O ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF JACKSBORO HIGHWAY AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH TEXAS STATE HIGHWAY DEPARTMENT FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with TEXAS STATE HIGHWAY DEPARTMENT for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in .said City, to-wit: JACKSBORO HIGHWAY From Approximately 366 Feet East of North Commercial Street to University Drive, known and designated as Unit No. 1, Project No. 104-35000-309. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 6130 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6130 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on•the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying_ the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description On April 14, 1969, the City of Fort Worth contracted with the Texas Highway Department for widening and improving the surface of Jacksboro Highway from White Settlement Road to University Drive. The City of Fort Worth agreed to pay for the construction of the curbs, gutters, driveways and storm sewers with a portion of the City's share of cost to be assessed against the owners of the abutting property (M&C C-1461). Project Cost and Financing This project has been completed and final inspection has been made by the Public Works Department staff. The City of Fort Worth's share of construction cost based on final quantities of materials used is $44,776.15, of which $20,010.16 is assessed against the abutting property owners. The City has previously deposited with the State the amount of $40,600, leaving a final payment due from the City of $4,176.15. Sufficient funds are available in Project No. 104-35000-309, "Jacksboro Highway". Deviation from the original estimated construction cost resulted in an over-run as described below: 1) Four additional driveways were constructed after the benefit hearing was held. The affected property owners have signed notes to pay the full amount of $1,383.85 upon completion of the project. + $1,383.85 2) Engineering costs on this project exceeded the usual ten (10%) per cent estimated by the Texas Highway Department and 14.332 per cent has been charged the City for engineering costs due to the relatively small size of the project. + 1,552.88 3) Minor variations between quantities estimated and quantities measured and used at the job site. + 1,239.42 Total Additional Cost $4,176.15 Recommendation It is recommended that the project described above be accepted as complete by the adoption of an ordinance and that final payment of $4,176.15 be authorized to the Texas Highway Department.
