AN ORDINANCE PROVIDING THAT THE ALLEY ALONG LOTS 5 THROUGH 9, BLOCK 35, JENNINGS SOUTH ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, FROM THE NORTH LINE OF LOT 9 SOUTH TO PETERSMITH STREET, BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley along Lots 5 through 9, Block 35, Jen- nings South Addition to the City of Fort Worth, Tarrant County, Texas, from the north line of Lot 9 south to Peter- smith Street, be and the same is hereby- vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owners of the fee as pro- vided by- law, save and except that an easement is reserved for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Subject right-of-way, acquired by dedication, is not open on the ground. If this request is granted the Applicants intend to utilize the vacated right- of-way for additional off-street parking area. City Departments and private utility companies have reviewed this request and have no objections, provided the Applicants replat and retain the vacated right-of-way as an easement for the existing utilities. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested. The Applicants have submitted a satisfactory replat. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission. HDM/mh Attach.
