AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF
IMPROVEMENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS
ON A PORTION OF NEU STREET AND PUBLIC PLACES IN THE CITY OF
FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDI-
NANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE
CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPRO-
PRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore
ordered that each of the hereinafter described portions of streets, avenues and pub-
lic places in the City of Fort Worth, Texas, lbe improved by raising, grading and
filling same and by constructing thereon the following, to-wit:
1. Nell Street, Unit No. 1: lilt Hot Mix Asphaltic Concrete
Surface on 7" Cement Stabilized
Base on 30' Roadway Width.
2. Nell Street, Unit No. 2: lilt Hot Mix Asphaltic Concrete
Surface on 7" Cement Stabilized
Base on 30' Roadway Width.
together with combined concrete curbs and gutters on proper grade and line where same
are not already so constructed, together with storm sewers and drains and other necessary
incidentals and appurtenances; all of said improvements to be constructed as and where
shown on the Plans and in strict accordance with the Plans and Specifications therefore;
and contract therefore has been made and entered into with Glade Construction Company;
and
1ti7MEAS, the City Council of the City of Fort Worth, Texas, has caused the
Public Works Director to prepare and file estimates of the cost of such improvements
and estimates of the amounts per front foot proposed to be assessed against abutting
property and the owners thereof, and such estimates have been examined. NOW, THERE-
FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
THAT:
I.
Such estimates be, and they are hereby, adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each
portion of street, avenue and public place hereinafter described, with the amount or
amounts per front foot proposed to be assessed for such improvements against abutting
porperty and the owners thereof, are as follows, to-wit:
On Nell Street: From the South Line of Kelroy Street
to the North Line of Brookline Avenue,
Known and Designated as Unit No. 1,
The estimated cost of improvements is $29,129.90; the estimated amount
per front foot to be assessed against abutting property and the owners
thereof for curb and gutter is $1.60; the a stimated amount per front
foot to be assessed against abutting property and the owners thereof for
improvements exclusive of curb and gutter is $3.03; the total estimated
amount per front foot to be assessed against abutting property and the
owners thereof is $4.63.
On Nell Street: From the North Line of Brookline
Avenue to the North Line of Martin
Street, Known and Designated as
Unit No. 2,
The estimated cost of improvements is �22,261.10; the estimated
an.ount per front foot to be assessed against abutting, property and
the owners thereof for curb and gutter is �1.60; thee stimated
amount per front foot to be -assessed against abutting property and
the o-v-m.ers thereof for improvements exclusive of curb and gutter is
$3.03; the total estimated amount per front foot to be assessed

inst abutting property and the owners thereof is -4.63.
A hearing, be given and held by and before the City Council of the City of 2ort,
vJorth, Texas, to all owning or claiming -ny property ablittin.- upon said portion of
streets, avenues and public places, as well as to all owning or claiming any interest in
any such prooerty. Such he--iring shall be given and held on the 2nd day of April, 1962,
at 9:30 o'clock A.1,1., in the Council Chamber in the City .:all in the Cit Yy of Fort Worth,
Texas, and the City Secretary is hereby directed to rive notice of the time and place of
such hearing and of other mattcrs an_' facts in accordance with the teri.as and ,,rovisions
of an Act sassed at the 2irst Called Session of the Fortieth, Legislature of the State of
Texas, and i-nown as Jitapter 105 of the acts of said -session, now bein- si-own as Article
1105b of Wernonts Texas Civil Statutes. Such, notice shall be by advertisement at least
three times in _c newspaper published in the 'City of Fort ..,o-rth, 7exas, the first DUblica—
tion to be made at least ten d-,,s before the J_te of said 'hearino. Said notice shall
comply with and be in accordance with the terms and provisions of said Act. 'he City
Secretary is further directed to Dive nersonal notice of the time and place of such
hearing to all owning or claiming any property abutting on aid portions of streets,
avenues and public places, as well as to all owning or claiming any interest in any such
oro-oerty. Such personal notice shall be given by the City Secretary mailing said notice,
postage prepaid, to the respect!ve owners of record of the properties t o b e assessed, and
to any person owning or claiming any interest in.said properties, to the last known address
of said owner or persons. It shall not be necessar- for the City Secretary to mail said
notice to any oi%rner or other person claiming an interest in the property to be assessed
when the address of such owner or ot-er nerson claiming r an interest in the property to
be assessed is unknovin to the City b`ccretary and c-.:nnot be dcterTf.ined b,, the Cit j% Secre-
tary after reasonable investigation, in this connection, the City secretary shall prepare
and f ile these proceedings a list of the properties to be assessed, the naxiles of those
persons owning or claiming any interest in said properties to whom the notice was mailed,
together with the last known address of the respective o-,,mers and those persons owning or
claiming any interest in said property. The City Secretary shall certify that each of
the parties named in said list whose address was known to him, was mailed a coRr of the
notice of hearing and shall further certify the date or dates on which said notice was
mailed. A copy of the notice shall be attached to -luch certificate. The certificate of
the City Secretary will be conclusive evidence of the facts therein recited. Fa4lUy.e of

of the owners or other persons interested to receive said notice, shall in noorlse invali-
date said hearing of any assessments levied pursuant to said hearing, but notice of
hearing, shall be sufficient, valid and binding uoon all owning or claiming such abutting
property of any interest therein vfnen saj-,ie shall have been given by newspaper advertisement
as first hereinabove orovided.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the I-,inute Book of the City Council and by filing the
complete ordinance in the ap-propriate Ordinance hecords of this City.
V.
This ordinance shall take effect and be in full force an: effect from and after
the date of its passage.

Members of the City Council Assessment Paving on Nell Stree
City of Fort Worth Project No. 94-B4-26 CIP-A-105
Mrs. McKnight and Gentlemen:
On December 299 1961v an ordinance was adopted ordering the paving of Nell
Street on an assessment basis and awarding a contract for construction of
this project to Glade Construction Company on its bid of $519391. (M&C
PWI-731)
A date for the benefit hearing was not established at that time because
assessment rolls for the project had not been completed. The rolls can be
completed in time for a hearing on April 2p 1962p and it is recommended
that an ordinance be adopted approving the estimates of cost and amounts to
be assessed; and setting April 29 19629 as the date for the benefit hearing
on the assessment paving of the streets named below.
