HomeMy WebLinkAboutOrdinance 6683 ORDINANCE NO. 6683 AN ORDINANCE AMENDING CHAPTER 16 OF EXHIBIT "B" OF THE ELECTRICAL CODE OF THE CITY OF FORT WORTH, SAID ORDINANCE CONCERNING CERTAIN EXCEPTIONS TO THE PROSCRIBED METHODS OF WIRING; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMU- LATIVE OF OTHER ORDINANCES AND PROVISIONS OF THE ELECTRICAL CODE OF THE CITY OF FORT WORTH; RE- PEALING ALL ORDINANCES OR PROVISIONS OF THE ELEC- TRSCAL CODE OF THE CITY OF FORT WORTH IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT Special Exception (2) of Section 1601 of Chapter 16, "General Wiring Methods and Materials" of Exhibit "B, " at- tached to and incorporated by reference in the Electrical Code of the City of Fort Worth, be and the same is hereby amended and, after being so amended, shall hereafter read as follows: "(2) The provisions of this section shall not apply to Group H apartment houses, Group 1Occupan- cies and Group J Occupancies, as same are defined in the Fort Worth Building Code. The provisions of this section shall apply to the separate branch service conductors to individual apartment breaker panels, to occupancies other than Group H apartment houses, Group I Occupancies and Group J Occupancies located in the same building, and to occupancies where two or more washing machines or drying machines are located, and to mechanical buildings and other nonresidential occupancies." SECTION 2. THAT it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffegrtive or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3. THAT this ordinance shall be and is hereby declared to be cumulative of the provisions of the Electrical Code of the City of Fort Worth and amendments thereto, regulating and con- trolling the installation and alteration of electrical equip- ment, except in those instances where the provisions of this ordinance are in direct conflict with such Code, in which in- stances said conflicting provisions of such Code are hereby repealed. SECTION 4. THAT all pending litigations and existing violations, both civil and criminal, whether pending in court or not, under the Electrical Code of the City of Fort Worth and amend- ments thereto superseded by this ordinance shall not be af- fected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 5. THAT any person, firm, association of persons, company or corporation or their agents, servants or employees who violate, disobey, omit, neglect or refuse to comply with any provision of this ordinance shall be punished by a fine of not exceeding two hundred dollars ($200.00) , and each day that a violation exists is hereby declared to be a distinct and sep- arate offense and punishable as such, all as provided for in -2- Section 1-5 of Chapter I of the Code of the City of Fort Worth (1964) , as amended. SECTION 6. THAT this ordinance shall become effective and be in full force and effect from and after its passage and publi- cation as required by law, and it is so ordained. On January 31, 1972, the Council adopted Ordinance No. 6619, updating the Code and incorporating into it various local amendments. The Code presently permits the use of non-metallic-sheathed cable (Romex) in one and two family residential construction. The Department of Housing and Urban Development has advised the staff that the Code will have to be revised to conform to the National Electrical Code in order to permit re- certification of-the Workable Program. It will, therefore, be necessary to extend the use of non-metallic-sheathed cable to Group H - Apartments - construction. Metallic-sheathed cable will continue to be required for commercial, industrial and institutional buildings. Recommendations It is recommended that an ordinance be adopted revising the Electrical Code to permit the use of non-metallic-sheathed cable in Group H construction.
