The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectable, with reasonable attorney's fees and costs of collection, if incurred, and shall provide substantially that the amounts evidenced thereby shall be paid to the Assessor and Collector of Taxes of the City of Fort Worth,Texas, who shall issue his receipt therefor, which shall be evidence of such payment on any demand for the same, and the Assessor and Collector of Taxes shall deposit the sums so received by him forth- with with the City Treasurer to be kept and held by him in a separate fund, and when any payment shall be made in the City the Assessor and Collector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said payment thereof. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Treasurer's Warrant for making such payment. Such payments by the Treasurer shall be receipted for the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney's fees, if incurred, have been paid in full. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessments upon other premises. X. Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof,is,in accordance with the law in force in this City, vested in the City. The procedures concerning owner participation in the cost of paving, including methods and policies of determining assessments, street construction standards, and methods of payment were explained to the 35 people in attendance. UNT_T 1 - DAVIS AVENUE - Riverside Drive to Ash Crescent Street No objections to the paving were stated at the hearing. UNIT 2 - DAVIS AVENUE - Ash Crescent to Belzise No objections to the paving were stated at the hearing. UNIT 3 - MULKEY STREET - Beverly Avenue east 250 feet No objections to the paving were stated at the hearing. UNIT 4 - FIFTH AVENUE - Lowe Street to Devitt Street No objections to the paving were stated at the hearing. UNIT 5 - FIFTH AVENUE - Devitt Street to High Street Mr. James W. Callaway, 1240 Devitt, owner of Lot 20, Block B, stated that he was opposed to being assessed for the paving. He said that twelve to fourteen years ago he tried unsuccessfully to obtain the paving. Mr. Callaway inquired whether properties in the Neighborhood Improvement Program would be assessed. He also asked what would happen if he refused to pay the assessment. Mr. Callaway was given information that properties in the Neighborhood Improve- ment Program Areas would be assessed for new paving. It was also explained how a lien is established upon the property as a result of the paving and that pay- ment of the assessment would be necessary to clear the title. UNIT 6 - SHAW STREET - Fifth Street to 350 feet west Mrs. Helen Hickey, representing S. E. Balch of 3245 Fifth Avenue was in favor of the paving, but wanted to know what was meant by curb and gutter. A diagram of a cross-section of curb and gutter was shown to her and full explanation was given. Mr. Gene W. McMath, 1305 Shaw Street, owner of Lots 5 and 61, Block L, speaking for himself and Mr. William E. Brandenburg, 1321 Shaw Street, owner of Lots 1 and 2, Block L, said they favored the paving but were opposed to the construction of side- walk on the south side of the street adjacent to their properties. A sidewalk is included in the project to provide all-weather access to a pedestrian walk-way beneath a railroad just west of the unit, to link existing sidewalk in the block, and to extend existing sidewalk east of this unit leading to a nearby school. Adjacent property owners are being assessed for 220.9 lineal feet of sidewalk frontage, after credits for existing sidewalk, and the City is paying f • t link to the underpass on the west end of the project and for 15 fe o0de at the intersection of Shaw Street and Fifth Avenue. ttAQ%I Assessment Paving on the South Side Page Two UNIT 7 - DICKSON STREET - New Orleans Street to Evans Avenue Mr. William Guy Turner, 802 E. Dickson, owner of the east one-half of Lot 6 and the west 20 feet of Lot 5, Block 8, asked what percentage of the total cost of Unit 7 the property owners were expected to bear. Mr. Turner was told that on this unit the property owners would be assessed 73.6 per cent of the total cost, and that the City would bear 26.4 per cent of the total cost. UNIT 8 - SIXTH AVENUE - Gambrell Street to Beddell Street No objections to the paving were stated at the hearing. UNIT 9 - RYAN AVENUE - Fuller Avenue to 140 feet north No objections to the paving were stated. at the hearing. UNIT 10 - SIXTH AVENUE - Fuller Avenue to Spurgeon Street Mr. Donald D. Harvey, 2100 Hurley, owner of Lot J, Block 26, objected to the paving. UNIT 11 - STANLEY AVENUE - Yates Street to 450 feet south Mr. Roberts, representing the Trustees of Joy Baptist Church, stated that they are in favor of the paving and that they would like information about head-in parking. Mr. Roberts agreed to direct his specific questions to the Traffic Engineer, T. R. Buckmangafter the neighborhood hearing. UNIT 12 - WALTON AVENUE - Colusa Drive to 775 feet east Of the total 1,507.96 feet of frontage on this project, 400 front feet is owned by Mrs. Hugh Thompson, 3409 Walton, whose residence is adjacent to the project, and the remaining 1,107.96 feet is owned by the Westcliff Co. , Inc. After considerable review of assessments and discussion with the property owners, it was determined that a residential credit would be recommended for the portion maintained as a resi- dence (112 feet of the 400 feet owned by Mrs. Thompson), and that the remainder of the property frontage, which is vacant and subject to development, would be assessed at the bid rate per foot. Engineering costs are not being assessed against the property subject to development in order to make the cost distribution comparable to that provided by community facilities contracts. Mrs. Thompson appeared at the neighborhood hearing and stated that she was opposed to the paving on the basis that it benefitted chiefly residents in nearby subdivi- sions and it was of negligible benefit to her property. The project includes the follow- ing units : ROADWAY UNIT STREET LIMITS WIDTH R.O.W. 1 Davis Avenue Riverside to Ash Crescent 30 feet 50 feet 2 Davis Avenue Ash Crescent to Belzise 30 feet 50 feet 3 Mulkey Street Beverly to 250' East 30 feet 60 feet 4 Fifth Avenue Lowe to Devitt 30 feet 60 feet 5 Fifth Avenue Devitt to High 30 feet 50 feet 6 Shaw Street Fifth to 350' West 30 feet 60 feet 7 Dickson Street New Orleans to Evans 30 feet 50 feet 8 Sixth Avenue Gambrell to Beddell 30 feet 60 feet 9 Ryan Avenue Fuller to 140' North 30 feet 60 feet 10 Sixth Avenue Fuller to Spurgeon 30 feet 60 feet 11 Stanley Avenue Yates to 450' South 30 feet 60 feet 12 Walton Avenue Colusa to 775' East 30 feet 60 feet Petitions ,have. been received, for' the, paving, ofcthe .above.-streets. wit4 thd. ex- teption*,of Units 4,- 5, '9; 10, and 12. Units-4 #n47.5., Fifth Avenue' .Unit •9, Ryan, Avenue, and .Unit 10,_ Sixth Avenue, were.,initiated by the City to provide for continuous paving and better flow of traffic in' the area. Unit 12, Walton Avenue from Colusa 775 feet East is scheduled in the Capital Improvement Pro- gram to close a paving gap on Walton Avenue. A number of property owners on the south side of Shaw Street, Unit 6, objected to the bid price for sidewalks in the amount of $3.18 per front foot. Because the proposed sidewalk connects existing sidewalk and a pedestrian railroad un- derpass serving a nearby school, the Public Works Department..requested that the sidewalk bid be reconsidered by the low bid contractor, who has agreed to reduce the rate from $3.18 to $2.00. Property owners have been notified of the reduction. It is the opinion of the Public Works Department that each parcel of property is enhanced in value in an amount equal to or in excess of the amount recom- mended for assessment. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TEX. s DATE REFERENCE SUBJECT: Benefit Hearing - Assessment PAGE NUMBER Paving on the South Side 2 2 12/12/66 2 Project 4-152 °} Recommendation It is recommended that an ordinance be adopted closing the hearing and levying the assessments as proposed.
