Assessing a portion of the cost of improvement on
East 7eatherford Street, in the city of Fort ',orth, Texas,
between its intersection with the east line of Co=,rce
Street and its intersection %vith the west line of the right
of way of Pt.W. & D . C . R. R., against the owner's of prop-
erty abutting thereon and their property; and providing

the Board of Commissioners of said City by resolution direct-
ea ,he improvement of Fast '. eatherford street between it% in-
tersection with the east line of Commerce Street and its
intersection with the west line of right of- way of Fort "7orth
and Denver R. R., by raising, filling, grading and paving the
same; and whereas, in accordance with said resolution, speci-
fications for said work were duly prepared by the said Board;
and whereas, bids for said improvement were duly advertised
for as required by the City Charter; and whereas, said bids
were received, opened and considered by the Board of Commis-
sioners, and the bid of the Metropolitan Construction Company,
a corporation, for tha ern t3T.301ii ol said strae; was accep.ud
by said Board of Commissioners; and whereas, the said Company
has entered into contracts with the city of Fort ': girth, as
provided by the Charter, for the improvement of said streets
within said "limits by raising, grading and filling the same ,
and by paving same with Bermudez Lake or Trinidad La're Shoot
Asphalt pavement upon a five inch gravel concrete base; and
whereas, the said Company has executed its bonds to the city
of Fort '.:'or th for the maintenance of the said improvements
and for ,,the construction thereof in accordance with said cou-
trPets upoc j.:"'ca'-ons , -With surotio s as required 'U3r the
said City Charger, thich contract and bonds with the sareties
thereof have been cluly approved by the said Board of Commis-
sioners; and, whereas, thereafter, the City Engineer of said
city filed his :written statement with the Board of Commissiorers
concerning the said improvements, and the cost thereof as
provided by Section 8, Chapter =, of the Charter of said
City, which statement was considered by the said Board, cor-

find and declare the necessity of ass000-Ing a portion of the cost
of said improvements against the owners of property abutting there-
on, and their property, and did prescribe a hearing to the said
owners, their agents and attorneys, and fix, a late Vrrefor, and
direct the Oity Secretary of the said e ity to issue notice of the
said hearing by advertisement as provided by the said City Charter
p and also byposting said notices 'as therein provided, and wher as,
in accordance with the said resolution the said City Secretary
did issue a notice of the said hearing to the said property owners
by pzablication thereof for the time and in the manner rascribed
by the City Charter in "The Star-Telegram," a daily paper of gereral

circulation in the City of Fort ','orth, for five (5) consecutive
days prior to the said hearing, and did also notify the said
owners of the said hearing by posting a copy of tle said notice
to each of them at the po stoffice in the City of Fort Worth, more
than ten (10) days prior to the date of the hearing; and, creas,
the• said hearing, in accordance with the said resolution and
notice, was held by the Board of Commissioners, on the 16th day
of August, 1910, at 9 o'clock, A. Y. at ,which time and place no
owners of property appeared to contest the said assessrent or the
benefit$ of said improvement or any other matter or thing con-
nected with the said improvement or any irregularity with refer-
ence thoreto, except as shown upon the records crf tPra board of

FIZ.,T: That the benefits to each _t reel of property of each
or ;_er hereinafter named, in the enhai ced "aloe of the said prop-
erty exceed in each case, the amounts hereinafter assessed against
such owners, and their property. And the Board 'laving considered
the evidence, and it appearing therefrom that the strict appli-
cation of the front foot rule or plan whereby each owner is to
be assessed in proportion as the fro-:cat�ff of '-is prorert=y ie to
the whole fron' age improved, would be in particular c..ses un_

ceived, and that the apportionment of the cost of said improve-
ments between property owners and the assessments hereinafter

That the amount set opposite the name of each owner
above am& his property is hereby assessed against the said
property and declared to be their personal liability of the
owner thereof, and secured by a lien upon the said property
superior to all. other lions, claims or
taxes; that the amounts payable by each owner and assessed
against his or her property above shall be payable as follows,
to-wit:
Onethird within thirty days after the completion
and acceptance of the work by the City, onet)kird in one year
and onethird in two years after the date of acceptance t ere-
of by the City. All deferred payments if no default is -- de
in the payment of any installment when due shall bear interest
at the rate of six per cent per annum. If default be made in
the payment of any instal mat of any c ertif i ea t,_w"n cilia
then all unpaid installments shall bear interest from date at
the rate of eight per cent per annum and collection charges.
Such deferred payments to be evidenced by improverent cer-
tificates to be issued by the City, payable to the cont.•actor
constituting a personal liability against the respective proper-
ty owners whose lands are assessed and be secured by a lien
on such property super`or to all other liens, claims or titles
except lawful taxes, and be issued in the manner and form
prescribed by the laws and ordinances of the said City of Dort
TOrth . }
