AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
ATE. 38TH STREET FROM NORTH MAIN STREET TO 651 FEET EAST
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
+CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort.Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
/YF•UNIT 1: 4i. 38TH STREET From North Main Street to 651' East,
known and designated as Unit 1,
Project No. 104-24000-196, to be
improved with seven-inch thick hot-mix
asphaltic concrete pavement on an
eight-inch thick lime stabilized
subgrade, seven-inch high concrete
curb and two-foot wide concrete
gutter, so that the finished roadway
will be forty feet wide and by
constructing four-foot wide concrete
sidewalks and six-inch thick concrete
driveways where specified.
UNIT 2: COLUMBUS STREET From NW. 34th Street to NW. 35th Street,
known and designated as Unit 2, Project
No. 104-24000*4960 to be improved with
six-inch thick hot-mix asphaltic concrete
pavement on a six-inch thick lime
stabilized subgrade, seven-inch high
concrete curb and eighteen-inch wide
concrete gutter, so that the finished
roadway will be thirty feet wide and by
constructing six-inch thick concrete
driveways where specified.
UNIT 3: Columbus Avenue From NW. 31st Street to Angle Avenue,
known and designated as Unit 3, Project
No. 104-24000-196, to be improved with
six-inch thick hot-mix asphaltic con-
crete pavement on a six-inch thick
lime stabilized subgrade, seven-inch
high concrete curb and eighteen-inch
wide concrete gutter, so that the
finished roadway will be twenty-six
feet wide from NW. 31st Street to
NW. 32nd Street and thirty feet wide
from NW. 32nd Street to Angle Avenue.

together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with Nr ost Loyd
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
UNIT 1: NW. 38th STREET From North Main Street to 651'
East, known and designated as
Unit 1, Project No. 104-24000-196.
The estimated cost of improvements is $ 19*773.33 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 3.09 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 7.90 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for four-feet wide concrete sidewalk is $ 3.18 ; the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ .90 per square foot; the total
estimated amount per front foot to be as against abutting property and the owners
thereof is $ 14.07 , plus the cost incurred for concrete driveway construction
where specified.
III.
A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any intexept in any such pr perty. Such hearing shall be
given and held on the day of mom , 19 70 , at 9:30 A.M. ,
in the Council Chamber in the City Hall in tM7MCity of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May 12, 1967. Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the City of Fort Worth,
Texas , the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names of such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is Shawn, no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per-
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy of the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con.•
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

concrete curb and gutter is $ 2.85 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 6,51 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ -0- per square foot; the total
estimated amount per front foot to be assessed against abutting property and the

ASSESSMENT FAVINO AT 8 LOCATIONS ON THE NORTH SIDE
PROJECT NO, 104-24000-196
A Neighborhood hearing was ;conducted by the Engineering Division of the Public Works
Department at the Washington Heights Elementary School on April 13, 1970 at 7:30 p.m. ,
for the Assessment Paving of 8 Locations on the Forth Side.
Procedures concerning owner participation in the cost, method and policies of determining
assessments, street construction standards and methods of payment were explained by Mr.
Schmidt to the twenty-eight (28) persons present.
Unit 1, NE,, 38th Street: W, R� Hall, representing Freuhaf Trailer Company, Tract 1-A of
W. B. Tucker Survey was concerned with what type of pavement was to be used and asked about
credit being given on existing pavement.
Don Wills, representing Mobil Oil Company, Tract 1=8, W, B. Tucker Survey asked about the
radius of the curve from one driveway to North Main Street ,
S, A. Wakefield, Lot 24, Block 11, Fostepco Heights Addition did not see the necessity for
sidewalks. Also he said he did not need a forty-foot or fifteen-foot driveway, Jack
Daniels, Traffic Engineering Department, is going to talk to him,
Unit 2, Columbus Avenue: Walter ?lacy, lots 16 and 17, Block 4, Worth Hills Addition asked
about the reason for different types of pavement,
Unit 3, Columbus Avenue: Willie Kennard, Lots 22 and 23, Block 35, Oak Grove Addition
asked about the elevation on; his street and about lay down curb and gutter. This was ex-
plained by Mr, Schmidt„
Unit 4, forth Pecan Street.* Mrs, Lean Maggard, Lots 1 and 2, Block 80, Fostepco Heights
Addition, was concerned about the grade of the parkway, She has a fence on her property
and is afraid it will fall down and her yard will wash if the grade is steep.
Ira Ward, representing Earl ]Lamb, lots 21 and 22, Block 81, Fostepco Heights Addition was
very interested in getting the pavement since he is buying this property,
Mrs, Johnny Kratky, who came with her father, lots 7 and 8, Block 80, Fostepco Heights
Addition was interested in the difference In penetration and permanent type of pavement.
Mr. Jones Leonard Robinson asked the price of single driveway.
Unit 5, North Hampton Street, Carmen Vasquez, representing her mother, Delores Torres,
Lot 5, Block 86, Eostepco Heights Addition asked about assessment on this property. Also,
Mrs. Torres who is now Mrs, Vasquez is buying Lots 3, Block 86, Eostepco Heights Addition
for her daughter, Carmen, from Marion Goetsch,
Unit 6, NW. Loraine Street- No comment.
Unit 7, NW., 26th Street.- Eula Bundage, owner of W. 35 feet of Lot 12, Block 24, M. G. Ellis
Addition and Imogene and Ella Bundage, owners of West 1/3 of Lots 13 and 14, Block 24, M., G�
Ellis Addition did not understand owner occupied credit. This was explained.
Unit 8, Ross Avenue. Mrs, 3osie Giddings, Lots 11 and 12, Block 25, M, G. Ellis Addition
is against sidewalks and does not want a driveway on Lot 12, as she has no car.
Several people asked about hardship cases and Mr, Schmidt explained to them who came in
this category.
After a lengthy, but interesting period of discussion, the meeting adjourned.

Petitions have been received from property owners for the paving of all units,
except Unit 1, which was City initiated as a result of request from major
property owner and poll-card survey.
Sidewalks
Sidewalks have been included in Units 1, 7 and 8 of subject project for the
following reasons:
Unit 1, NE 38th Street: To tie in with existing sidewalks, to serve commercial
property and street also ties into a major thoroughfare - North Main Street.
Unit 7, NW 26th Street: To tie in with existing sidewalks and leads to Sam
Rosen Elementary School, some twelve (12) blocks west and to North Main, one
block east.

Unit 8, Ross Avenue: To tie in with 50% existing sidewalks.

Project Cost,and Financing
Based on the low net bid, approximately $88,403.31 will be assessed against
abutting property owners. The cost to the City-at-large will be approximately
$86,000.00, including engineering expenses, inspection and miscellaneous ex-
penditures.
A Bond Fund Transfer from Unspecified Funds is proposed to provide for the
City's portion of the cost of the project.

e) Making appropriations to cover indebtedness thereby.-in-
curred for improvements of the project named above.

3) An Ordinance be adopted:
a) Approving the estimates of cost and amounts proposed to be
