AN ORDINANCE FINDING AND DETERMINING THAT IN
THE MATTER OF THE IMPROVEMENT OF GAMBRELL STREET
FROM THE WEST LINE OF STANLEY AVENUE TO THE
WEST LINE OF HEMPHILL STREET IN THE CITY OF
FORT "NORTH, TEXAS, IT IS NOT PRACTICAL TO
PROCEED WITH THE IMPROVEMENT OF THAT PORTION
OF SAID GAMBRELL STREET FROM THE WEST LINE OF
STANLEY AVENUE TO THE EAST LINE OF JAMES STREET
DESIGNATED AS UNIT NO. 13 AND ORDERING THAT THE
IMPROVEMENT OF SAID PORTION OF GAMBRELL STREET
DESIGNATED AS UNIT NO. 1 BE ABANDONED; AND THAT
THE PLANS AND SPECIFICATIONS FOR SAID IMPROVEMENTS
BE AMENDED TO DELETE SAID PORTION OF GAMBRELL
STREET NOT TO BE IMPROVED; FINING AND DETERMIN-
ING THAT THE CONTRACTOR HAS CONSENTED TO SUCH
ABANDONMENT AND SUCH CHANGE IN THE PLANS AND
SPECIFICATIONS FOR SUCH WORK AND IMPROVEMENTS;
FIBUING AND DETERMINING TO PROCEED WITH THE
IMPROVEMENT OF THE REMAINING PORTION OF SAID
GAMBRELL STREET HERETOFORE ORDERED IMPROVED AND
DIRECTING THE DIRECTOR OF PUBLIC l'70RKS TO PRE-
PARE AND FILE ',TITH THE CITY COUNCIL A NEW ESTIMATE
OF THE COSTS OF SUCH IMPROVEMENTS AND FOR TIM
REMAINING PORTION OF SAID GAMBRELL STREET TO BE
SO IMPROVED; AND DIRECTING THAT THIS ORDINANCE
SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT 'NORTH, TEXAS:
SECTION 1.
The City Council of the City of Fort Worth, Texas
hereby finds and determines as follows, to-wit:
(a) That by ordinance duly enacted on July 10,
1948, being Ordinance No. 2328, the City Council
determined the necessity for, and ordered the
improvement of Gambrell Street from the west
line of Stanley Avenue to the West line of
Hemphill Street, and did by such ordinance direct
the City Engineer to prepare and file complete
plans and specifications for such improvements,
which plans and specifications were thereafter
duly prepared and filed by said City Engineer
and approved and adopted by the City Council for
use in the construction of said improvements; and
(b) That after advertising for bids for the con-
struction of said improvements ih the manner and
for the length of time as required by the law
and the Charter of said city, the lowest secured
bid of Brown & Root, Inc. was accepted and-contract
duly awarded to said Brown & Root, Inc. for the
construction of said improvements, which contract

is dated July 23, 1947, and approved and authorized
by ordinance No. 2441, duly enacted by the City
Council on August 6, 1947; and
(o) That in said plans, specifications and contract
that portion of Gambrell Street to be improved
thereunder within the limits hereinabuve defined,
was divided into three separate Sections and desig-
nated as Units Nos. 1, 2 and 3, as follows, to-wit:
GAMBRELL STREET, from the west line of Stanley Avenue
to the east line of James Street, known and desig-
nated as Unit No. 1:
GAMBRELL STREET, from the east line of James Street
to the west line of Heath Adams Street, known and
designated as Unit No. 2: and
GAMBRELL STREET, from the west line of South Adams
Street to the west line of Hemphill Street, known
and designated as Unit No. 3.
SECTION 2.
That said City Council does hereby find and determine
that it is not praotical and to the best public interest to pro-
ceed with the improvement of that portion of said Gambrell Street
lying between the west line of Stanley Avenue and the east line
of James Street designated as Unit No. 1, and hereby orders and
directs that the improvement of said Gambrell Street within the
limits designated as Unit No. 1 be, and the same is hereby
abandoned and ordered not improved under said contract and the
proceedings heretofore had In reference thereto.
SECTION 3.
That the plans and specifications for the improvement of
Gambrell Street within the above described limits originally
ordered improved, heretofore approved and adopted by the City
Council and forming a part of the above described contract, be,
and the same are hereby amended and changed by deletiXE such
parts of said plans and specifications as provide for the improve-
ment of said portion of Gambrell Street designated as Unit No. 1
herein ordered abandoned, so that hereafter said plans and speci-
fications dhall include and provide only for the improvement of
the remaining portions of said Gambrell Street designated as

Units Nos. 2 and 3, the improvements of which shall proceed
and be made under the terms and provisions of said contract and
plans and specifications as herein amended.
SECTION 4.
That the City Council hereby finds and determines that
Brown & Root, Inc. , the Contractor for the construction of said
improvements under the above described contract, has in writing
consented and agreed to the abandonment of said portion of
Gambrell Street designated as Unit No. 1, and to the amendment
of said plans and specifications as hereinabove ordered and that
said Contractor will proceed with the improvement of the remain-
ing portions of said Gambrell Street under the terms and protd-
sions of said contract and plans and specifications as herein
amended.
SECTION 5.
That the Director of Public Works is hereby directed to
prepare and file with the City Council a new estimate of the
costs of such improvements for the portion of said Gambrell Street
to be improved, designated as Units Nos. 2 and 3, together with
the estimates of the amounts proposed to be assessed, and the
per-front-foot rates thereof, against the abutting property and
the real and true owners thereof, and other pertinent information,
all as required under Article 1105 b, of the Revised Civil
Statutes of Texas as adopted by Section 17 of Article XXIII of
the Charter of the City of Fort Worth, Texas.
SECTION 6.
That this ordinance shall take effect and be in full force
from and after its passage.
