HomeMy WebLinkAboutOrdinance 4484 ORDINANCE NO. � AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 9, EDWARDS HEIRS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the twenty foot north-south alley in Block 9, Edwards Heirs Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the fee to the land in said alley above described is hereby released and will revert to the owners as provided by law, save and ex- cept that easements are reserved for any and all existing utilities, the same being described as follows: A 10-foot easement for the existing sanitary sewer line measured five (5) feet on each side of the center line of the existing sewer; and An easement for facilities of the Southwestern Bell Telephone Company and Texas Electric Service Company located in the west ten (10) feet of said alley for a distance of one hundred (100) feet north of Pennsylvania Avenue. SECTION 3• That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION That this ordinance shall take effect and be in full force and ef- fect from and after the date of its passage. Honorable Mayor and Members of the City Council Re: Requested Alley Closing City of Fort Worth Block ,9, Edwards Heirs Addn. Mrs. McKnight and Gentlemen: A petition has been received from the adjacent property owners requesting the closing of the alley in Block 9, Edwards Heirs Addition. This closing is requested in order to consolidate commercial property and to provide for the +construction of apartment housing units. The Public Works Department and the City Piannfng Departmient have Investiga- ted this request and have found no objections to the requested closing pro- vided #asements are reserved for the existing mtilities. The alley -re- quested to be closed is as follows: The 20' North-South alley in Block 9, Edwards Heirs Addition to the City of Fort Worth, Tarrant County, Texas, SAVE AND EXCEPT easements be reserved for any and all existing utilities which are described as follows: A 10' easement for the existing sanitary sewer measuring 3' each side of the center line of the existing sewer; and the west 10' of the alley be reserved as an easement for-utility purposes for the distance of 1.001 north of PenFAyivania Avenue, said utilities in- cluding the Southwestern Bell Telephone Company facilities and Texas Electric Service Company fecifities. It is recommended that din ordinance be adopted for the closing of the alley in Block 9, Edwards Heirs Addition,as described Above. Respectfully submitted, LPC:ih .
