HomeMy WebLinkAboutOrdinance 2584 ORDINANCE NO. 2 AN ORDINANCE ANENDING ARTICLE IX OF ORDINANCE NO. 1271, SAME BEING THE SANITARY CODE OF THE CITY OF FORT WORTH, BY CHANGING SAID ARTICLE AS SHOWN BE- LOW; PROVIDING FOR THE ISSUANCE OF PERMITS FOR CERTAIN OCCUPATIONS AND BUSINESSES AND PRESCRIBING THE FEES FOR THE SAME; REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A CUMULATIVE CLAUSE; FIXING A PENALTY FOR THE VIOLA- TION OF THIS ORDINANCE OF A FINE OF NOT NDRE THAN TWO HUNDRED DOLLARS (P00.00), AND MAKING EACH DAM VIOLATION OR EACH DAYS FAILURE TO COMPLY WITH ANY OF THE PROVISIONS OF THIS ORDINANCE A SEPARATE OF- FENSE; AND FIXING THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Article I%.of Ordinance No. 1271 be amended so that said arti- cle shall read as follows: ARTICLE I%. PERMITS Section 1. It shall be unlawful for any person, fire, association or corporation to operate or engage in any of the occupations, vocations or businesses listed or included in Section 2 hereof without first having made application in writing to the Director of the Department of Public Health and Welfare for a permit so to do and receiving and holding a permit to operate or engage in such occupation, vocation or business. The application shall be made upon forms prescribed and furnished by the Department of Public Health and Welfare, and shall set forth, among other things, the followings The name of applicant, the nature of the business, the location of the business, and such other in- formation as may be required by the Director of the Depart- ment of Public Health and Welfare. A permit in writing shall be issued to the applicant where applicant has complied with the requirements of all state statutes, city ordinances, and rules and regulations of the Department of Public Health and Welfare governing sanitation and protection of public health, and has furnished satisfactory proof of such compliance, together with satis- factory proof of future compliance for the term of the permit. Any permit granted hereunder shall remain in full force and effect for the fiscal year of the City of Fort Worth, beginning October lot and ending September 30th, unless sooner revoked for cause, and a failure to comply with any ordinance of the City of Fort Worth, or law of the State of Texas, or rule and regulation of the Department of Public Health and Welfare concerning sanitation and public health shall be deemed cause for revocation of the permit. A renewal permit shall be secured annually in like manner as the original. A fee shall be charged for each per®it as hereinafter described, and such fee shall be payable in full for any fraction of the fiscal year for which granted. Each permit granted hereunder shall be nontransferable, and shall be displayed conspicuously at all times within the place of business for which the permit is granted. Section 2. Each person, firm, association or corpora- tion engaged in one or more of the following occupations, vocations or businesses shall secure a permit as hereiabs- fore providedt Restaurant Dining Room Cafe Grocery Store Meat Market Bakery Food Peddler Food Factory Candy Store Soft Drink Establishment Soda Fountain Lunch Counter Hamburger Stand Watermelon Stand Bottling Plant Water Distributor Hotel Tourist Camp Tourist Court Motel Theater Place of Public Amusement Transient Stock Company Carnival Circus Barber Shop Beauty Parlor Any other occupation, vocation or business where food or drink for human consumption is manufactured, stored, sold, or offered for sale, or given away or given in exchange Section 3. For each permit issued hereunder or under Ordinance No. 1271 a fee shall be charged and paid by per- mittee on the following basis.- - Restaurant - Dining Room - Cafe - Grocery Store - Meat Market - Bakery �00 - Food Peddler Fee - Food Factory - Candy Store - Soft Drink Establishment Soda Fountain - Lunch Counter - Hamburger Stand - Watermelon Stand (CONTINUED) - Bottling Plant - Water Distributor - Hotel - Tourist Camp - Tourist Court - Motel - Theater - Place of Public Amusement - Transient Stock Company - Carnival - Circus - Barber Shop - Beauty Parlor Fee - Any other occupation, vocation - or business where food or drink - for human consumption is manu- - factured, stored, sold or of- - fered for sale, or given Away - or given in exchange, excepting, - however, those places regulated - under city ordinances concerned - with a distinct industry, occu- - pation, vocation or business, - for which the permit fee shall - remain as designated in such - city ordinances - Hospital No - Maternity Home Fee - private School - Childrents Boarding Home SECTION 2. That this ordinance shall be cumulative of all the provisions of Ordinance No. 1271 and any other ordinance of the City of Fort Worth relating to sanitation and the issuance of .permits for certain occu- pations and businesses except in those instances where the provisions of this ordinance are in direct conflict with such provisions, in which instances said conflicting provisions are expressly repealed. SECTION 3. That any person, firm, association or corporation violating any of the provisions of this ordinance, or any person, firm, association or corporation failing or refusing to do any of the things therein re- quired, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than Two Hundred Dol- lars ($200.00), and each day's violation or each dayts failure to comply vith any of the provisions of this ordinance shall constitute a separate offense.
