APPENDIK, CHAPTER 1, OF ORDINANCE No. 4155, PROVID- ING INSURANCE REWIRE1MVS PRIOR TO THE ISSUANCE OF ANY PERMITS FOR THE REMOVAL OF A BUILDING, AND FURTHER AMENDING SECTION 1405 (b), CHAPTER 14, OF SAID BUILD- ING CODE ORDINANCE, REGULATING ROOM SIZES AND CEILING HEIGHTS; PROVIDING A SAVINGS CLAUSE; MAKING THIS ORDI- NANCE CUMULATIVE OF OTHER ORDINANCES WITH RESPECT TO BUILDING REGULATIONS; REPEALING ALL ORDINANCES IN - CONFLICT HEREWITH, PROVIDING A PENALTY; AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TERAS: SECTION 1. That Paragraph 3 of Section 104, Appendix, Chapter 1, Removal of Buildings, of the Building Code of the City of Fort Worth, Ordinance No. 4155, be amended, and, after being so amended, it shall read as foJlovs: 3. Before any permit for the removal of a building is granted by the Building Official, the person, firm or corporation applying therefor shall have on file, in the City Secretary's office, a certificate showing that such person, firm or corporation has taken out and is maintain- ing automobile, truck, trailer and dolly bodily injury and property damage liability insurance as follows: Automobile, track, trailer and dolly bodily liability insurance in an amount of not less than Twenty-five Thousand Dollars ($25,000.00) for injuries, including accidental death, to any one person, and in an amount of not less than Fifty Thousand Dollars ($50,000.00) on account of one (1) accident; and property damage insurance in an amount of not less than Fifty Thousand Dollars ($50,000.00). No person, firm or corporation shall move any building for vhich a permit is required for moving, from one site"to another within the city limits of the City of Fort Worth, un- til such person, firm or corporation shall have first on file with the City Secretary of the City of Fort Worth a satisfac- tort' surety bond in the sum of Ten Thousand Dollars ($10,000.00) approved by the City Council. Such bond shall be conditioned for the removal of buildings in accordance with the ordinance of the City of Fort Worth regulating same, and shall provide for the indemnification of the City of Fort Worth for any or all damages or liability that may accrue to or against it by reason of the removal of buildings by or under the direction of the maker of such bond. The bond shall be submitted to -- ' the Building Official for filing with the City Secretary after- approval by the City Council, and shall be maintained by renew- al as long as the maker is engaged in the business of moving buildings. SECTION 2. That Section 1405 (b) of Chapter 14, Regulating Room Sizes and Ceiling Heights, of the Building Code of the City of Fort Worth, Ordinance No. 4155, be amended, and, after being so amended, it shall read as follows: (b) Room Sizes and Ceiling I3eights. Every room re- quired to have windows by subsection a) shall have a ceiling height of not less than seven feet, six inches (716") in at least fifty per cent (50%) of its area with no portion less than four feet, six inches (4'611) in height. No portion of such room having a ceiling height of less than five feet (5') shall be considered as con- tributing to the required area hereinafter specified. Every dwelling and/or dwelling unit shall contain at least one hundred fifty square feet (150 sq.ft.) of floor space for one occupant and one hundred square feet (100 sq. ft.) of floor space for each additional occupant there- of. In every dwelling or dwelling unit of two or more rooms, every room occupied for sleeping purposes by one occupant shall contain at least seventy square feet (70 sq.ft.) of floor space, and every room occupied for sleeping purposes by more than one occupant shall contain at least fifty square feet (50 sq. ft.) of floor space for each occupant thereof. Kitchens shall have not less than thirty square feet (30 sq. ft.). SECTION 3. That this ordinance shall be cumulative of all provisions of the Building Code of the City of Fort Worth, Ordinance No. 4155, with respect to building regulations, except in those instances where the provisions of this ordinance are in direct conflict with such Code, in which instances said conflicting provisions of such Code are hereby repealed. SECTION 4. Any person, firm, association of persons, company or corporation, their agents, servants or employees, who violates, disobeys, omits, neg- lects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars ($5.00) nor more than Two hundred Dollars (:$200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM AIM LEGALITY: City Attorney CITY OF FORT WORTH �• .pi- Lamm TEXAS OFFICE OF THE CITY MANAGER Communication to Mayor and Council No. - 19 April 29, 1960 Honorable Mayor and Members of the City Council Re: Amendments to Building City of Fort Worth Code Ordinance No. 4155 Mrs. McKnight and Gentlemen: On April 9, 1960, the City Council authorized the City attorney to prepare an amendment to the Building Code Ordinance No. 4155 by deleting from the section governing insurance requirements for housemovers the requirement that owner's end contractor's liability insurance be obtained. This de- I,etion is necessary by reason of the fact that no longer is 'such specific coverage available. On February 25, 1960, the Building Code Board of Appeals considered a re- Y quest by the Home Builders Association of Fort Worth that changes be made in the minimum ceiling height requirements of the Code to permit 716" ceilings with 416" as the height for knee walls instead of 810" and 51611, respectively, as now required. Such modification of the Code is recom- mended to the City Council by both the Building Code Board of Appeals and the Building Commissioner. In order to limit the number of amendments to the Building Code, such additionally requested amendment with respect to room sizes has been in- cluded in the amendatory ordinance previously authorized concerning house- movers, and said ordinance containing both amendments is recommended for your consideration.
