AN ORDINANCE CLOSING, VACATING AND PERMANENTLY
ABANDONING THE ALLEYWAY LOCATED IN BLOCK NO. 14,
TURNER'S SUBDIVISION OF BEACON HILL ADDITION,
AN ADDITION OF THE CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS; DECLARING THAT THE PUBLIC INTEREST
AND CONVENIENCE DEMAND SUCH ACTION; PROVIDED THAT
THE EFFECT OF THIS ORDINANCE SHALL OPERATE AS A
QUIT CLAIM DEED OF THE ABUTTING PROPERTY OWNERS
AS TO THE ALLEYWAY CLOSED; PROVIDING THAT THE
CITY OF FORT WORTH AND THE PUBLIC UTILITIES NOW
USING SAID ALLEY SHALL AT ALL TIMES HAVE THE
PRIVILEGE OF A RIGHT-OF-WAY IN, TO AND THROUGH
SAID ALLEYWAY SO CLOSED, VACATED AND ABANDONED
94ITHOUT CHARGE;) PROVIDING THAT THIS CEDINANCE
SHALL BECOME EFFECTIVE IMMEDIATELY UPON AND AFTER
THE DATE OF ITS PASSAGE.
WHEREAS, it appearing to the City Council of the QlL•y
of Fort Worth, that the alleyway now existing in Block No. 14
of Turner's Subdivision of Beacon Hill Addition, an addition
to the City of Fort Worth, Tarrant County, Texas, is not now
being used as a public thoroughfare and never has been used
as such; that the public necessity and convenience demand that
such alleyway be closed said alleyway being more particularly
described as follows to-wit:
'All that certain lot, tract or parcel of land
in Block No. 14 of Turner's Subdivision of Beacon
Hill Addition to the City of Fort Worth, Tarrant
County, Texas, dedicated to the public as an'alley
according to the plat records of Tarrant County,
Texas, said alley lying between Mount Vernon Street
and the Dallas Pike and commonly known as the 3800
block on said Streets.
WHEREAS'; all of the property owners abutting and being
adjacent to said alleyway described above and the owners and
holders of property in said block have assented to the closing
of the said alley and have petitioned the City Council in
writing that said alleyway be closed and Ya ve assented to the
closing of the same and have accepted a reversion and repeal
--of any and all rights in and to said alleyway from the City of
Fort Worth except that the same shall revert one-half to each
of the said property owners abutting thereon.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF FORT WORTH:
SECTION ONE.
That the following described section and portion of
an alleyway within the corporate limits of the City of Fort
Worth be and the same is hereby declared to be permanently
closed and abandoned and forever vacated for use as a public
street, highway or thoroughfare, to-wit:
"All that certain lot, tract or parcel of land
In Block No. 14 of Turners Subdivision of Beacon
Hill Addition to the City of F crt Worth, Tarrant
County, Texas, dedicated to the public as an alley
according to the plat records of Tarrant County,
Texas, said alley lying between mount Vernon Street
and the Dallas Pike and commonly known as the 3800
block on said Streets."
SECTION TWO
That the permanent closing, vacating and abandoning
of the above described alleyway is hereby declared to be a
public necessity, that this ordinance shall operate as a
quit claim deed from the City of Fort Worth to the abutting
property owners, resigning and discharging any and all claims
of the City of Fort Worth to use the same as a public highway
and thoroughfare, but the privilege of using the same for
right-of-way purposes at any time is hereby expressly reserv-
ed by said City, for the use of the City of Fort 'North and
for the use of public utilities.
SECTION THREE.
That this ordinance shall become effective immediately
from and after its passage.
