HomeMy WebLinkAboutOrdinance 4884 r � ORDINANCE NO. � AN ORDINANCE GOVERNING THE OPERATION OF RAILROAD OFFICIAL RECORD VEHICLES IN THE CITY OF FORT WORTH, SETTING MAXI- 14JM SPEED LIMIT OF 20 MILES PER HOUR AT GRADE CITY SECRETARY CROSSINGS WITHIN A DESCRIBED AREA; AND AT GRADE CROSSINGS CONTROLLED BY FLASHING SIGNALS AND AT FT. WORTH, TEX. 40 MILES PER HOUR ELSEWHERE, MAKING THE ENGINEER PRIMA FACIE RESPONSIBLE FOR VIOLATIONS; PROVIDING A SAVINGS CLAUSE; MAKING THIS ORDINANCE CUHIJLATIVE OF OTHER ORDINANCES GOVERNING THE OPERATION OF RAIL VEHICLES, REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; PROVIDING A PENALTY OF THE VIOLATIONS THEREOF; AND NAMING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That Section 1 of Chapter 30 of the Code of the City of Fort Worth, 1950, be amended so that hereafter the same shall be and read as follows: Section 1. Speed Limits It shall be unlawful for any railway company to operate any engine, train or other rail vehicle with- in the corporate limits of the City of Fort Worth at a speed in excess of the following prescribed limits: (a) While crossing public streets at grade level within the hereinafter described area, the maximum law- ful speed shall be 20 miles per hour: An area bounded by the north right of way line of North Side Drive and the north right of way line of Yucca Street on the North; the east right of way line of Beach Street and the east right of way line of Mitchell Boulevard on the East; the south right of way line of Berry Street on the South; the west right of way line of University Drive on the West. (b) While crossing public streets at grade level elsewhere in the City of Fort Worth, the maximum lawful speed shall be 20 miles per hour; provided, however, that if said grade crossing is protected by flashing signals so located and operating as to give warning to all vehicular traffic traveling upon any public streets which intersect the railroad tracks at said crossing, the maximum lawful speed shall be 40 miles per hour. (c) In all areas where there are no grade crossings, the maximum lawful speed shall be 40 miles per hour. If any engine, train or other rail vehicle is operated within the . City of Fort Worth in violation of this ordinance, the engineer, con- ductor or person otherwise in charge of the operation of said vehicle shall be held prima facie responsible for such violation. SECTION 2. Should any section, clause or provision of this ordinance be declared by a court of competent ,jurisdiction to be invalid, the same shall not affect the validity of this ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 3. That this ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such ordinances or portions thereof as are expressly repealed hereby. SECTION 4. That any person who violates, disobeys, omits, neglects or refuses to comply with any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). SECTION 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. A variable speed limit ordinance has been formulated which contains the follow- ing provisions for the speed of trains : 1) While crossing public streets at grade level within the hereinafter describe area, the maximum lawful speed shall be 20 miles per hour: An area bounded by the north right-of-way line of North Side Drive and the north right-of-way line of Yucca Street on the north; the east right-of-way line of Beach Street and the east right-of-way line of Mitchell Boulevard on the east; the south right-of-way line of Berry Street on the south; the west right-of-way line of University Drive on the west. 2) While crossing public streets at grade level elsewhere in the City of Fort Worth, the maximum lawful speed shall be 20 miles per hour; provided, how- ever, that if said grade crossing is protected by flashing signals so located and operating as to give warning to all vehicular traffic traveling upon any public streets which intersect the railroad tracks at said cross- ing, the maximum lawful speed shall be 40 miles per hour. 3) In all areas where there are no grade crossings, the maximum lawful speed shall be 40 miles per hour. A map showing railroad lines, grade crossings, and types of protection will be available at the Council meeting. City Council action on this ordinance is requested.
