LOUIS AVENUE BETPMN THE SOUTH DINE OF LF.UDA STREET AND THE SOUTH LINE OF DOWMAN STREET IN THE CITY- OF FORT WORTH UnER THE CONTRACT BETWEEN THE SAID CITY fiND THE METROPO- T.ITAN 'CONSTRUCTION COMPANY THYREOF, ASSIGNED TO ROACH & MANIGAN. BE IT ORDAINED BY THF. BOARD OF CO?P',"ISSIOKFR9 OF Tff, CITY OF FORT NART SECTION 1. The said city heretofore duly entered into a contract with the Metropolitan Construction Company to improve St. Louis Avenue between the South line of Leuda Street and the South line of Dowman Street, and thereafter said Metropolitan Con- struction Company duly gold, assigned and transferred all its rights, title, and interest in and to said contract to Roach 8c Manigan, a partnership, who assumed all the obligations of said Construction Company under acid contract; whisign ent was ly approved by said city by resolution adopted/ 19/0; and all of the official proceedings prescribed by the charter and ordinances of said city have heretofore been duly and regularly taken and enacted by the said city to enable it to levy, assess and. charge the part of the cost of the said Improvements re- quired by the said contract to be paid by the property abutting thereon and its owners, and each and every notice and hearing provid- ed for by the charter and ordinances of said elty 1-n that res�bt has been given and had. SECTION a The Poard of Commissioners of said city adopt- ed in making the apportionments and assessments bereinafter stated such rule of apportionment as would effect substantial equality and justice between the several property owners affected, having in view M�r the benefits received End burdens imposed on such owners respective- ly for the reason that in the opinion of the said Board the assess- ment of the cost of the sAid improvement against the property abutt- ing upon said fanprovement and its owners in the proportion of the frontage of the property of each owner to the whole frontage of property to be improved, and in accordance with the front foot rule ,4 or plan would in the opinion of the Board operate unjustly in parti- oaler vases; and in the assessments hereinafter recited on pert of such cost assessed against Any owner or his property is in excess of the special benefits hhereto in enhanced value thereof arising from the improvement. SECTION S. The said Board of Commissioners after having given the notice and afforded the hearing provided for in the charter of said city in respect to such assessments, duly inquired into. determined And adjudged all questions relatthg to the said assessment and to the regularity of the said improvement proceedings and the amount and validity of the assessments and oherge of person- al liability against the persons and property hereinafter recited, and determined that the said assessments and charges of personal liability hereinafter recited are legal, equitable and valid. SECTION 4. There is hereby assessed, charged End levied ageiast the several owners of property hereinafter named, and again- st the respective lots, treats or parcels of property ovmed by them respeetive'ly described opposite their names, Rbuttir.- on that pert of the and highway to be improved as aforesaid, the amount set opposite the names of the property owners end the property own- ed by them respectively, to pay their just share of the cost of the said improvement as the same has been and is determined and adjust- ed by said Board, that is to say: Y s v January 8th-1912. SECTION b. A lien in hereby crested and fixed against each and every lot, tract or perael of lend above described, sup- erior to all other liens, claims or titles except lawflsl texas, to secure the payment of the amount assessed and charged against the same as fforessld, together with interest and coats of collection including a reasonable attorney's fee when incurred, and the re- spective owners of the said tracts of land pre hereby declared to be personally liable for the payipent of the amount assessed against them, and the respective lots, tracts, cr parcels of land owned by them and hereinbefore desoribed, as aforesaid; and the Amounts so assessed and cherged shall be payable -es follows; one-third within thirty days after completion and acceptance of the work by the city; one-third in on a year, and one-third in two years after such date. ?.11 deferred payments, if no default is mode in the pay- ment of all installment when due, shell beer interest Kt the rate of six per cent per annum; but if default be made in the payment of any installment when due then the unpaid installments shall bear interest from date at the rate of eight per oent per ennum.
