AN ORDINANCE PROVIDING FOR THE ABANDONMENT,
CLOSING AND VACATING OF A PORTION OF A CER-
TAIN ALLEY EXTENDING FROM THE SOUTH BOUNDARY
OF MAGNOLIA AVENUE BETWEEN EIGHTH AVENUE AND
HURLEY AVENUE IN THE CITY OF FORT WORTH TO A
POINT APPROXIMATELY 150 FEET SOUTH; AND AC-
CEPTING THE DEDICATION OF AN ALLEY AND THOR-
OUGHFARE EXTENDING FROM THE ALLEY ABOVE DE-
SCRIBED EAST TO THE WEST LINE OF HURLEY AVENUE
IN SAID CITY; AND PROVIDING FOR THE REPEAL
OF ALL ORDINANCES OR PORTIONS OF ORDINANCES
IN CONFLICT HEREWITH.
WHEREAS, it appearing to the City Council
of the City of Fort Worth that there is a portion of
an alley or thoroughfare extending from the south line
of Magnolia Avenue between Eighth Avenue and Hurley
Avenue to a point approximately 150 feet south of
said Magnolia Avenue that has not been used as a pub-
lic thoroughfare for more than fifteen years, and as
a public way for travel has been abandoned and vacated
for the time above set forth; and
WHEREAS, it further appearing to the City
Council that prior to the time said thoroughfare was
closed and at the present time that the portion of the
alley above described passes over a hill and steep in-
cline that is now and was prior to the time above set
forth dangerous for use as a public thoroughfare and
constitutes a nuisance; and
WHEREAS, it further appearing to the City
Council that it will be to the best interests of the

public and public necessity requires that the portion of
said alley above described be closed, Vacated and per-
manently abandoned as a public thoroughfare; and
WHEREAS, it further appearing to the City Coun-
cil that All Saints Hospital, a charitable corporation,
owns lots 13 and 14 in Block A, McAnulty & Nye's Sub-
division of Block 29 of Field Welch Addition to the City
of Fort Worth in Tarrant County, Texas, which lots ex-
tend from the alley running through Block A to Hurley
Avenue and that said corporation has dedicated an alley
12 feet in width extending from said alley to Hurley
Avenue between said lots 13 and 14 upon the condition that
that portion of the alley above described extending from
the north line of the proposed alley be abandoned as above
set forth; and
WHEREAS, it further appearing that in the event
that that portion of the alley running through Block A
as above described is closed and the new thoroughfare
that the said hospital proposes to dedicate is accepted
by the City Council, a practical, safe and convenient alley
and thoroughfare will be provided for all property owners
in Block A and for the public generally who desire to use
such a thoroughfare; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH:
SECTION I
That that portion of the alley extending through
Block A of McAnulty & Nye's Subdivision of Block 29 of
Field Welch Addition to the City of Fort Worth in Tar-
rant County, Texas, between Eighth Avenue and Hurley
Avenue and extending A0000Rfrom the south line ofMag-
nolia Avenue and more. particularly described as a tract
of land BEGINNING at the northeast corner of Lot 1 in
said Block and extending south 148 feet;

THENCE northeast 14.1feet to�the southwest cor-
ner of lot 14:
THENCE north 138 feet to the northwest corner
of lot 16;

THENCE west to the place of BEGINNING.
And that the said thoroughfare and tract of land is here-
by vacated, closed and permanently abandoned as an alley
or public thoroughfare.
SECTION II
That the dedication by the said All Saints
Hospital of the above described thoroughfare in Block
A of McAnulty & Nye's Subdivision of'Block 29 of Field
Welch Addition to the City of Fort Worth in Tarrant
County, Texas, and which tract and thoroughfare is more
particularly described as a parcel of land BEGINNING at
a point in the west line of the alley extending through
Block A 138 feet from Magnolia Avenue;
THENCE 100 feet east to the west line of
Hurley Avenue;
THENCE 12 feet south to the northeast corner of
At 13;
THENCE west 90 feet to a point;
THENCE southwest 141 feet to a point in the east
line of the alley running through block A.
And that said tract and parcel of land and thoroughfare
be and the same is hereby accepted by the City of Fort
Worth as a public thoroughfare and as a continuation of
and portion of the alley extending through Block A as above
described.
SECTION III
That all ordinances or portions ordinances in
conflict herewith are hereby repealed.
SECTION IV
That this section shall take effect and be in
full force and effect from and after the date of its
passage.
