Ordinance No. 23792-08-2019 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FISCAL YEAR 2019-2020 FORT WORTH PUBLIC IMPROVEMENT DISTRICT 20— EAST LANCASTER AVENUE FUND IN THE AMOUNT OF $245,727.00, FROM AVAILABLE FUNDS, CONTINGENT UPON THE ADOPTION OF THE ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE 2019 TAX YEAR, FOR THE PURPOSE OF PROVIDING IMPROVEMENTS AND SERVICES FOR PUBLIC IMPROVEMENT DISTRICT 20—EAST LANCASTER AVENUE DURING FISCAL YEAR 2019-2020; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2019-2020 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Fiscal Year 2019-2020 Fort Worth Public Improvement District 20— East Lancaster Avenue Fund ("Fund") in the amount of$245,727.00, from available funds, contingent upon the adoption of the ordinance levying special assessments for the 2019 Tax Year, for the purpose of providing improvements and services for Public Improvement District 20—East Lancaster Avenue during Fiscal Year 2019-2020. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2019, and ending September 30, 2020, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: On February 12,2019,the City Council adopted Resolution No.5052-02-2019,establishing Fort Worth Public Improvement District 20-East Lancaster Avenue("East Lancaster Avenue PID"). The purpose of this benefit hearing is to receive comments from the public regarding the 2019-2020 Fiscal Year Budget and Five-Year Service Plan for the East Lancaster Avenue PID and the proposed assessments to be levied on each property in the East Lancaster Avenue PID for the 2019 tax year.Following the public hearing, it is recommended that the City Council take the following actions:(a)approve the attached Budget and Five-Year Service Plan; (b)approve the 2019 Assessment Roll;and(c)adopt the attached ordinances levying the proposed assessments and appropriating funds. On August 20,2019,the City Council conducted a public hearing to receive comments on the proposed 2019-2020 Fiscal Year Budget, Five-Year Service Plan,and 2019 Assessments for the East Lancaster Avenue PID (M&C BH). Notice of the August 20,2019,benefit hearing and this hearing were published in the Fort Worth Star-Telegram on August 8,2019 and mailed to all record owners of property in the East Lancaster Avenue PID on August 7,2019, in accordance with state law. The East Lancaster Avenue PID is located in COUNCIL DISTRICTS 5 and 8. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and the adoption of the Fiscal Year 2019-2020 Budget by the City Council,funds will be available in the Fiscal Year 2020 operating budget,as appropriated,of the Fort Worth Public Improvement District 20- East Lancaster Avenue Fund.
