AN ORDINANCE PERMITTING A.. L. DAVIS TO LEAVE THE ES.-
ISTING REFRIGERATION UNITS TO HIS BUILDING WITHIN THE
PARKWAY OF HAMPTON STREET AWAC3XT TO BLOCK 48. FOS-
TEPCO HEIGHTS ADDITION, FOR A MAKIMUM DISTANCE OF 4.7
FEET AS SAME ARE NOW LOCATED IN SAID HAMPTON STREET:
AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE
IMMEDIATELY.
WHEREAS, A. L. Davis is the owner of an existing building lo-
cated at 3455 Decatur Avenue, the same being Block 48. Fostepco Heights
Addition, the refrigeration and electrical equipment of which extends
at the rear of said building for a maximum distance of 4.7 feet into
and upon said Hampton Street adjacent to its east property line between
Dixie Street and 34th Street, and beginning 110 feet north of the south-
west corner of Lot 3,81ock 48, Fostepco Heigb.ts Addition, and extending
in a northerly direction for a distance of 20 feet; NOW, THEREFORE,
BE IT ORDAINED BY ME CITY COUNCIL CF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That A. L. Davis, the owner of said land above described and the
improvements situated thereon, be permitted to leave the existing build-
ing and its refrigeration and electrical equipment for a maximum dis-
tance of 4.7 feet as said refrigeration and electrical equipment now
exists and is located in Hampton Street across its easterly line between
Dixie Street and 34th Street, and beginning 110 feet north of the south-
west corner of Lot j, Block 48, Fostepco Heights Addition, and extending
in a northerly direction for a distance of 20 feet; and. that said improve-
monto now existing be allowed to stand during the life of said building
as the same are now contracted, provided, however, that in the event
said property within Hampton Street is ever needed by the City for any
reason, said improvements encroaching upon Hampton Street shall be removed
therefrom upon written notice from the said City of Fort Worth, and pro-
vided further that in the event such building be demolished or major al-
terations and repairs be made to said building in the fixture, said build-
ing shall be reconstructed or repaired so as not to encroach upon Hampton
Street and'so as to be in compliance with the then existing ordinances,
rules and regulations of the City of Fort Worth, Texas.
SECTION 2.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage.
