AN ORDINANCE GRANTING TO ST. LOUIS, SAN FRANCISCO
AND TEXAS RAILWAY COMPANY AN EASEMENT TO CONSTRUCT
A SPUR TRACK OVER A PORTION OF DAKOTA STREET; PRO-
VIDING THAT THE GRANTEE WILL HOLD THE CITY OF FORT
WORTH HARMLESS FROM ANY DAMAGES; AND SPECIFYING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That an easement be and the same is hereby granted to St. Louis, San
Francisco and Texas Railway Company to cross Dakota Street with a spur track
immediately west of a present existing spur track running in a southeasterly
direction beginning at the south end of I,ot 7, Block 3, and ending on the
north side of Lot 20, Block 4, Evans, Pearson, Westwood Addition to the City
of Fort Worth.
SECTION 2.
That the said grantee shall be authorized and empowered to maintain such
spur track along said street so long as it is needed to serve property in
the vicinity thereof.
SECTION 3.
That the said railway company shall accept this grant upon the express con—
dition that it will at all times maintain its track on a level grade with
the street; that it shall keep its tracks and appurtenances thereto in good
condition and in all respects equal to the condition of the adjacent street;
that it will construct all drainage facilities necessary in connection with
its construction work across Dakota Street; and that all work and improve—
ments as herein provided shall be done under the supervision of the City En—
gineer of the City of Fort Worth. That it is further provided in this grant
that said railway company will indemnify and hold harmless the City of Fort
Worth'from all damages and claims for damages arising out of and incident to
or in any way connected with the installation, construction and maintenance
of said spur track.
SECTION 4.
That this ordinance shall be in full force and effect from and after
the date of its passage, and it is so ordained.
