ORDINANCE NO. 92 Y S AN ORDINANCE APPROVING THE REPORT OF THE PUBLIC WORKS DEPARTMENT: AWARDING THE CONTRACT FOR THE IMPROVEMENT OF PORTIONS OF SOUTH MAIN STREET, SAINT LOUIS AVENUE, EAST PAFFORD STREET, SOUTH JONES STREET, EAST CANTEY STREET, AND EAST LOWDEN STREET IN THE CITY OF FORT WORTH, TEXAS, AND AUTHORIZING ITS EXECUTION: MAKING APPROPRI- ATION FOR THE INDEBTEDNESS INCURRED THEREBY: AND DIREC- TING THE CITY ENGINEER TO PREPARE ESTIMATES. WHEREAIS, by Ordinances passed and approved by the City Council of the City of Fort Worth, being Ordinances Nos. 3861, 3860, 3706, 3863, 38629 3707, and 3864, the City determined the necessity for and ordered the improvement of portions of streets at seven (7) locations, to-wit: SOUTH MAIN STREET: from the northerly line of Berry St:beet to the southerly line of Bowie Street, known and designated as Unit No. 1. SOUTH MAIN STREET: from the southerly line of Butler Street to the northerly line of Dickson Street, known and designated as Unit No. 2. SAINT LOUIS AVENUE: from the southerly line of Ripy Street to the northerly line of Butler Street, known and designated as Unit No. 3. EAST PAFFORD STREET: from the easterly line of Bryan Street to the North to the westerly line of the North-South Freeway, known and designated as Unit No. 4. SOUTH JONES STREET: from the northerly line of East Berry Street to the southerly line of East Bowie Street, known and designated as Unit No. 5• EAST CANTEY STREET: from the easterly line of Evans Avenue to the westerly line of New York Avenue, known and designated as Unit No. 6. EAST LOWDEN STREET: from the westerly line of Evans Avenue to the- easterly line of North-South Freeway, known and designated as Unit No. 7. WHEREAS, subsequent to the passage and approval of said Ordinances, Plans and Specifications for said improvements were submitted by the Public Works Director and said Plans and Specifications were approved and adopted by the City Counci% and, WHEREAS, Notice to Bidders was given as required by the City Charter; and, WHEREAS, the bid of Texas Bitulithic Company was found to be the lowest and best bid for the making and construction of said improvement, to-wit: Excavation of present streets and placing I" crusher-run crushed limestone base with combined curb and gutter and necessary appurtenances, and placing 1j" Hot Mix Asphaltic Concrete Surface, all as provided by said plans and specifications; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1 � SECTION 1. That the work of making and constructing such improvements and contract therefor is hereby awarded to Texas Bitulithic Company, at and for the prices stated in the proposal of the said company and as reported and recommended by the Public Works Department. The Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said contract embracing therein, among other things, the prices for the work. SECTION 2. That to provide for the payment of the indebtedness incurred by the City of Fort Worth by said Contract, there is hereby appropriated out of available funds which have been set aside for said purpose, an amount sufficient to pay said indebtedness so incurred. SECTION 3. That the Public Works Director of the City of Fort Worth be and he is hereby ordered and directed to file with the City Council estimates of the cost of such improvements in accordance with the terms of the powers and provisions of Chapter 106 0£ the acts of the First called session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas, Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth.
