AN ORDINANCE FINDING AND DECLARING UNSUITABLE
AND INADEQUATE FOR USE AS PUBLIC PARKS THE
PROPERTIES SITUATED IN THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, IDENTIFIED AS: (A) A
PARCEL OF SOME 1.11 ACRES, MORE OR LESS, OUT
OF THE TRACT OF LAND KNOWN AS GLENWOOD PARK
THE SAME BEING EAST OF AND SEPARATED FROM THE
MAIN PORTION OF GLENWOOD PARK BY SOUTH RIVERSIDE
DRIVE; (B) A TRACT KNOWN AS LOTS 1, 2, 6-8 AND
THE WEST 18 FEET OF LOT 3, LAND 700 ADDITION,
WITH IMPROVEMENTS SITUATED THEREON COMMONLY
KNOWN AS THE SOUTH SIDE RECREATION BUILDING
LOCATED AT THE SOUTHEAST CORNER OF THE INTER-
SECTION OF WEST VICKERY AND GALVESTON STREETS;
(C) A PARCEL OF SOME 4.567 ACRES, MORE OR LESS,
OF LAND OUT OF BLOCKS 34 AND 35, EDWARDS HEIRS
ADDITION AND BEING A PORTION OF TRINITY PARK
LYING EAST OF THE CLEAR FORK OF THE TRINITY
RIVER; AND (D) LOTS 12 THROUGH 19, BLOCK 17,
FRISCO RAILROAD ADDITION, AND BEING A PORTION
OF FOREST PARK LOCATED AT THE NORTHEAST CORNER
OF THE INTERSECTION OF MCCART AND MCPHERSON
STREETS; AND PROVIDING FOR THE SUBMISSION OF
PROPOSITIONS CONCERNING THE SALE OF SAID FOUR
(4) TRACTS OR PARCELS OF LAND TO THE QUALIFIED
VOTERS OF THE CITY OF FORT WORTH, TEXAS, AT
THE ELECTION HERETOFORE CALLED ON SATURDAY THE
7TH DAY OF APRIL, A. D. 1979.
WHEREAS, the City of Fort Worth heretofore acquired the
following tracts of land situated within the City of Fort Worth,
Tarrant County, Texas, for public use:
(A) A parcel of some 1.11 acres, more or less,
out of the L. Moore Survey, Tarrant County,
Texas, and being a portion of the tract of
land known as Glenwood Park, the same being
east of and separated from the main portion
of said Glenwood Park by South Riverside
Drive;
(B) A tract known as Lots 1, 2, 6-8, and the
west 18 feet of Lot 3, Land 700 Addition,
together with the improvements situated
thereon commonly known as the South Side
Recreation Building located at the
Southeast corner of the inter-section of
West Vickery and Galveston Streets in the
City of Fart Worth;
(C) A parcel of some 4.567 acres, more or
less, out of Blocks 34 and 35, Edwards
Heirs Addition, and being the unencumbered
portion of Trinity Park lying east of the
Clear Fork of the Trinity River, north of
the East-West Freeway (I-20) and south of
Parkview Drive in the City of Fort Worth;
and
(D) A tract known as Lots 12 through 19, Block
17, Frisco Railroad Addition, and being
a portion of Forest Park (400 feet by
125 feet) located at the northeast corner
of the intersection of McCart and McPherson
Streets in the City of Fort Worth; and
WHEREAS, The above described property has heretofore
been used for park purposes but has become unsuitable and inadequate
for further use as a part of the public parks of the City of Fort
Worth; and
WHEREAS, the City of Fort Worth has no present nor fore-
seeable public use for the above described property and deems it to
be in the public interest to abandon any public use thereof and,
subject to the concurrence of the electorate, dispose of the
same through public sale, all in accordance with the laws and
ordinances of this City and State; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That the following described tracts and parcels of
public property heretofore devoted to park purposes are found and
declared unsuitable and inadequate for use as public parks:
(A) A parcel of some 1.11 acres, more or less,
out of the L. Moore Survey, Tarrant County,
Texas, and being a portion of the tract of
land known as Glenwood Park, the same being
east of and separated from the main portion
of said Glenwood Park by South Riverside
Drive;
(B) A tract known as Lots 1, 2, 6-8, and the
west 18 feet of Lot 3, Land 700 Addition,
together with the improvements situated
thereon commonly known as the South Side

SECTION 2.
That in compliance with the laws and constitution
of the State of Texas, the following propositions shall be
submitted to the qualified voters in the City of Fort Worth,
Texas, at the election heretofore on this date called on
Saturday the 7th day of April, A.D. 1979:
PROPOSITION 1
Shall the City of Fort Worth through its
City Council be authorized to sell approxi-
mately 1.11 acres of land out of Glenwood
Park, City of Fort Worth, Tarrant County,
Texas?
PROPOSITION 2
Shall the City of Fort Worth through its
City Council be authorized to sell Lots 1,
2, 6-8 and the west 18 feet of Lot 3,
Land 700 Addition, City of Fort Worth,
Tarrant County, Texas?
PROPOSITION 3
Shall the City of Fort Worth through its
City Council be authorized to sell approxi-
mately 4.567 acres of land out of Blocks 34
and 35, Edwards Heirs Addition, City of Fort
Worth, Tarrant County, Texas?
PROPOSITION 4
Shall the City of Fort Worth through its
City Council be authorized to sell Lots
12-19, Block 17, Frisco Railroad Addition,
City of Fort Worth, Tarrant County, Texas?
SECTION 3.
That the City Secretary of said City shall prepare
ballots to be used in voting machines in said election, on which
ballots shall be printed the propositions hereinabove set forth.
SECTION 4.
That all voters who favor one or more of the propositions
to sell the properties hereinabove described shall vote
"FOR the sale"
with respect to the proposition(s) they favor and those voters
opposed to one or more of the propositions to sell the properties
hereinabove described shall vote
"AGAINST the sale"
with respect to the proposition(s) they oppose.

SECTION 5.
That absentee voting shall be conducted by two
methods;
(1) Voting by personal appearance at the
Fort Worth City Hall, 1000 Throckmorton
Street, Fort Worth,Texas, 76102, and
(2) Voting by mail
Absentee voting shall be on paper ballots and each absentee
voter shall indicate his vote "FOR the Sale" or "AGAINST
the Sale" with respect to each proposition to sell the
properties hereinabove described, by placing an "X" in the
square beside the alternative for which he wishes to vote
with respect to each proposition; provided, however, that
if the voter places a plus sign (+) or a check mark (%+� , or
any other mark which clearly shows his intention in such
place, it shall be counted "FOR" or "AGAINST" the sale, as
indicated. That the failure of a voter to mark his ballot
in strict conformity with the directions or failure to vote
on all propositions shall not invalidate the ballot, and the
ballot shall be counted on all propositions wherein the
intention of the voter is clearly ascertainable, except
where the law expressly prohibits the counting of the ballot.
That it is specifically provided that the election officers shall
not refuse to count any Absentee ballot because of the voter's
having marked his ballot by scratching out the alternative with
respect to each proposition for which he does not wish to vote;
and that in this connection the attention of the Absentee

Ballot Canvassing Board is directed to the provisions of
Article 6.06 of the Election Code of the State of Texas.
SECTION 6.
That voting machines approved by the Commiss-
ioners' Court of Tarrant County, Texas, shall be used at
the election on April 7, 1979, in strict compliance with
the applicable provisions of Article 7.14 of the Election
Code of the State of Texas, as amended, and other applicable
provisions of such Election Code.
SECTION 7.
That the polls shall be kept open from seven
o'clock A.M. until seven o'clock P.M. on April 7, 1979, and
that due returns shall be made to the City Council showing
the number of votes cast for and the number of votes cast
against each proposition, respectively.
SECTION 8.
That the polling places for this election, the
personnel or the officers who are to hold the same and
the Absentee Ballot Canvassing Board, except insofar as
they may be changed by the City Council of said City, shall
be as follows:

SECTION 9.
That the City Secretary is hereby ordered and directed to
prepare and issue ballots for absentee voting and for voting
machines and to stamp same "Official Ballot."
SECTION 10.
That the City Secretary of the City of Fort Worth shall
furnish election officials said ballots and voting machines
together with any other forms, blanks or instructions in
accordance with the Charter of the City of Fort Worth and the
laws of the State of Texas, insofar as same are applicable.
SECTION 11.
That this ordinance shall constitute the proclamation,
call, notice and ordinance calling and ordering said election;
that same shall be published in a newspaper of general circula-
tion in The City of Fort Worth once a week for four (4) weeks
prior thereto; and that the City Secretary is hereby directed to
post or cause to be posted said proclamation, call, notice and
ordinance in each voting precinct, or at the polling place of
combined voting precincts, at least twenty days before said
election.

SECTION 12.
That the way and manner of holding this election, the notice
to be given therefor, the polling places, the personnel and the
officers who are to hold same, and all details connected with
the holding of the election shall be provided for and arranged
by the City Secretary; that the proper notice and publication of
this notice,proclamation and ordinance shall only be cumulative
of and in addition to the statutory notice of said election as
herein provided; and that any omission or irregularity in the
publication of this notice, proclamation and ordinance, or in
the signing of same, shall not in any way affect or invalidate
such election.
SECTION 13.
That this ordinance, election order, proclamation and notice
shall take effect and be in full force and effect from and after
the date of its passage, and it is so ordained.

Background
The Park and Recreation Department has identified four parcels of property
which no longer function as useful recreation or public open space. It is
believed that the communities' recreation needs could be better served by
selling these surplus lands and using the proceeds to improve adjoining
parks or constructing replacement facilities. Secondary benefits include
getting unneeded public lands back to private use and eliminating the City's
maintenance responsibility.
State law provides that the sale of surplus park land requires voter approval
in a general election.
The Four Park Parcels Proposed for Sale
The four parcels proposed for sale are as follows:
1. A 1.11 acre parcel east of Riverside Drive across from Glenwood
Park: This parcel of land was cut off from Glenwood Park with
the construction of Riverside Drive. Proceeds from the sale of
this property will be used to improve Glenwood Park
2. A 1.15 acre parcel of property east of McCart Street across from
Forest Park: This parcel was cut off from Forest Park with the
construction and expansion of McCart Street. Proceeds from the
sale of this tract will be used to improve Forest Park.
3. A 5 f acre tract of land south of the Trinity River across the
river from Trinity Park. This parcel was cut off from Trinity
Park with the channelization of the Trinity River. The property
presently is used as a park maintenance compound. Proceeds from
sale of this parcel will be used to construct an improved and
better located maintenance facility, with any remaining funds to
be used for contingency funding for the Park and Recreation Capital
Improvement Program.
4. A .65 acre parcel located at 215 W. Vickery, This site contains
the old Southside Athletic Center Building. The 1978-82 CIP
provided that proceeds from the sale of this facility would be
used to supplement the $720,000 approved to build a new athletic
facility to be located in the central portion of the City.

If approved by the City Council and voters, the surplus lands listed above
will be sold using competitive bidding under standard City policy and
Charter provisions.
Recommendation
It is recommended that the City Council adopt an ordinance calling an
election for April 7, 1979, for the sale of the surplus park lands listed
above.
