ORDINANCE NO.
An Ordinance by the City Council of the City of Fort Worth, Texas,
approving Resolution No. 74-59 of the Dallas-Fort Worth Regional Airport
Board, which amends Resolution No. 71-172 (known and adopted as The Code
of. Rules and Regulations of the Dallas-Fort Worth Regional Airport) providing
for the amer,dn,ent of Chapter Two of the Code, Section 2 thereof, entitled
"Traffic Control installations"; making it unlawful to disobey traffic control
installations; providing that such installations shall conform inscfar as pos-
sible, to the Manual and Specifications adopted by the State Highway Com-
mission of the State of Texas; adopting, affirming and ratifying the traffic
control installations as presently located, erected and installed on the
Dallas-Fort Worth Regional Airport, as shown on the. attached plats and maps
of the AirporL ,vlhich are made a part hereof; providing the procedures for making
changes in such installations; adopting and setting the vehicular speed limits
as presently posted, which said speed limits were and are hereby- based upon
an engineering and traffic investigation as required by state law, as shown
on such attached plats or maps which are made a part hereof, providing a
severability clause; providing a penalty for violations not to exceed a fine
of two hundT'ed dollars ($200); and providing an effective date.
WHEREAS, Section 8 F. of the Contract and Agreement; Between the
City of Dallas, Texas, and the City of Fort Worth., Texas, provides that
the Dallas-Fort Worth Regional Air,port Foard shall have the pcovcr, by a duly

WHEREAS, .Article 46d-14, Revised Civil Statutes of Texas, and Section
8.F. of the Contract and Agreement provide that such orders by said Airport
Board shall become effective only upon approval of the governing bodies of
the Cities of Dallas and Fort Worth and publication as therein provided; and
WHEREAS, pursuant to the foregoing, the Dallas-Fort Worth Regional
Airport Board on October 5, 1971, passed, approved and ordered Resolution
No. 71-172, which adopts The Code of Rules and Regulations of the Dallas-
Fort Worth Regional Airport, and thereby defines certain terms; regulates
traffic and travel within the Dallas-Fort Worth Regional Airport; prohibits or
otherwise regulates certain personal conduct relating to restricted areas,
animals, soliciting, signs, destruction of property, throwing of objects,
litter, refusal to pay for services, weapons and explosives, fire fighting
equipment, kites, organizations, impersonating an officer, camping, swim-
ming or picnicking, and photography, productions and polls; establishes
certain procedures for the adoption of additional rules, regulations and orders,
and the issuance of parking and traffic citations; provides for a fine of not
to exceed Two Hundred Dollars ($200.00) for any violation thereof; provides
a severability clause; and provides an effective date; and
WHEREAS, in accordance with Section Three of Chapter Five of The
Code of Rules and Regulations of the Dallas-Fort Worth Regional Airport, the
Airport Board has requested that the City Councils of the Cities of Dallas and
Fort Worth approve its said Resolution TJo. 74-59 in order that it may become
effective as stated by law and in said Code;
NOV'I, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH:
SECTION' 1, That all of the declFrations and findings contained in
the preambles of this Ordinance are made a part hereof and shall ba fully
effectiv,, as a part of the ordained subject matter of this Ordinance.

SECTION 2. That Resolution No. 74-59 of the Dallas-Fort Worth
Regional Airport Board, a duly certified copy of which is attached 'hereto and
made a part of this Ordinance by reference, is hereby approved.
SECTION 3. That after publication of a substantive statement relative
to the contents of such Board Resolution No. 74-59 of the Dallas-Fort Worth
Regional Airport and the penalty for the violation thereof, in a newspaper of
general circulation in each of the Counties of Dallas and Tarrant, stating
that a breach of any provision of said Resolution No. 74-59 of the Dallas-
Fort Worth Regional Airport will subject the violator to the infliction of a
penalty, and stating that the full text of said Resolution No. 74-59 and any
attachn.ents thereto are on file in the principal office of the Board where the
same may be read by any interested party, the said Resolution No. 74-59
shall thereafter have the same force and effect within the boundaries of the
Dallas-Fort Worth Regional Airport as an ordinance by the City Council of
the City of Fort Worth would have in the City of Fort Worth, and said penalty
shall be enforced in the same manner in which penalties prescribed by other
ordinances of the City of Fort Worth are enforced.
SECTION 4. That the sections, paragraphs, sentences, clauses and
phrases of this Resolution No. 74-59 are severable, and if any phrase, clause,
sentence, paragraph or section of this Resolution No. 74-59 shall be declared
unconstitutional by the valid judgment or decree of anv court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this Resolution
No. 74-59, since the samewould have been enacted without the incorporation
in this Resolution No. 74-59 of any such unconstitutional phrase, clause,
senLence, paragraph or section.
t'ECTION 5. That this Ordinance shall take effect in accordance with
tine provisions of the Charter of the City of Fort V%orth and it is accordingly
APPROVED AS TO FORM AND LEGALITY:

RESOLUTION NO, 74 -§9
BE IT RESOLVED BY THE DALLAS-FORT WORTH REGIONAL AIRPORT BOARD:
"SECTION 1 . That Chapter Two of The Code of Rules and Regulations of the
Dallas-Fort Worth Regional Airport Board, dated September, 1971 , being
Board Resolution No. 71-172, entitled "Regulation of Vehicles" , be amended
by adding Paragraphs (b) and (c) to Section 2 thereof, entitled "Traffic Control
Installations" so that such Section shall hereafter read as follows:
'Section 2. Traffic Control Installations
• '(a) It shall be unlawful to disobey any traffic control de-
vice, sign, signal, marking or insignia erected, installed or
placed by authority of the Airport Board. This shall apply,
when applicable, to both vehicular and pedestrian traffic.
Insofar as possible, all such devices, signs, signals , mar-
kings or insignia shall conform to the Manual and Specifica-
tions adopted by the State Highway Commission of the State
of Texas, as set forth in Sections 29 and 31 of Article 6701d
of the Revised Civil Statutes of the State of Texas .
'(b) Except for speed limit signs, all traffic control de-
vices, signs , signals, markings and insignia as presently
located, erected or installed on the premises of the Dallas-
Fort Worth Regional Airport, are hereby adopted, affirmed and
ratified. Hereafter, the Executive Director, or the person,
officer or employee designated by him, shall conduct studies
and investigations relating to all such traffic control devices,
signs , signals, markings and insignia , and in accordance with
such studies and determinations shall make such changes as
are deemed necessary in the interest of traffic safety. Such
changes, when effected, shall be entered upon an official map
or drawing either by words and/or by legend, with the notation:
"Change effective on 19 (date) , and
certified by (name and title of
designated person, officer or employee) . "
'Provided, however, the delegation of authority herein
granted shall not extend to establishing or changing speed
limits, whether maximum or minimum, but same shall be
established by the Board according to the requirements of
State Law as delegated to cities by Legislative enactment.
'(c) Based upon the authority vested in the Cities of
Dallas and Fort Worth by Sections 169(b) and 170(b) of
Article 6701d of Vernons Annotated Civil Statutes, the speed
limits upon the streets, ways , passages and vehicular
routes within the boundaries and confines of the Dallas-
Fort Worth Regional Airport are set, affirmed and ratified
as shown on the map or plat attached hereto, and as de-
scribed in the attachment.
'In compliance and in obedience to the above authority,
the Dallas-Fort Worth Regional Airport Board has determined
upon the basis of an engineering and traffic investigation
that the prima facie maximum speed limits herein set forth
are reasonable and safe under the conditions found to exist at
all intersections and other places and upon any part of the
airport roadway system, having taken into consideration the
width and condition of the pavement and other circumstances
on such portions of said airport roadway system as well as
the usual traffic speed limits thereat and thereon, which
limits when appropriate signs giving notice thereof are
erected shall be effective at any such intersection or other
place or part of the airport roadway system at all times
during hours of daylight or darkness, or at such other times
as may be determined.'
"SECTION 2. That the provisions of this Resolution shall be deemed to be
severable, and if any of the Sections, paragraphs, sentences, clauses,
phrases or words of this Resolution shall be held to be invalid or uncon-
stitutional by the judgment or decree of any court of competent jurisdiction,
such holding shall not affect any of the remainder of this Resolution, and the
remaining portions thereof shall be unaffected thereby and be in full force and
effect.
"SECTION 3. That any person, firm or corporation who shall violate sub-
paragraph (a) hereof shall be deemed guilty of a misdemeanor, and upon con-
viction shall be punished by a fine not to exceed two hundred dollars ($200) ,
and each day such violation shall continue shall be a separate offense.
"SECTION 4. That this Resolution shall take effect upon approval by the City
Councils of Dallas and Fort Worth."

- �� On October 26, 1971, the City Council acted concurrently with the City of
Dallas in adopting the Code of Rules and Regulations of the Dallas/Fort Worth
Regional Airport Board (Resolution 71-172) . This action was taken pursuant
to the general powers for the joint operation of airports contained in
Article 46d-14 of the Revised Civil Statutes of Texas. The Contract and
Agreement between the City of Dallas and the City of Fort Worth, Section 8 F,
provides that such rules and regulations shall become effective only upon
approval of the governing bodies of both cities.
The Dallas/Fort Worth Regional Airport Board has recommended two amendments
to the Code of Rules and Regulations, each of which also requires concurrent
approval by the two Cities.
Board Resolution 74-59 proposes to amend Section 2, Chapter Two of the Code
of Rules and Regulations, which section pertains to Traffic Control Installa-
tions, by affirming and ratifying traffic control installations as presently
located, erected and installed on the Dallas/Fort Worth Regional Airport;
providing procedures for making changes in such installations and affirming
and ratifying existing speed limits at the Airport.
Board Resolution 74-60 proposes to amend Section 2, Chapter Five of the
Code of Rules and Regulations, which section pertains to Airport Security,
by providing for the appointment of Special Officers for specific duties at
the Airport, such officers to be furnished by other firms, persons or
corporations, but the qualifications, duties and training of such officers
to be prescribed by the Chief of the Airport Department of Public Safety;
limiting the authority of such Special Officers to carry arms to definite
premises and at prescribed locations and providing for the revocation of
the appointment or lesser disciplinary action of such Special Officers as
the Executive Director of the Airport shall deem necessary.
Recommendation
It is recommended that the proposed amendments to the Dallas-Fort Worth Code
of Rules and Regulations be approved by adoption of the ordinances described
above.
