HomeMy WebLinkAboutIR 9269 INFORMAL REPORT TO CITY COUNCIL MEMBERS No. 9269 To the Mayor and Members of the City Council June 22, 2010 '��rt�b Page 1 of 1 a SUBJECT: EMERGENCY PROCUREMENT WITH SUNBELT INDUSTRIAL SERVICES FOR TRANSPORTATION AND DISPOSAL OF CONTAMINATED SOILS AT 2500 BRENNAN AVENUE The purpose of this report is to provide details on an Emergency Procurement of soil removal services at the Brennan Service Center and describe the site activities. In December 2009 the City Council approved a Contract with Eagle Construction and Environmental Services, LLP (Eagle)for the transportation and disposal of contaminated soils at 2500 Brennan Avenue from the drainage channel and 3479 W. Vickery Boulevard. During waste characterization activities the Chevron facility, located due north, had an unauthorized release of wastewater that impacted the drainage channel. Once Chevron completed their cleanup and Eagle finished their waste characterization it was discovered that additional contaminated soils, unrelated to the Chevron release, required remediation. Environmental Management brought forward M&C 24119 which City Council approved on March 2, 2010 to remove additional contaminated soils and account for cost increase based on waste characterization. While performing additional investigation to further delineate the amount of impacted soils petroleum impacted soils were found to pose a threat to the Trinity River. Hydrocarbons had begun to migrate out of the soil into the drainage channel. Approximately 17,800 cubic yards of soil requires excavation and approximately 9,500 cubic yards of total petroleum hydrocarbons (TPH) contaminated soil requires transportation and disposal. Proper removal and disposal of the contaminated soils is required under Texas Commission on Environmental Quality rules and regulations. Eagle was unable to continue work due to a "non-compliance" status under the MWBE ordinance. Sunbelt Industrial Services (Sunbelt) was contacted regarding the emergency cleanup. Sunbelt's costs were similar to the prior costs; they could begin work immediately; and committed to a 12 percent MWBE participation. The Environmental Management Department conferred with both the Law and Financial Management Services (Purchasing) Departments to proceed under emergency procurement procedures in order to prevent additional environmental impacts and potential human exposure. Both Legal and Purchasing have agreed that this issue can be treated as "a procurement that is necessary to preserve or protect the public health or safety of the municipality's residents" in accordance with the Texas Local Government Code Section 252.022(a)(2). The emergency purchase was setup with a not to exceed amount of$472,600 that will be paid from the Environmental Protection Fund.
