the corporate limits of the City of Fort Vlorth be and the some is hereby declared to be permanently closed, abandoned and forever vacated for use as a public street, highway or thoroughfare, to wit: Beginning at the Southwest corner of Lot l B;ook 175 of theM. G. Ellis Addition to the City of Fort Worth Tarrant County, Texas; Thence North through said block to the Northwest corner of Lot 11 of said Block; Thence West a distance of 20 feet to the Northeast corner of Lot 12, Block 175; Thence South to the Southeast corner of Lot 22 Blool. 175; Thence East to the place of beginning. SECTION TWO. That thepermanent closing, vacating and abandoning of the above described alleyway is hereby declared to be a public necessity and the continuation thereof as a public highway or thoroughfare declared to be a public menace and nuisance, and that this ordinance shall operate as a quitclaim dead from the City of Fort Worth to the abutting property owners, resigning and discharging any and all claims of the City of Fort Worth to use the same as a public highway and thoroughfare, but the privilege of using the same for right of way purposes at any time is hereby expressly reserved by. said City, for the use of public utilities. At a regular meeting of the City Council of the City of Fort Worth held in the Council Chambers in the City Hall in the City of Fort Worth,on Tuesday July 1927 the Secretary Treasurer being in attendance and a quorum being present, Councilman seconded by Councilman moved the adoption of the foregoing ordinance and samehaving been read ennsidered and put to a vmte, and all voting "Aye thereon and none voting "No" the same was declared to beunanimouslyadopted and ordered spread upon the minutes.
