AN ORDINANCE CREATING THE OFFICE OF ELECTRICAL INSPECTOR AND THE ELECTRICAL EXAMINING BOARD AND DEFINING THEIR RESPECTIVE DUTIES, REGULATING THE WAY AND MANNER IN WHICH ELECTRICAL WIRES AND APPARATUS SHALL BE INSTALLED IN THE CITY OF FORT WORTH, TEXAS, AND PROVIDING FOR THE GENERAL INSPECTION OF SUCH WORK; PROVIDING FOR THE ISSUANCE OF LICENSES AND PERkITS; PROVIDING FOR FEES TO BE CHARGED FOR DOING OF SUCH WORK; REPEALING ORDINANCE N0. 4O, ORDINANCE NO. 1227 AND PARTS OF ORDINANCE NO. 1596 AND ALL ORDYATANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVID- ING A PENALTY FOR VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT FORTH, TEXAS: SECTION I. DEFINITIONS Article 1: The term "electrical wiring" herein used is intended to mean the installation of electrical wires, fixtures, appliances, apparatus, or the addition to any wires, fixtures, apparatus or appliances used or to be used on or in any building, or in any premises for the purpose of transmitting electrical current for electric light, heat, power, house annunciator systems, electric bells, telephones, signal systems, private telephone or telegraph, radios, lighting fixtures or for any purpose, of any kinds nature or description. Article 2: "luster Electrician or Electrical Contractor" shall mean any person, firm, partnership or corporation engaged in the business of, or bolding themselves out to the 'public as being engaged in the business of installing or repairing, or cont.rketing to install or repair any electrical wiring, conduits, fixtures, devices, equipment or other electrical materials for conducting, using or consuming electrical energy for which a permit is herein required. Article j: "Journeyman Electrician" shall mean and include any person doing the work of installing, repairing or maintaining any electrical wiring, conduits, fixtures, or deviceg,or any other electrical materials or appliances for conducting, using or con- suming electrical energy, and who may engage in such work only under the supervision of, or in the direct employ of a Master Electrician, or Electrical Contractor. SECTION II. ELECTRICAL INSPECTORS .Article 1: That there is hereby created the office of Electrical Inspector of the City of Fort Forth, Texas, Chief and Assistant Inspectors, who shall have the following minimum quali- fications. A ri.2 Chief Electrical Inspector: (1) Seven years of successful experience as a Journeyman Electrician, at least three of which shall have been in a responsible supervisory capacity; or (2) Three years of practical experience as an Electrician, at least one of which shall have been in a responsible supervisory capacity, and graduation in Electrical Engineering from a recognized College or University; or (3) Any equivalent combination of experience and training sufficient to demonstrate competence in the work. A rz 3 Assistant Electrical Inspectors: (1) Five years of successful experience as a Journeyman Electrician, including some experience in a supervisory capacity, and completion of High School training; or (2) Two years of practical experience as an Electrician and graduation in Electrical Engineering from a recognized College or University; or (3) Any equivalent combination of experience and training sufficient to demonstrate competence in the work. A ri%q Upon the completion and request for final inspection of work upon which a permit has been issued, the Electrical Inspection Department shall make final inspection and if the work is found to comply with this Ordinance a certificate of inspection shall be issued stating that the work has been done according to the provisions of this Ordinance and the rules governing the respective ^lass to which it belongs. Ari.5 The Electrical Inspectors are herein given authority to reftYse to issue permit on an addition to old work where the old work is in an unsafe condition, until such is changed to come up to a satisfactory condition. All light, heat, and power companies shall be notified not to make service connections until they receive clearance or written permission from the Electrical Inspec- tion Department. A Y�.(p It shall be the duty of the Electrical Inspectors to inspeot all public and isolated light plants (excepting property of companies and corporations operating under a regular franchise) 2 now or hereafter in operation, at least once in each year, or more often if application is made by the owners thereof. They shall see that any dangerous or defective machinery, wires or apparatus are removed or repaired immediately at the expense of owner or agent of said property. Aryt, 7 It shall be the duty of the Electrical Inspectors to cause all dead wires, unused poles or electric apparatus on the outside of buildings or in streets or alleys to be removed at the expense of the owners thereof by giving the said owners written notice. AYA $ The City Electrical Inspectors may be called upon as many times as required to inspect new building in course of construc- tion in order not to delay construction, and must inspect such work within 48 hours from time notice is received, time to start from time stamped upon ticket by Permit Clerk, Sundays and Holi- days excepted. �lYj,'I The Electrical Inspectors shall have the authority to demand building contractors to open such work that in any manner conceals electrical wiring that has been closed without his knowledge or permission, and in no case shall inspectors issue clearance until he is satisfied that the work is in accordance with the provisions of this Ordinance. Inspectors shall also have the right to refuse to issue a clearance on any wiring that is concealed in such a manner that he cannot fully satisfy himself that it has been done in accordance with this Ordinance. Xy�. 10 The Electrical Inspector shall have the right at all reason- able hours to make a thorough re-inspection of the installation in or on buildings and/or premises of all electric wiring, electric devices and electric material now installed or that may hereafter be installed, within the City of Fort Worth. When the installation of any such wiring, devices and/or material is found to be in a dangerous or unsafe condition, the person, firm or corporation owning, using or operating the same, shall be notified in writing, and shall make the necessary repairs or changes required to place such wiring, devices and material in a safe condition and have such work completed within fifteen (15) days from date of said notice or other reasonable period specified by the Electrical Inspector in r said notice. Yj,(( The Electrical Inspector is hereby empowered to disconnect or order the public utility company serving electric energy to sever the electrical service to such Wiring, device and/or material so found to be defectively installed until the installa— tion of such Wiring, device and material has been made safe as directed by the Electrical Inspector. Any person, firm or corporation ordered to discontinue such electrical service shall do so within twenty—four (24) hours and shall not reconnect or allow it to be reconnected until notified to do so by the City Electrical Inspector. No person or persons shall hinder or prevent the City Electrical Inspector or his deputies from making any electrical inspection. A rf /Z Whenever service is discontinued to any building in Fire Zone I, or Fire Zone II, or any building used for commercial or mercantile purposes, theatres, gasoline stations, and garages in the corporate limits of the City of Fort Worth, Texas, clearance must be obtained from the Electrical Inspector before connecting to the electrical energy. No charge will be made for such inspections and inspections will be made on application of owner, or tennant. ,44 13 The City Electrical Inspector shall have the power to enter any building, structure, alley, lot, manhole or subway during reasonable hours and while in the actual performance of his regular duties he shall have power to arrest, or cause the arrest of any person or persons violating any of the provisions of this ordinance. SECTION III ELECTRICAL EXAMINING BOARD, APPOINTMENT AND DUTIES Article 4: That a Board of Electrical Examiners be and the same is hereby created for the City of Fort north, Texas, to be known as the Electrical Examining Board, the said Board shall consist of the City Electrical Inspector, one Master Electrician, one Journeyman Electrician, and the Supervisor of Public Utili- ties. The Master and Journeyman Electricians shall be appointed by the Mayor and shall serve during the pleasure of the Mayor and City Councilmen; they shall qualify by subscribing to the oath of office as required by the Charter of the City of Fort North. Article ;: Duties. It shall be the duty of the Electrical Examining Board to hold a meeting at least once during each month for the examination of applicants, to obtain a Master Electrician or Electrical Contractor's license, such examination shall be for the purpose of determining whether the applicant for license has a fair knowledge of the rules and regulations for the installation of electric wiring, devices and equipment as set forth in the ordinance of the City of Fort Worth, Texas, and in the National Electric Code, and shall determine the general qualifications and fitness of each applicant for execut- ing or performing the work covered by the license applied for. Article V Upon the approval of the applicant's examination by the Examining Board they shall issue a certificate of qualifica tion to said applicant, stating that the holder is qualified to sep /as �� receive a license to work as a Master Electrician, to conduct or carry on the business of electrical contracting, or employing electricians. Articld $:I The Electrical Examining Board shall have the power to make and promulgate its own rules governing its meetings and proceedings. SECTION IV. ELECTRICIAN'S LICENSE Article 4:I No person, firm, or corporation shall engage in the business of installing, altering or repairing, or work in the capacity of a Master Electrician for himself or any other person within the City of Fort Worth, Texas, on any electric wir- ing, devices or equipment for the installation, alteration, or repair, or the replacement and/or reconnection of starters, motors, generators, signs, or other fixed or stationary appliances, nor shall any person, firm, or corporation in any manner undertake to execute any such work unless such person, firm, or corporation is the holder of a Master Electrician's (or Electrical Con- tractor's) license. Article $:2 No permit for the installation or alteration of any electric wiring, devices, or equipment shall be issued to any person, firm, or corporation unless such person, firm, or corpora- tion is the holder of a license entitling said holder to procure permits for and to execute the class of work described in said permit. Article 4:3 Application for Master Electrician's license shall be made in writing, stating the name and place of business of the applicant, the firm, company, or corporation to be repre- sented by said applicant; attached to said application shall be W a certificate of qualification signed by not less than two members of the Electrical Examining Board. Article $►.'{Any person, firm, or corporation failing to renew their license within thirty (30) days after expiration of said license, shall be required to make a new application and pay a fee of $100.00 for renewal of said license. Article J:f All license shall be issued in the name of the person, as certified by the Electrical Examining Board. Article j:G The fee for Master Electrician License shall be one hundred dollars ($100.00) for the first year, payable in full in advance, said license shall be renewed at twenty-five ($25.00) per annum as the same expires, and may be revoked at any time by the order of the ]Mayor and City Council for violation of any of the provisions of this ordinance; and the offending person, or firm, or corporation shall be prohibited from engaging or con- ducting any such work, as called for in said license in the City of Fort north, Texas, for the period of one (1) year, at which time it may be renewed for twenty-five dollars ($25.00). Article 1:7 It shall be unlawful for any person holding license to transfer same or allow the use of samd directly, or indirectly, by any other person, firm, or corporation, for the purpose of obtaining a permit to do any electric work herein specified. Article $:S No minor, nor any person, or persons not of lawful age will be issued a Master Electrician's License. Article *.9 Approved Methods - No certificate of approval shall be issued unless the electric light, purer and heating installations are in strict conformity with the provisions of this ordinance and the statutes of the State of Texas, and unless the installation is made in compliance with approved methods of construction for safety to life and property. The regulations as laid down in the National Electric Code, as approved by the American Standards Association and in the National Electrical Safety Code, as approved by the American Standards Association, and other installation and safety regulations approved by the American Standards Association, shall be prima facie evidence that said installations are 14 confor ty of such approved methods. V4 SECTION V. ELECTRICAL PERMITS, HOW OBTAINED, FEES AND PAYMENT OF SAME Article J0 No wiring, devices or equipment for the trans— mission, distribution or utilization of electrical energy for light, power and/or heat, shall be installed within or on any building or structure, nor shall any alteration or addition be made to any such existing wiring, device, or equipment without first obtaining a permit therefor from the City Inspector, except as stated in the following paragraphs. Article B:Z No permit will be required for the replacement of lamps, or the connection of portable devices to suitable receptacles which have been permanently installed. Article 1:5 No permit will be required for the installation of wiring and equipment for the operation or transmission of intelligence where such wiring, devices, and equipment operate at a voltage not exceeding 25 volts between conductors. Article 0A Application for electrical permit shall describe the work to be done, and shall be made in writing to the City Inspector by the person, firm, or corporation installing the work and the permit when issued shall be to such applicant. Article *:S The City Inspector may require that applicant for permit furnish complete plans and specifications for the installation showing sizes of conductors and such other details as may be necessary to determine whether the installation as described will be in conformity with the requirements of this ordinance. Article r.6 The issuance of a permit shall not be taken as permission to violate any of the requirements of this ordinance. Article ;:7 Permit Inspection Fees:-- The fees to be charged for inspections of any electrical work in the corporate limits of the City of Fort Worth, Texas, shall be as follows, and shall be paid at the office of the Electrical Inspector before work is commenced. (a) For from one to ten outlets, new or old wiring, 41.00; for each additional outlet, $0.05; ftl!-ewi*et g except where not more than four (4) convenience receptical outlets, or Wall switches are added to existing .,firing; the fee for such addition shall be twenty-five (40.25) cents for each outlet. (b) For electric motors up to and including 3/4 H.P. , P.50 each. (c) For electric motors from 3/4 H.P. to and including 5 H.P., v1.00 each; for electric motors from 5 H.P. up to and including 15 H.P., $2.00 each; for all motors in excess of 15 H.P. , $3.00 each. (d) For electric generators including switchboards and exciters, not in excess of 10 K...., 0.00 each; for generators in excess of 10 K.41., P'5.00 each. (e) For electric sign circuits - $0.25 per circuit; for connec- tions of electric signs, $0.75 each. (f) For motion picture projection machines, $1.00 each; for arc lamps not a part of projection machines in projection booth, 30.35 each. (g) For temporary installations, holiday decorations, show window displays, wl.00 each inspection. (h) For inspection of electrical apparatus for which no fee is herein prescribed, or for re-inspection of wiring being rejected after second inspection, a fee of $1.00 will be charged; such fee must be paid before the person, firm, company or corpora- tion doing such work will be issued other permits. (1) For repairs where no additional outlets are added, or for new or extended service or meter relocation, a fee of $0.75 for each inspection. (j) Store buildings shall require a permit for each store where separate service is installed. (k) For electric fixtures, from one to ten, a fee of $1.00 will be charged; and $0.05 for each additional fixture; ceiling fans and drop cords will be classed as fixtures. -9.. SECTION VI. ELECTRICAL WIRING REQUIREMENTS. Article 1. Interior Conduits and Wiring. All un-grounded wires of a branch circuit must be protected by fuses or circuit breakers. The neutral conductor must be identified and properly connected to all branch circuits and be connected to the screw shell of all sockets and need not be fused. Avrt Z Wiring for light, heat or power in all buildings hereinr- after erected, and all wiring, alterations and additions to existing buildings in Zone I and Zone II of 'the fire limits of the City of Fort Worth, Texas, shall be installed in a rigid rocewaq iron conduit, or metal All buildings used or to be used for mercantile purposes, all churches, schools, roominghouses, garages for three or more cars, hotels, hospitals, factories, grain elevators, filling stations, refineries, apart- ment houses of more than two apartments, all basements, all build- ings (other than private residences) of two or more stories, and all buildings to be used for public entertainments within the city limits of the City of Fort Worth, Texas, shall have all wiring for lights, heat and power installed in a complete conduit or metal moulding system. All changes or additions to wiring used for light, heat and power in all buildings classified in this article shall be in conduit or metal m*v;jd4;u,&. roce Woc(. 3 All power wiring shall include all necessary wiring for electric motors, rectifiers, generators, electric heating and all electrical apparatus other than lighting and signalling equipment, and shall be in rigid iron conduit. All switches controlling motors or lights other than those mounted on switchboards shall be what is known as safety type externally operated, indicating the on or off position. All buildings known as private residences, all duplex apartments, and all out-buildings of residence occupancy hereinafter wired for lights, heat, or power, and all alterations, changes, or exten- sions to existing wiring shill be done in a metal conduit or armored cable system. i0 Metal moulding can only be used on exposed work. At-L l All current consuming openings installed on main ceiling of store buildings for general illumination shall be made of 300 watts capacity, and in no case shall more than four such openings be permitted on one circuit of No. 14 wire. For ceil- ing fan outlets four only will be permitted on one circuit of No. 14 wire, and circuits and outlets must be tagged so as to identify them. In all other installations except decorative outline and show window wiring, eight current consuming outlets with a maximum of 1320 watts connected load for circuits will be permitted. Art 5' All conduits must be secured to boxes, junction boxes or cabinets by.placing approved lock nuts on outside of box and bushings inside of box. The point of entrance of service wires shall in all cases be designated by the Power Company, unless proper lines carrying the proper current desired exist at a point easily accessible and at shortest distance for supply, necessitat- ing only one point of contact to customer's building. Aet b All installations of six circuits or more must have standard panel-boards enclosed in standard approved steel cabinets. ,Ayi 7 Exit lights shall be required in all apartments, and hotel buildings more than two stories high, and must be connected with only one set of fuses between main fuse and exit .circuit. All lights indicating fire escape exits shall be red lights with words "Exit" clearly lettered. Ayi fr All wires installed in underground work, ice boxes and VO ul4s refrigerating pl4wa2s must be in rigid galvanized iron pipe and lead covered. Art 9 All ceiling and bracket outlet boxes must be equipped with standard fixture studs. Fixture studs must also be securely fastened with stove bolts and not less than four bolts to the stud will be accepted, or an approved boltless stud. Art 14 Conduit must be installed as a complete system before wires are installed. Conduit must be equipped at every outlet with approved fittings or outlet box. In completed installations the box must be covered by an approved cover. 11 For concealed work in walls and ceilings composed of plaster on wooden joists or stud construction, outlet boxes and cutout cabinets must be installed so that the front edge will be even with finished surface. Armoured cable shall not be run over top of joists, holes must be bored so that in pulling in the cable no injury will be caused to the armour by sharp bends, strain, and the like. At all terminals cable must be fitted with an approved fiber bushing to protect the cable from sharp edges of the armour. Article 9 service Entrance Switches. The service entrance conduit must enter a main line safety switch or circuit breaker approved for the location and purpose of its use. In all single and multi-family dwellings not exceeding ieeitr apart- ments (where outdoor metering is used) the service switch must be of the service entrance type with fuses or circuit breakers for each of the ungrounded service conductors and a neutral strip or connecting bar for fastening the neutral conductor. rt 12 In commercial installations outside of Fire Zone No. 1 and network distribution zone service entrance switches or circuit breakers for single phase, two wire, and single phase, three wire, not exceeding sixty amperes, must be the service entrance type with fuses or circuit breakers for each of the ungrounded service entrance conductors and a neutral strip or connecting bar for fastening the neutral conductor. For multi-phase installations the service entrance switch when up to and including 100 amperes must be equipped with meter testing lugs and the switch must be the accessible fuse type safety meter service switch with fuses accessible only when switch is in open position. In multi-phase installations requiring service switches in excess of 100 amperes and requiring instrument transformers the switch must be of the service entrance safety type and the instrument transformers must be enclosed in an approved steel cabinet. y{ /:3 In commercial buildings in the network distribution zone all service entrance switches up to and including 100 amperes, single phase and multi-phase, must be the safety type meter service entrance switch with meter testing lugs in each of the ungrounded 12 conductors, and shall have the main line fuses accessible only when the switch is in open position. train line service entrance switches in excess of 100 amperes must be the safety type service entrance switch or circuit breaker, if instrument transformers are used; such transformers must be installed in approved steel cabinets. Af .&in entrance switches or circuit breakers in excess of 400 amperes may be mounted on approved switchboards, approved for the purpose and location. The service entrance equipment for a multi—family dwelling $/X of more than fete family apartments shall be wired so that the entire load shall be brought in through one main line service entrance switch; if separate metering is required for each apart— ment, all such apartments must be supplied through a safety type service entrance switch grouped with their respective meters at a readily accessible room or place. j4 Yi /y Service entrance switches, circuit breakers, or fuse cabinets installed on the outside of buildings or structures must be approved weatherproof switches. �1 /7 Arse-# Fuses, Circuit Breakers, and Current Limiting Devices. It shall be unlawful for any person, or persons, to replace any fuse or fuses, circuit breakers or current limiting devices, with a fuse, breaker, or device of greater current limiting capacity than that specified in the National Electric Code, or to replace any fuse, or current limiting device with any type of substitute other than that approved for the purpose and location. SECTION VII. PENALTY Any person, firm, or corporation violating,any of the pro— visions of this ordinance shall be deemed guilty of a misdemeanor and the person, firm, or corporation, or an employee, agent, manager, or officer thereof, who is guilty of violating any of the provisions, shall upon conviction thereof be fined in any amount not to exceed $200.00 for each offense, and every viola— tion of and each and every days failure or refusal to comply 13 With the said provision will constitute a separate offense and in case of willful or continued violations by any person, firm, or corporation as aforesaid or their agents, employees, servants, or officers, the City shall have power to revoke and repeal any license under which said person, firm, or corporation may be acting, and revoke all permits, privileges and franchises granted to said person, firm, or corporation aforesaid. SECTION VIII. LIABILITY FOR DAMAGE This ordinance shall not be construed to relieve from or lessen the responsibility of liability of any party owning, operat- ing, controlling or installing any electric wiring, electric devices, or electric equipment for damage to person or property caused by any defect therein, nor shall the City of Fort Worth be held as assuming any such liability by reason of the inspection authorized herein, or certificate of approval issued as herein provided. SECTION IX. VALIDITY OF ORDINANCE If any section, sub-section, sentence, clause, or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION X. REPEAL OF CONFLICTING ORDINANCE All ordinances or part of ordinances conflicting with the provisions herein contained, are hereby repealed. DATE TO TAKE EFFECT The fact that the present ordinances governing electric wiring installation and installation of electrical fixtures and appliances and apparatus are inadequate and there are conditions existing in said city endangering the life and safety of the public, M?6ates an emergency and an imperative and public necessity for the preservation of public health and safety, and,therefore, the Secretary-Treasurer shall promptly have this ordinance published in pamphlet form as provided in Section 12 hereof and it shall become a law and be in full force and affect from and after such publication. M SECTION XII. Examination of applicants shall be held once each month bet-ween the hours of 8:00 Al. and 5:00 PL. All persons desiring to be examined shall make application, in writing, to the Secretary of the Electrical Board ten (10) days before the date set forth herein. The Electrical Board shall furnish to the Supervisor of 1,unicipe.l F.esearch and Personnel of the City of Fort forth a set of questions and tests to be used in `ivin._, the examination reeuested. The Electrical Board may appoint one or more riiembers of the Board to be present during the examination. Applicants stall be under the supervision of the Supervisor of Idunicipal Research and Personnel and any member of the Electrical Board who may be ap_?ointed for the purpose during the entire course of said exeinination. At the completion of the examination all examination papers and answers to any tests given shall be turned over to the Electrical Board for grading. It will be the duty of the Electrical Board to determine the grade made by the applicant. The Electrical Board shE.11 notify any applicant as to his grade on said examination within five (5) days after examina- tion has been taken. A general average of 701' will be the minimum passing grade. Arf. 9 Should applicant fail, he may call for a re—examination at the next regular session of the Board. Should this examination be allowed, the Electrical Board shall so notify the Supervisor of Municipal P.esearch and Personnel„ who in turn will give a second examination using those questions and tests given to him by the Electrical Board. In the case of a second failure, applicant may make request to the City iana.ger of the City of Fort �+orth for re— examin�,A ion and should the City Tanager have reason to believe that the applicant should be permitted to have a, second re—examination, he shall so notify the Secretary of the Electrical Board who shall, as in the first and second examinations, rake necessary arrangements with the Supervisor of !Lunicius,l esearch and Personnel.
