HomeMy WebLinkAboutOrdinance 2888 r � ^ AN ORDINANCE providing for the vacating, abandoning and closing of a 20 foot alley which formerly existed over and across the South 20 feet of Lots 7 and 18 in Block 9 of Byers & McCart Addition to the City of Fort Worth, and accepting in lieu thereof a 20 foot alley over and across the South 20 feet of Lots 6 and 19 in said Block. WHEREAS, on November 14, 1945, Interstate Circuit, Inc„ the then owner of Lots 7 and 18 in Block 9 of Byers & McCart Ad— dition to the City of Fort Worth, did dedicate to the use of the public an alley 20 feet wide over and across the South 20 feet of said Lots 7 and 18, which instrument of dedication appears of record in vol. 1754, pg 502, deed records, 'arrant County, Texas;- and, WHEREAS, on November 30, 1949, the City Council of the City of Fort Worth, passed a resolution authorizing the relocation of said alley over and across the South 20 feet of Lots 6 and 19 in said Block 9, and agreeing to accept such relocated al- ley and give a quitclaim deed to McKeever Realty Management Co., Ltd., covering the South 20 feet of said Lots 7 and 18 upon execution and delivery of a written dedication of the relocated alley on the South 20 feet of said lots 6 and 19; and WHEREAS, on February 15, 1950, W. W. McKeever et al, Trustees, the then owners of said lots 6 and 19, did execute and deliver to the City of Fort Worth an instrument of dedication Whereby said 20 foot alley was relocated upon the South 20 feet of said lots 6 and 19, which instrument is of record in Vol. 2165, pg. 400, deed records, Tarrant County, Texas; and, UMUS on February 22, 1950, The City of Fort Worth, acting by and through its Mayor, did execute and deliver a quitclaim deed to McKeever Realty Management Co., Ltd., covering the South 20 feet of said Lots 7 and 18 in Block 9 of Byers and McCart Addition, which said quitclaim deed appears of record in vol. 2167, pg. 376 deed records, Tarrant County, Texas; and, WHEREAS formal ordinance abandoning, closing and vacating such 20 foot alley as formerly located on the South 20 feet of said lots 7 and 18 was never passed by this Council, although such al- ley was actually closed, vacated and abandoned on the ground, and relocated as hereinabove recited: NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fort Worth, Texas: SECTION I THAT the 20 foot alley whbeh formerly existed over and across the South 20 feet of lots 7 and 18 in Block 9 of Byers and Me— Cart Addition to the City of Fort Worth, be and the same is hereby declared to have been vacated, abandoned and closed in— so—far as said Lots 7 and 18 are concerned, and to have been relocated upon the South 20 feet of Lots 6 and 19 as hereinabove more fully recited, and all acts heretofore done by the City of Fort Worth and the owners of said properties in regard there to are hereby ratified and confirmed as fully to all intents and purposes as if an ordinance of abandonment had been passed by this Council at that time.
