AN ORDINANCE REQUIRING CARNIVALS AND TENT SHOWS
EXCEPTING CIRCUSES TO HAVE LICENSE TO OPERATE
AND FIXING THE LICENSE FEE AND EXCLUDING THEM
FROM CERTAIN14PPORTIONS OF THE CITY.
WHEREAS, street carnivals and tent shows have been heft
In the City of Fort Worth every few months, and have often resulted
in large crowds congregating and engaging in unlawful conduct sad
in the viotimizing of many ignorant persons and becoming noisy
and disturbing the peace in the residential portions of the City,
requiring extra policemen and police regulation, and
WHEREAS, there is now no law regulating the licensing
and contr6lling of street carnivals or tent shows; now, therefore,
BE IT ORDAINED by the Board of Commissioners of the City
of Fort Worth:
1. It shall be unlawful to hereafterhold, sponsor or
run a street carnival or tent show in the city of Fort Worth unlea
a permit to hold such carnival or tent show is first obtained from
the City of Fort Worth in accordance with this ordinance. Each
person aiding or abetting the holding of such carnival or its
subsidiary shows, concessions, amusements and businesses or text
shows, shall be equally guilty of a violation of this article
when said carnival or tent show commences without such a permit.
E. A permit shall be issued by order of the Police and
Fire Commissioner to hold such carnival or tent show when and
only when a proper application in writing is made therefore and
to him. Such application shall state in detail the different
component parts of the carnival or tent show, including all
concessions, shows, amusements, businesses and the proposed
location of said carnival, the time it is to run and the number
of persons regularly traveling therewith., if any, and the number
of local persons connected therewith, and shall give a full and
and complete plan of the proposed carnival or tent show.
3. If the proposed carnival or tent show appears to be
entirely composed of lawful amusements and lawful enterprises
the Police and Fire Commissioner shall determine the number of
extra police necessary to properly superintend such carnival or
tent show and regulate the anticipated crowds and carnival or tent
show. Such Commissioner shall instruct the Assessor and Collector
of Taxes how many extra officers shall be needed and whether to
issue such permits.
The application for permit shall then pay a license
fee of One Hundred ($100.00) Dollars, together with Five ($6.00)
Dollars per extra officer per dW for som�any days that said
carnival or tent show is issued a permit to ran and the`Assesscr
and Collector of Taxes shall, issue the permit specifying the length
of time and the location. These fees are intended to be used for
regulating, inspecting, and policing such carnival or tent show
and shall be deposited with the City Treasurer in a police fund
for policing these carnivals or tent shows and shall be spent by
the police department for such purposes and is hereby appropriated
for such purposes.
4. If the proposed carnival or tent show consists
in part of any unlawful games or enterprises of any kind tt8 ISM;- -
shall be refuse& and if such carnival or tent show is issued a f
permit and it conducts itself in an unlawful manner in whole or in
part, its permit may be revoked by the Police and Fire Commissioner)
and fees paid shall be forfeited. +
6. It shall be unlawful for any carnival or tent
show to operate and no permit shall be issued for any carnival or
tent show to operate within the space of Three Hundred (300) Feet
from any residence, school, or church building within the City
limits of Fort Worth, Texas.
6. It shall be unlawful for any carnival or tent abcM
to operate in whole or in part after its permit expires or after
it is revoked for cause, and all persons assisting in such opera-
tion shall be guilty of an offense.
7. The Police and Fire Commissioner shall have
supervision of the Policing of said carnival or tent show.
B. Any person guilty of violating any provision of
this ordinance shall be fined not to exceed Two Hundred ($200.00)
Dollars.
9. The invalidity of any part hereof shall not
invalidate any other part.
10. This law shall not apply to street fairs
composed of local people for purely local charitable purposes
and without profit.
11. By reason of the absence of any law licensing
and regulating carnivals or tent shows, it is necessary for the
immediate preservation of public peace and safety that this
ordinance shall take effect upon its passage as provided in such
cases.
