AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE TRANSPORTATION IMPACT FUND IN THE AMOUNT
OF $676,426.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF PAVEMENT,
SIDEWALKS, WATER, STREET LIGHTS AND DRAINAGE IMPROVEMENTS FOR
SUMMER CREEK DRIVE AND MCPHERSON BOULEVARD; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2011-2012 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Transportation Impact Fund in the amount of $676,426.00, from available funds, for the purpose of
pavement, sidewalks, water, street lights and drainage improvements for Summer Creek Drive and
McPherson Boulevard.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.1 99 1 1-09-20 1 1 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of a Community Facilities Agreement with Legacy Capital Company in the Amount of
$6,573,880.66 for Pavement, Sidewalks, Water, Street Lights and Drainage Improvements for Summer
Creek Drive and McPherson Boulevard, Authorize Execution of an Interlocal Agreement with Tarrant
County in the Amount of$500,000.00 and Adopt Appropriation Ordinances (COUNCIL DISTRICT 6)
RECOMMENDATION:
It is recommended that the City Council take the following action:
1. Authorize the City Manager to execute an Interlocal Agreement with Tarrant County in the amount of
$500,000.00 to partner in funding the construction of Summer Creek Drive and McPherson Boulevard;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
2004 Capital Improvement Program New Development Fund in the amount of$500,000.00 from available
funds;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Transportation Impact Fund in the amount of$676,426.00 from available funds; and
4. Authorize execution of a Community Facilities Agreement with Legacy Capital Company in the amount
of$6,573,880.66 for pavement, including a roundabout at Summer Creek Drive and McPherson
Boulevard, water and sanitary sewer main improvement, and landscaping and irrigation system for the
streets listed below.
DISCUSSION:
This project consists of the construction of Summer Creek Drive from Risinger Road to McPherson
Boulevard, McPherson Boulevard from future SH 121T Chisholm Trail Parkway to Willow Branch Way, a
16 inch Water Main, a 12 inch water line, sewer lines to serve the surrounding area, a roundabout at
McPherson Boulevard and Summer Creek, and extensive landscaping. The annual budget impact for the
Parks and Community Services Department landscape maintenance for this project is anticipated to be
$50,000.00.
The City will utilize $3,276,293.00 from the 2008 Bond Program, $888,000.00 from the Water Capital
Projects Funds, $676,426.00 from Transportation Impact Fee Funding, and $500,000.00 from Tarrant
County to provide for construction contract costs, contingencies and construction services for a project
total of$5,340,719.00. Included in the total project cost is $625,171.00 that will be utilized for
contingencies and construction services including surveying, material testing and construction
inspection. Legacy Capital Company will provide $1,233,161.66 toward this CFA.

Summer Creek Drive is a major arterial on the City's Master Thoroughfare Plan. The 2008 Capital
Improvement Program (CIP) approved funding to construct a four lane divided major arterial with
sidewalks from Risinger Road to McPherson Boulevard. McPherson Boulevard is a principal arterial on
the City's Master Thoroughfare Plan. Construction of the two westbound lanes of McPherson Boulevard
will compliment the existing two eastbound lanes of McPherson Boulevard from Willow Branch Way to
Summer Creek Drive providing a divided arterial between Summer Creek Drive and Hulen Street. Legacy
Capital Company intends to build McPherson Boulevard from Summer Creek Drive to the new Chisholm
Trail Parkway to coincide with its development of Legacy Ranch. Legacy Capital Company will pay for its
portion of McPherson Boulevard from Summer Creek Drive to Chisholm Trail Parkway.
The cost stated is based on the public bids received by Legacy Capital Company. The City's cost
participation will be in an amount not to exceed $5,340,719.00.
This project is located in COUNCIL DISTRICT 6, MAPSCO 102V, 102Y and 102Z and 103W.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon adoption of the recommended
appropriation ordinances, funds are available in the current capital budgets, as appropriated, of the Water
and Sewer Capital Projects Fund, Transportation Impact Fund, New Development Fund and the Street
Improvements 2008 Fund.
