AN ORDINANCE AMENDING TOW-AWAY ZONES, WHEREIN ANY VEHICLE ILLEGALLY STOPPED, STANDING OR PARKED SHALL BE SUBJECT TO IMPOUNDMENT, BY AMENDING SECTION 26-122 OF FORT WORTH (1964) , AS AMENDED; PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS OF ORDIN- ANCES AND OF SUCH CODE AFFECTING MOTOR VEHICLES AND TRAFFIC, PROVIDING FOR REPEAL; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Subsection (b) of Section 26-122 of Chapter 26 of the Code of the City of Fort Worth (1964) , as amended, be, and the same is hereby amended and, after having been so amended, same shall be and read as follows: " (b) Each of the following is designated as a tow-away zone, effective when notice of said zone is given by an official traffic- control device, and any vehicle unlawfully stopped, standing or parked in any such tow-away zone shall be removed in the manner and to the place provided by this chapter: " (1) Seventh Street, from Lamar Street to Jones Street; " (2) Sixth Street, from Jones Street to Cherry Street; " (3) West Tenth Street, from Throckmorton Street to Monroe Street; " (4) Alice Street, west half, from West Dickson Street to West Pafford Street; " (5) May Street, from West Biddison Street to West Butler Street; " (6) West Ripy Street, from South Main Street to a point one hundred and fifty (150) feet west of May Street; " (7) Saint Louis Avenue, from West Biddison Street to West Butler Street. " SECTION 2, That this ordinance shall be cumulative of all pro- visions of ordinances and of the Code of the City of Fort Worth (1964) , as amended, affecting motor vehicles and traffic, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event such conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 26 of the Code of the City of Fort Worth (1964) , as amended, and of any other ordinance affecting motor vehicles and traffic which has accrued at the time of the effec- tive date of this ordiance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such chapter and/or other ordinances, same shall not be affected by this ordinance -2- but may be prosecuted until final disposition by the courts. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void. ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitu- tionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5, That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the provisions of this ordinance is committed. continued or permitted, and each violation shall be punishable by a fine not to exceed Two Hundred Dollars ($200.00) , SECTION 6. That this ordinance shall be in full force and effect from and after the date of its passage and publications as required by law, and it is so ordained. Following analysis of the surveys and discussions of the results with Police, Fire, Public Works and Park and Recreation Departments, proposed changes in parking around City Hall were developed which should help to improve the availability of short-term parking and reduce congestion on Tenth Street. The recommended changes are outlined as follows: 1. Tenth-Street from Jennings to Monroe (forth Side of Municipal Building) This block of Tenth Street should be reserved for marked Police vehicles only and a portion should be designated as a prisoner unloading area. In addition, both sides of this block of Tenth Street should be designated as a tow-away zone. 2. Monroe-Street from-Tenth-to Texas. (West Side of Municipal Building) Parking meters along the east side of Monroe should be removed and the parking spaces designated for Police vehicles. 3. Thirteenth-Street and Jennings Street Thirteenth Street should be changed from two-way to one-way operation westbound to allow parking on the south side and to eliminate the problem of the offset intersection at Thirteenth and Monroe. Additional parking meters will then be installed along the south side of Thirteenth Street between Jennings. and. Monroe and along the west side of Jennings from Thirteenth Street to Lancaster Avenue. 4. A sign should be installed on the Courtesy Parking Lot at Texas and Jennings to identify it as .only available to the public for City business. 5. Finally, in order to maintain a fair relationship with retail businesses in the areas adjacent to the City Hall complex, several parking meter areas should be made 'off limits" to regular City vehicles. This can be done by designating certain meters with a painted red ring around the meter post and notifying employees that they are not to park at those locations. Funds are available to accomplish these tasks in the Traffic Engineering Department operating budget. The authority to make these parking and traffic control changes rests with the City Manager and the Director of the Traffic Engineering Department, except for the amending of the tow- away zone ordinance. In order ,to accomplish the traffic and parking changes in the vicinity of the Municipal Office Building, as well as keeping .the tow-away zone ordinance up-to-date, the following changes to the tow-away zone ordinance are proposed: ADD: West Tenth Street from. Throckmorton. Street to Monroe Street. DELETE: Second Street from Houston Street to Taylor Street Taylor Street from Second Street to Belknap Street. Recommendation: It is recommended that the City Council adopt the proposed amended tow- away zone ordinance.
