AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
LIVE OAK STREET, EAST 2ND STREET AND EAST 3RD STREET,
SITUATED IN THE MOORE THORNTON AND COMPANY ADDITION,
AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS, AND CONTAINING APPROXIMATELY 35,838 SQUARE FEET
OR 0.823 ACRES OF LAND,PROVIDING FOR THE REVERSION OF FEE
IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That portions of Live Oak Street, East 2nd Street and East 3`d Street, according to the plat
of Moore Thornton and Company Addition, an unrecorded plat, City of Fort Worth, Tarrant
County, Texas, and containing, 35,838 square feet or 0.823 acres of land, and as more specifically
described in Exhibits "A" and "B" attached hereto and incorporated herein by reference, be and
the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street right-of-way is released and shall
revert to the adjacent owner as provided by law.

SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
LIVE OAK STREET VACATION
BEING 0.823 acre of land comprised of Live Oak Street from the South right-of-way line of
East 3rd Street to the South right-of-way line of East 1st Street, a portion of East 2nd Street,
and a portion of East V Street, according to the plat of Moore Thornton and Company
Addition, an unrecorded plat, City of Fort Worth, Tarrant County, Texas. Said 0.823 acre of
land being more particularly described by metes and bounds as follows:
BEGINNING at a 5/8" iron rod found, at the intersection of the Southeast right-of-way line of 15t
Street (a 60 foot wide public right-of-way) with the Southwest right-of-way line of Live Oak
Street (a 60 foot wide public right-of-way), and said point lying at the North corner of Lot 3,
Block 17, of said Moore Thornton and Company Addition;
THENCE N 860 49' 47" E 67.58 feet, severing said Live Oak Street, to a point lying at
the West corner of Lot 5, Block 2, Cunningham and Woodalls Addition, an addition to the
City of Fort Worth, Tarrant County, Texas, according to the plat recorded in Volume 57,
Page 490, of the Plat Records of Tarrant County, Texas;
THENCE S 300 34' 21" E 528.78 feet, along the Northeast right-of-way line of said Live
Oak Street, to a point at the intersection with the Southeast right-of-way line of East 31d
Street (60 feet wide public right-of-way);
THENCE S 590 18' 37" W 90.45 feet, along the Southeast right-of-way line of East 31d
Street to a '/" iron rod marked "Brittain & Crawford" set;
THENCE N 290 13' 39" W 60.02 feet, crossing the right-of-way of said East 31d Street, to
a Y2" iron rod marked "Brittain & Crawford", set in the Southeast boundary line of Block 23,
of said Moore Thornton and Company Addition;
THENCE N 590 18' 37" E 29.04 feet, along the Southeast boundary line of said Block 23,
and the Northwest right-of-way line of said East 31d Street, to a 5/8" iron rod found at the
East corner of said Block 23, and lying at the intersection of the Northwest right-of-way line
of said East 31d Street with the Southwest right-of-way line of said Live Oak Street;

Adopt Ordinance Vacating a Portion of Live Oak Street, East 2nd Street and East 3rd Street,for a Existing Railroad Right-of-Way for the New
Commuter Rail Line,TEX Rail(COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating portions of Live Oak Street,East 2nd Street and East 3rd Street for existing railroad right-of-way for the
new TEX Rail commuter rail line;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Stateside Right-of-Way,on behalf of the Fort Worth Transportation Authority,has requested the vacation of these portions of Live Oak Street,East
2nd Street and East 3rd Street for existing railroad right-of-way for the new commuter rail line,TEX Rail.The City of Fort Worth has completed a
realigment of Live Oak Street to replace the vacated right-of-way in this area and preserve adequate area circulation.The City Plan Commission
recommended approval of this request at its meeting on June 28,2017.The City Plan Commission also approved a waiver of the requirement to
replat the vacated right-of-way with the adjoining property.
The City of Fort Worth(City)originally obtained the above mentioned rights-of-way through platting process.The City does not own any fee interest
in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of the rights-of--
way easements for the streets.
This project is located in COUNCIL DISTRICT B.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
