O S AN ORDINANCE PROVIDING THAT THE UNNAMED STREET LO- CATED BETWEEN BLOCKS 21 AND 22 OF EDWARDS HEIRS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDED IN VOL. 63, PAGE 2, OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, BE VACATED, ABANDONED AND CLOSED` PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LANDf REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the unnamed street located between Blocks 21 and 22 of Edwards Heirs Addition to the City of Fort Worth, Tarrant County, Texas, according to the plat recorded in Vol. 63, page 2, of the Plat Records of Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said unnamed street is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict h6rewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. BUCK 1 GRAHAM OWEN Thomas Tomlinson and Paul Cretien, with consent of all adjoining property owners, REED HIGHTOW R have requested that the City vacate the unnamed street located between Blocks 21 and 22 of the Edwards Heirs Addition in the City of Fort Worth, according to the plat recorded in Volume 63, Page 2 of the Deed Records of Tarrant County, Texas and as shown on the attached map that is marked for identification purposes as "Exhibit I. Subject right-of-way, acquired by dedication, is not open on the ground. If the request is granted, the applicants intend to expand the building area of their adjoining property. Subject right-of-way has been encroached upon by a frame residential structure and a sheet metal building as shown on the attached map, that is marked for identification purposes as "Exhibit II." Mr. Harry Miller who is-opposed to the vacation request lives in the house and operates an asphalt contracting busi- ness from this location. According to Mr. George Thompson, Jr. , attorney representing Mr. Harry Millero this house has been on the subject right-of-way approximately forty (40) years and his client bought this house by quit claim deed for $1,365.00. Also attached for the information of the City Council is a copy of the decision rendered on Cause No. 54780-C, Tom Tomlinson and Paul Cretien vs. Joe Bilardi, Executive Secretary, City Planning Commission, City of Fort Worth, Texas. (Exhibit III). City Departments and private utility companies have reviewed this request and have voiced no objection to this vacation, provided the applicants plat this vacated right-of-way with their adjoining property. The City Attorney has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested. The City Plan Commission has reviewed this request and on a motion by Mr. Howard, seconded by Mr. Adams, unanimously voted to refer to the City Council without recommendation for determination of the equities involved, the request of Tom Tomlinson and Paul Cretien for vacating the right-of-way of the dedicated, unopened street from the 2100 block West Vickery toward the southeast.
