HomeMy WebLinkAboutOrdinance 7985 ORDINANCE NO. 7985 AN ORDINANCE ORDERING A SPECIAL HOME-RULE ELECTION IN THE CITY OF FORT WORTH, TEXAS, TO BE HELD ON TUESDAY, THE SIXTH DAY OF NOVEMBER, 1979, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY, FOR ADOPTION OR REJECTION, PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF FORT WORTH; AUTHORIZING THE CITY COUNCIL TO DESIG- NATE THE PLACES AT WHICH SAID ELECTION IS TO BE HELD; PRESCRIBING PRESIDING OFFICERS THEREOF; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort :°7orth, in the exercise of its obligation imposed on it by the Constitution and laws of this State, and more particularly Articles 1165 through 1174, inclusive, Texas Revised Civil Statutes, relating to the amendment of city charters by cities having more than five thousand inhabitants; and WHEREAS, a petition containing the signatures of the requisite number of qualified voters in the City of Fort Worth has been presented to the City Council, said petition requesting an election to be held on an amendment to the City Charter of the City of Fort Worth which would limit revenues which could be raised by the City of Fort Worth from ad valorem taxation; and WHEREAS, the requisite number of signatures on said petition have been certified to the City Council by the City Secretary, specifically 9,157 have been identified by the said City Secretary as being signatures from among the 180,786 registered voters of the City of Fort Worth; and WHEREAS, the City Council recognizes the right of the elec- torate to vote on said amendment; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a special election be held in the City of Fort Worth, (Revised 9/24/79) Texas,on Tuesday, the 6th day of November, 1979, for the pur- pose of submitting to the qualified voters of said City, for adoption or rejection, the following proposed amendment to the existing Charter of the City of Fort Worth: PROPOSED AMENDMENT Shall the Charter of the City of Fort Worth be amended to include a new section of Chapter XXV, said section to be desig- nated as Section 37 of said chapter, the said new section to read as follows: "Section 37. The ad valorem tax rate of the City of Fort Worth shall be divided into two separate and distinct tax rates; those being described and named Bond Rate and General Fund Rate. Further, that the Bond Rate shall be set for the fiscal year 1979-1980 at that rate which shall provide for the retirement of legal bond payments as prescribed for that fiscal year, and no more, and that subsequent year's rates be set accordingly. Further, that the General Fund shall be set for the fiscal year 1979-1980 at that rate which shall produce $26 Million Dollars revenue, with no provision for delin- quency or uncollectables, and that in subsequent years, shall be set at that rate which will produce a growth rate in Ad Valorem taxes not to exceed 5% of the previous year's revenue from Ad Valorem taxes." -2- (Revised 9/24/79) SECTION 2. That said election shall be held and conducted in the manner and within the hours prescribed for general elections by the laws of the State of Texas insofar as they may be applicable, and all persons qualified to vote in said City under the laws of this State regulating general elections shall be allowed to vote. SECTION 4, That the proposed charter amendment shall be clear and distinct so that each voter may vote "For" or "Against" on the amendment. That absentee voting shall be on paper ballots, and such ballots shall conform to the requirements of Article 6,05 of the Election Code of the State of Texas, as amended, which pro- vides that a square shall be placed beside the proposed amendment, in which the voter is requested to place an "X" or other clear mark to indicate the way he wishes to vote, but which also provides that failure of a voter to mark his ballot in strict conformity with the instructions on the ballot shall not invali- date the ballot, and the ballot shall be counted if the intention of the voter is clearly ascertainable, except where the law ex- pressly prohibits the counting of the ballot. It is specifically provided that the election officers shall not refuse to count a ballot because of a voter having marked his ballot by scratching out the amendment for which he does not wish to vote. That ballot shall include substantially the following: -4- OFFICIAL BALLOT (Place an "X" in the square inside the statement indicating the way you wish to vote) . For Shall the Charter of the City of Fort Worth be amended to add a new Section 37 to Chapter XXV, the said new section to read: "Section 37. The ad valorem tax rate of the City of Fort Worth shall be divided into two separate and distinct tax rates; those being El Against described and named Bond Rate and General Fund Rate. Further, that the Bond Rate shall be set for the fiscal year 1979-1980 at that rate which shall provide for the retirement of legal bond payments as prescribed for that fiscal year, and no more, and that subsequent year's rates be set accordingly. Further, that the General Fund shall be set for the fiscal year 1979-1980 at that rate which shall produce $26 Million Dollars revenue, with no provision for delin- quency or uncollectables, and that in subsequent years, shall be set at that rate which will produce a growth rate in Ad Valorem taxes not to exceed 50 of the previous year's revenue from Ad Valorem taxes."? SECTION 5. That the voting machines approved by the Commissioners' Court of Tarrant County, Texas, if available, may be used at the charter amendment election on the 6th day of November, A.D. 1979, in strict compliance with the applicable provisions of Article 7.14 of the Election Code of the State of Texas, as amended, and all other appli- cable provisions of such Election Code. SECTION 6. That the official ballots to be used shall be in compliance with the applicable provisions of Article 6.05 of the Election Code of the State of Texas, as amended, and shall have written or printed thereon the following: -5- (Revised 9/24/79) CHARTER AMENDMENT (place an "X" in the square beside the statement Indicating the way you wish to vote) . SECTION 7. That the City Secretary is hereby ordered and directed to prepare and issue ballots for absentee voting and for the special election and to stamp same "Official Ballot," on which ballots shall be printed the proposed charter amendment hereinabove set forth. SECTION 8. That the City Secretary shall furnish election officials said ballots, together with any other forms, blanks or instructions in accordance with the Charter of the City of Fort Worth, Texas, and the laws of the State of Texas insofar as same are applicable, and the provisions of this ordinance unless a court of competent jurisdiction orders otherwise. -6- (Revised 9/24/79) SECTION 9. That this ordinance shall constitute the election order for such special election, a substantial copy of which shall serve as the notice of election under Article 1170 of the Revised Civil Statutes of the State of Texas. SECTION 10. That the City Secretary is hereby authorized and directed to cause notice of said election to be given by posting a sub- stantial copy of this election order in each of the election precincts of said City and also at the City Hall; and that this notice of said election shall also be published on the same day in each of two (2) successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for said election, and the City Secretary shall see that proper publication is made and proper notice of this election is given, in full conformity with the applicable statutes of the State of Texas. SECTION 11. That the proposed amendment as hereinabove set forth, if approved by a majority of the qualified voters voting upon said amendment, shall become a part of the Charter of the City of Fort Worth as soon as an official order has been entered on the Council Minutes of said City by the City Council thereof, declaring the same adopted. SECTION 12. That the way and manner of holding this election, the notice to be given therefor, the polling places, the personnel and the officers who are to hold same, and all details connected with the holding of the election shall be provided for and arranged by the City Secretary; that the proper notice and publication of this notice, proclamation and ordinance shall only be cumulative of and in addition to the statutory notice -7- of said election as herein provided; and that any omission or irregularity in the publication of this notice, proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate such election. SECTION 13. That this ordinance, election order and notice shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained.
