Provided, however, that any owner shall have the right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and accrued interest, and provided further that if default shall be made in the payment of principal or interest promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of Fort Worth,or its assigns,be and become immediately due and payable, and shall be collectable, together with reasonable attorne'v's fees and cost of collection, if incurred, PROVIDED, however, that acting through its duly authorized Director of Public Works the City of Fort Worth retains the right to authorize payment of the sums assesed against abutting'property upon such completed and accepted unit in not more than forty-eight (18) equal regular monthly installments of not less than $9.00 each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit. VIII. Although the aforementioned charges have been fixed, levied, and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where deemed appropriate.Notwithstanding the City Council has herein reserved the right to issue credits, it shall not be required to issue credits, and will not do so, if same would result in any equity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of Fort Worth, Texas,as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment hereinabove levied such amount or amounts,if any,as may hereafter be allowed by the City Council as a credit against the respective assessmepts. IX. The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectable, with reasonable attorney's fees and costs of collection, if incurred, and shall provide substantially that the amounts evidenced thereby shall be paid to the Assessor and Collector of Taxes of the City of Fort Worth,Texas, who shall issue his receipt therefor, which shall be evidence of such payment on any demand for the same, and the Assessor and Collector of Taxes shall deposit the sums so received by him forth- with with the City Treasurer to be kept and held by him in a separate fund, and when any payment shall be made in the City the Assessor and Collector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said payment thereof. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Treasurer's Warrant for making such payment. Such payments by the Treasurer shall be receipted for the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney's fees, if incurred, have been paid in full. Said certificates shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law,and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of Fort Worth,or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. s o W U O 7 d a °° M a C 404 60 0 a o 0 0 N co A VI as N t 3 ?. to 60 to 1fl a O O O O Q W 7 O 7 O of O aN N 7 ► H to /A !R tb a 0 o 0 0 0 y o o O O i N N N - u w w w CFJc '-1 e-I r-1 p 6R 44 to WR fA to to 2 a N n o of o 000 a U)N N N ll N V1 Ln 1, R' - LCCCu3JJJ N t4 to to 64 to !A to N O e- 1 O N N F O of O O O 1O W N 1 g w w w a ~wag o o cn cn acaww N N u o tv 54 (i! u p 7G E- ta W pppr7 t1 f z Ir i °o o .a $ w F• 4 s g a g 1-4 < a - z U) 0 C) C14 cq C14 C14 C4 0 F-4 0 O O O 0 0 C,4 Cn E-4 W z CL. WORTH, TEX. OADWAY WIDTH R.O.W. 1 N.W. 31st Street Kearney Avenue to Lydon Street 30 feet 60 feet 2 N.W. 30th Street Kearney Avenue to Lydon Street 30 feet 60 feet 3 N.W. 32nd Street Long Avenue to Rosen Avenue 30 feet 60 feet 4 N.W. 32nd Street Rosen Avenue to McKinley Avenue 30 feet 60 feet 5 Lincoln Avenue N.W. 26th Street to 300 feet 30 feet 80 feet north 6 N.W. 24th Street McKinley Avenue to Roosevelt 30 feet 60 feet Avenue 7 N.W. 22nd Street Loving Avenue to Columbus Avenue 30 feet 60 feet 8 N.W. 22nd Street Columbus Avenue to Chestnut Ave. 30 feet 60 feet 9 Refugio Avenue N.W. 22nd Street to 150 feet 30 feet 80 feet south It is the opinion of the Public Works Department that each parcel of property is benefitted in an amount equal to or in excess of the amount recommended for assessment. Construction of Cul-de-Sacs Because cul-de-sacs are needed on dead-end streets for turning vehicles, including heavy City waste disposal and other equipment, without entering private driveways, it appears to be advisable to construct cul-de-sacs whenever possible at the end of block fragments or on dead-end streets being improved on the assessment basis. The Public Works Department is now studying possible revisions in standard assessment policies which could provide for the construction of cul-de-sacs on such streets in the future, and is reviewing formulas for applying assessments in such cases. The construction of cul-de-sacs is under consideration for Unit 5 (Lincoln Avenue) and Unit 9 (Refugio Avenue) where paving to a dead-end is provided in the contract. Details of the proposed cul-de-sacs are included in the attached resume of the project. Because the feasibility and cost distribu- tion of the cul-de-sacs has not been determined, it is proposed the assess- ments be levied as proposed to avoid delay of this project and that con- struction of the cul-de-sacs be submitted for Council review and approval by change order to the contract if the cul-de-sacs are forFICIAL o and desirable. The procedures concerning owner participation in the cost of paving, including methods and policies of determining assessments, street construction standards, and methods of payment were explained to the 17 persons in attendance. UNIT ,-24th STREET - McKinley Avenue to Roosevelt Avenue Mrs. Dunlap, speaking in behalf of her mother, Mrs. Lexie Loyd, wanted to know why Lots 1 & 13, Block 30, were zoned "C" Apartment and why their assessment was' higher than the two lots _across the street. It was explained that she would have to check with Planning and Zoning in regard as to ,why the property was "C" Apartment. She stated that she has written to Zoning for her mother to get it re-zoned. It was explained to Mrs. Dunlap that since the property was not zoned Residential, the rate would remain at $6.40 per foot. She was assured that if the property is re-zoned any time before the project is completed, Mrs. Loyd could then receivT dentialcredits. Y SEA RD fr R'IARY UNIT 7. 22nd STREET' - Loving Avenue to Columbus Avenue ; l Joe Koci, Lot 5, Block 2, stated that the other portions of this street are hot-topped. It seemed to him that this portion of the street should also be paved with penetration asphalt. He asked that the City inspect the drainage As there seemed to be a mistake made whey► the storm drains were constructed and the system does not carry all the water. He stated that he. has to replace the drain cover each time it rains. It was explained to Mr. Koci that hot-topping is not done within the City anymore and that 6" Hot-mix Asphaltic Concrete is standard for residential areas. In response to the drainage complaint, the Engineering Division is conducting a study of this problem. A second or relief storm drain system was constructed in 1965 to relieve the existing system in providing adequate drainage in this area. Further drai.,.., _ studies are being made and should it be determined that additional inlets are desirL- _, they will be constructed prior to the paving of the street. John Pi-,pin, Lot 4, Block 2, stated that his complaint was, also, on drainage, and he would like this problem solved before 'the paving was done. Reference is made to the alcove response. I 1 4TTACHMENT "A" Page Three i . f UNIT 8, 22nd STREET - Columbus Avenue to Chestnut Avenue Charlie Russey, Lot 11, Block 11, asked why the street could not be hot-topped. It was explained to Mr. Russey that the sub-standard pavement is not used within the City anymore and that 6" Hot-mix Asphaltic Concrete was minimum standard for residential streets. Mr. Russey, also, asked if the paving would cause the taxes to go up. He was advised that usually any enhancement to property resulted in some change in taxes. Mrs. Pearl Tyson, Lot 1, Block 10, also, has a complaint about drainage and asked if the City could look into this matter before the paving is started. She was assured that the entire block will be investigated as to what can be acc=plished to assure the best drainage possible with the economic limit of drainage desi 8[MWr 9RD CITY SECRETARY ,UNIT 9. REFUGIO AVENUE - 22nd Street to 150' South FT• WQRTH TEX Mr. G. W. Smith, Lot 11, Block 153, stated he was definitely opposed to the paving since he found out it would be expensive 6" Hot-mix Asphaltic Concrete and not inex- pensive "hot-topping". The Fort Worth Independent School District, after bids were received for the paving of Refugio Street, requested that a cul-de-sac be constructed at the dead end. The School District dedicated necessary right-of-way and plans are being made to.include the cul-de-sac in the contract.
