AN ORDINANCE VACATING, ABANDONING AND CLOSING
THAT PORTION OF ASHVILLE AVENUE IN THE 7100
BLOCK A WIDTH OF 60' AND A LENGTH OF APPROX-
IMATELY 145' FROM THE Z. BOAZ GOLF COURSE WEST
TO THE EAST BOUNDARY OF THE T & P RAILROAD
RIGHT-OF-WAY; THAT PORTION OF IRENE DRIVE IN
THE 2800 BLOCK A WIDTH OF 60' AND A LENGTH OF
APPROXIMATELY 390' FROM CALMONT AVENUE SOUTH TO
ASHVILLE AVENUE; AND VACATING AN 8' UTILITY EASE-
MENT WITH ITS CENTERLINE THE COMMON REAR LOT
LINES OF LOTS 5, 6, 11 AND 12, BLOCK 5, ALTA
MERE ADDITION, A LENGTH OF APPROXIMATELY 85'
FROM THE WEST RIGHT-OF-WAY OF IRENE DRIVE TO
THE EAST RIGHT-OF-WAY OF THE T & P RAILROAD;
PROVIDING FOR THE REVERSION OF THE FEE IN SAID
LAND; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL
BECOME EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the portion of Ashville Avenue in the 7100 Block a
width of 60' and a length of approximately 145' from the Z.
Boaz Golf Course west to the east boundary of the T & P
Railroad right-of-way and that portion of Irene Drive in the
2800 Block a width of 60' and a length of approximately 390'
from Calmont Avenue south to Ashville Avenue be and the same
are hereby closed, abandoned and permanently vacated as a
street or public thoroughfare of any kind or character what-
ever.
SECTION 2.
That the 8' utility easement with its centerline the
common rear lot lines of Lots 5, 6, 11 & 12, Block 5, Alta
Mere Addition, a length of approximately 85' from the west
right-of-way of Irene Drive to the east right-of-way of the
T & P Railroad be and the same is hereby closed, abandoned
and permanently vacated as a utility easement.
SECTION 3.
That the fee to the land in the above described portion
of Ashville Avenue, Irene Drive and in the utility easement
hereinabove described is hereby released and will revert to
the adjacent owners as provided by law, SAVE AND EXCEPT that
easements are reserved for any and all existing utilities.
SECTION 4.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

T. A. Leasing, owner of abutting property, being Lots 5, 6, 11 & 12, Block 5,
Alta Mere Addition, with the consent of the Fort Worth Park and Recreation Depart-
ment, owner of all other abutting property, has requested that the City vacate
two streets and a general purpose easement. The subject streets are Ashville
Avenue in the 7100 block a width of 60 feet and a length*of approximately 145
feet from the Z. Boaz Golf Course west to the east boundary of the T & P Rail-
road right-of-way and Irene Drive in the 2800 block a width of 60 feet and a
length of approximately 390 feet from Calmont Avenue south to Ashland Avenue.
The subject easement has a width of 8 feet with its centerline the common rear
lot lines of Lots 51.6,11 ,& 12, Block 5, Alta Mere Addition, a length of approxi-
mately 85 feet from the west right-of--way of Irene Drive to the east right-of-way
of the T & P Railroad.
The subject right-of-way and easement, acquired by dedication, are neither paved
nor open and contain no public facilities. Reviewing City departments and pri-
vate utility companies have no objection to this request subject to a satisfac-
tory replat showing necessary easements including a public access easement for
the use of the Park Department (shown on the attached plat) , physical closure of
Irene Drive when Calmont is improved, approval of necessary zoning changes, and
acceptable arrangements for buffering adjacent to the Z. Boaz Golf Course.
The City Plan Commission has review this request and recommends approval subject
to the above conditions. A satisfactory replat has been submitted to the City
Staff and other conditions have been complied with as required.
At a special called meeting on June 30, 1976, the Park and Recreation Advisory
Board considered the subject right-of-way vacations and a then proposed zoning
change to "E" Commercial for abutting property. The Board endorsed the project
concept for the purposed restaurant subject to access, drainage improvements,
and landscaping requirements, all of which have now been complied,
Right of legal title to vacated street right-of-way is normally divided among
owners of abutting property, in this case being T.A. Leasing and the Fort Worth
Park and Recreation Department. If T.A. Leasing is to replat all vacated rights-
of-way with their property as proposed, plat attached, the City must relinquish
its right of legal title to one-half the subject right-of-way once the vacation
is approve¢. A quit claim deed, satisfactory to the Park and Recreation Depart-
ment, has been prepared for this purpose .and is submitted herein for Council
approval.
Recommendation
It is recommended that the City Council adopt an ordinance vacating the subject
street right-of-way,and easement as requested. It is also recommended that the
Council ratify a quit claim deed relinquishing the City's right of legal title to
the subject right-of-way once vacated.
