AN ORDINANCE AMENDING ORDINANCE NO. 2286, WHICH IS
AN ORDINANCE PROHIBITING ANY PERSON TO HAVE, KEEP,
STORE, SELL, OFFER FOR SALE, GIVE AWAY, USE, TRANS-
PORT, MANUFACTURE, DISCHARGE, IGNITE, OR IN ANY
MANNER AID, ASSIST OR ABET IN THE DISCHARGING OR
IGNITING OF ANY FIRECRACKER WITHIN THE CORPORATE
LIMITS OF THE CITY OF FORT WORTH, TEXAS, BY ADDING
THERETO SECTION 4-A, WHICH MAKES CERTAIN EXCEPTIONS
AND AUTHORIZES THE CHIEF OF THE FIRE DEPARTMENT TO
GRANT PERMITS UNDER CERTAIN CIRCUMSTANCES FOR PUBLIC
OR PRIVATE DISPLAY OF FIREWORKS UNDER PROPER POLICE
SUPERVISION; PRESCRIBING A SAVINGS CLAUSE; MAKING
THE ORDINANCE CUMULATIVE OF ALL OTHER ORDINANCES
AFFECTING EXPLOSIVES, EXCEPT IN THOSE INSTANCES IN
WHICH A DIRECT CONFLICT EXISTS; FIXING A PENALTY
FOR THE VIOLATION THEREOF; AND NAMING AN EFFECTIVE
DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1,
That Ordinance No. 2286 be amended by adding thereto Section 4,-A,
which section shall read as follower
Section 4-A.
Nothing in this ordinance shall be construed to apply
to the sale, storage or use of railroad torpedoes or
other signaling devices used by railroads, nor to the
sale, storage or use of flashlight composition by photog-
raphers or dealers in photographic supplies, or to pre-
vent any public or private demonstration or display of
fireworks of any kind, if conducted under proper police
supervision, after application made and permit issued
by the Chief of the Fire Department of the City of Fort
Worth for such demonstration. Said permit shall not be
granted unless such demonstration or display shall be of
such a character and so located, discharged or fired as,
in the opinion of the said Chief of the Fire Department
after proper inspection, shall not be hazardous to prop-
erty or endanger any person or persons.,
SECTION 2.
This ordinance shall be cumulative of all the provisions and sec-
tions of other ordinances of the City of Fort Worth relating to regula-
tions governing the discharge of firearms and fireworks except in those
instances where the provisions of this ordinance are in direct conflict
with such provisions, in which instances said conflicting provisions
are expressly repealed.
SECTION 3.
If any section, part of a section or provision of any section
of this ordinance shall be held to be void, ineffective or unconstitu-
tional by a court of competent jurisdiction, the holding of such section,
part of a section or provision of any section to be void, ineffective or
unconstitutional for any cause whatsoever shall in no way affect the
validity of the remaining sections and provisions of this ordinance,
which shall remain in full force and effect. The City Council would
not have passed any sections, parts of sections or provisions of any sec-
tions of this ordinance that were unconstitutional, void or ineffective
if they had known that they were unconstitutional, void or ineffective
at the time of adopting this ordinance.
SECTION 4.
Any person found guilty of violating any of the provisions of
this ordinance shall be fined in any sum not to exceed One Hundred Dol-
lars ($100.00), and each violation or each day that there is a failure
to comply with the terms of this ordinance shall constitute a separate
offense.
SECTION $.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage and publication as required by
law.
