HomeMy WebLinkAboutOrdinance 7385 ORDINANCE NO. f J g 5 AN ORDINANCE AMENDING SECTION 28-11, SECTION 28-12 AND SECTION 28-14 OF THE FORT WORTH CITY CODE (1964) , AS AMENDED, BY INCREASING THE NUMBER OF MEMBERS FROM FIVE (5) TO SEVEN (7) ; PROVIDING FOR EXPIRATION OF TERMS; AND PROVIDING FOR MEETINGS AND QUORUM; MAKING THE ORDINANCE CUMULATIVE OF ALL ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Sections 28-11, 28-12 and 28-14 of the Fort Worth City Code (1964) , as amended, be and the same are hereby amended, and, after being so amended, shall hereafter read and be as follows: Sec. 28-11. Creation and appointment. There is hereby created a city plan commission, to be composed of seven (7) qualified electors of the city. It is the declared policy that the city council shall consider for appointment to the commission only those persons who have demonstrated their civic in- terest, general knowledge of the community, indepen- dent judgment, understanding of zoning and planning and availability to prepare for and attend meetings, and who, by reason of diversity of their occupations. constitute a commission which is broadly represent- ative of the community. Sec. 28-12. Terms of office. The terms of four (4) of the members shall expire on October 31st, of each odd-numbered year and the terms of three (3) of the members shall expire on October 31st of each even-numbered year. The members of the commission shall be identified by place numbers of one (1) through seven (7) . The odd-numbered places shall expire in the odd- numbered years and the even-numbered places shall expire in the even-numbered years. Vacancies shall be filled for unexpired terms, but no mem- ber shall be appointed for a term in excess of two (2) years. Sec. 28-14. Meetings and quorum. Four (4) members of the commission shall constitute a quorum for the conduct of business. The members of the commission shall regularly attend meetings and public hearings of the com- mission and shall serve without compensation except for reimbursement for authorized expenses attendant to the performance of their duties. SECTION 2. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Fort Worth providing for the regulation of certain occupations, voca- tions or businesses in the City of Fort Worth, and this ordinance shall not operate to repeal or affect any of such other ordinances except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any, in any such ordinance or ordinances are hereby repealed. SECTION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitu- tional, such holding shall not affect the validity of the remaining portions of this ordinance, and all of the re- mainder of this ordinance not so held to be unconstitutional shall continue to be in full force and effect. SECTION 4. All of the regulations provided in this ordinance are hereby declared to be governmental and for the health, safety and welfare of the general public. Any member of the City Council, any City official or employee charged with the en- forcement of this ordinance, acting for the City of Fort Worth -2- in the discharge of his duties, shall not thereby render himself personally liable, and he is hereby relieved from all personal liability for any damage that might accrue to persons or property as a result of any act required or per- mitted in the discharge of his said duties. SECTION 5. This ordinance shall take effect and be in full force and effect from and after the date of its passage and pub- lication as provided by law.
