ROAD AT?D PORTIONS OF SUNDRY OTTER STREETS, A P_,N1 S AND PIBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTR0.CT IVTT T. TEXAS BITULITHIC COMPANY FOR THE CON- STRUCTION OF SAID IMPROVEDENTS FULLY COMPLETED AND PER- FORMED; DIRECTING THE ISSUANCE, EXECUTIOT AND DELIVERY OF CERTIFICATES IN EVI')EPICE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CR?DITS HEREIN AUTHORIZED ,'i�'D ALLOtP77) AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO EFGROSS AND EIROLL T?':IS ORDINANCE BY COPYING THE CAPTION OF SAME iN T??E MINUTE BOOK OF THE. CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE R=RDS OF SAID CITY: A?iD PROVIDING AN EFFECTIVE DATE. WHEREAS, The City of Fort ,forth, Texas, has heretofore entered into a contract ;,with Texas Bitulithie Company for the making and construction of certain street improvements on the hereinafter described portion of Grinbury Road in said City, to-wit: ^rranbury Road: From the Easterly line of Trail Lake Drive to the Northeasterly line of Lot 14, Block 24, Blue- bonnet Hills Addition. WHEREAS, by sundry proceedings heretofore passed by the City Council of the city of Fort North, Texas, including Ordinance No. 4451, a portion of the cost of said improvements was levied and assessed against the respective properties abutt- ing on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, ?^riEREAS, th:� City Council of the City of Fort Worth, Texas, has, upon review, 'found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of th, assessments levied by Ordinance No. 4481, and, 1,1HER'?AS, the street improvements hereinabove mentioned have been com- pleted upon each of the portions of streets, avenues and public places hereinabove des- cribed, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT CRDAINrD BY T tE CITY COUNCIL OF T" CITY OF FORT '10 71, TEXAS, T"AT: I. The improvements on eac"i of the portions of streets, avenues and public places hereinabove described be, and they are hereby accepted, and the contract with reference thereto be, and it is hereb;-, found and declared fully completed and performed. II. The Kayor be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest sane and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assess- ment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of property assessed. and shall be issued in the amount equal to the difference between the principal amount of the assessment and the amounts of any credits issued thereon. The numbers of the certificates, wit the property des- criptions to be shown on t' e respective certificates, together with the names of the ovmers of said property, thr principal amount of the assessment, the respective credits, if any, which are hereby authorized, granted and allowed against the nrihcipal amount of some one or more of the assessments heretofore levied., and the: principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerat^d an:' itemized as follows: III. When each of the certificates have been duly executed as hereinabove provided, same shall be delivered to Texas Bitulithic Company as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City.
