IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH J..

IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS-
MENT3 LEVIED AKER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP-
TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE,
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with T. L. M1FRAm OONSTR rTTojr gL imanmgTNC= for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public
places in said City, to-wit:
MD CLEBUBNE ROLD: From Wayside Azenue to Cantey Street,
kaovu and designated as Unit No. 2 of
8th Avenue, Project No. 094-23000-110.
IvH' S,-by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 52M , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial ,justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5280 , and
WHEREAS, the street improvements hereinabove mentioned have-been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT.
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro—
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as .past payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

Project Description
Name: Eighth Avenue Widening and Paving, Unit 2, Old Cleburne Road
from Wayside to Cantey.
Contractor: J. L. Bertram Construction and Engineering, Inc.
Contract Awarded: October 26, 1964 (M&C C-389)
Work Order Issued: February 17, 1965
Work Order Effective: March 1, 1965
Date of Final Inspection and Approval : October 8, 1965
Some delay of the project not chargeable to the contractor
was caused by delay of the Frisco Railroad in relocating
Western Union Telegraph and crossing signal installations
which blocked completion of the west paving lane in the
vicinity of Berry Street and Cleburne Road.
Working Time Bid: 90 Working Days
Working Time Used: 88 Working Days
Project Cost and Financing
Bid Price: $155,312.07
Final Contract Cost: $163,916.44
Partial Payments Previously Made: 6 Amount: $146,024.98
Final Payment Due: $ 17,891.46
Payment to be made from Project No. 094-23000-110, "Eighth Avenue Paving"
Deviation from Bid Price: $8,604.37 over-"run for the following reasons:
1) During removal of existing asphalt on various
side street intersections, it- was discovered
that some areas of the existing concrete base
had deteriorated and had excessive crowns,
which were repaired and/or replaced for crown
control to provide proper intersecting grades. + $4,397.60
2) In order to make the West Berry Street Inter-
section conform to new lines and grades on Old
Cleburne Road and to accelerate street and
gutter drainage at ends of project, more hot-
mix asphaltic concrete overlay was required
than originally anticipated. + 3,068.50
3) To properly maintain adequate drainage at out-
fall of 60-inch storm drain, bottom and side
slopes of ditch were rip-rapped with concrete. + 850.00

Compliance With Specifications
Attached is a tabulation of paving test cores on Eighth Avenue
of 4 inches cushion. and 7 inches of reinforced concrete surface
showing compliance with specifications within construction
tolerances. During...testing on this project, 56 corings were
made of the surface and the base with the following results:
Exceeds Even With Under Specs But Below-
Paving Specs Specs Within T.oleradce Tolerance

The average thickness of the surface is 7.55 inches as compared
to 7.0 inches specified. The average thickness of'the base is
4.2l .inches as compated-.to 4.0 inches specified.
Tests made during construction show that material used was in
compliance .with specifications.
Recommended Council Action .
It is recommended that the above project be accepted by adoption
of an ordinaiiceq and that final paysierit of $17,891.46 be author
ized to„J. L. Bertram Conatruction'and .Engineering, Inc.
