' ORDMNCE ACCEPTING IMFROVV_1aNTS ON A PORTION OF MYN GARDEN nRrVR AND PORTIONS OF SUNDRY OTH�i STRUTS, AVENUES AND PUBLIC PLACF,S IN THE CITY OF FORT WORTH, TEXAS; IE CLARING THE' C0TIMUCT WITH R THE CONSTRUCTION OF SAID IMPROV-1-CENTS FULLY COMPLn- ED AND P D; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVI� AFTER GIVING EFFECT TO SUNNY CREDITS HE)iE'IN AUTHORIZED AND ALLOWED AGAINST SOMV OF SAID ASSESSMENTS; DIRLCTING THE CITY SECR'ITTARY TO ENGROSS AND MOLL THIS OF=7ANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE B00K OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AMD E_37F.CTIVE DATE. 6+1IMMAS, the City of Fort Worth, Texas, has heretofore entered into a contract with TEXAS BITULITHIC COMPANY for the making and construction of certain streeF improvements on the hereinafter described portions of streets, avenues and public planes in said City, to-wit: UNIT 1: GLEN GARDEN DRIVE From Station 98+96 (South line of Tract 2-C, S. B. Hopkins Survey) to Riverside Drive, known and designated as Unit 1, Project No. 104-24000-212. UNIT 2: BELZISE TERRACE From Glen Garden Drive to Ash Crescent Street, known and designated as Unit 2, Project No. 104-24000-212. WHEREAS, by sundry proceedings heretofore passed by the City Council of the city of Fort Worth, Texas, including Ordinance No. 6469 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6469 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on 'the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows-. III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. PASSED AND APPROVED THIS day of a 19 . HOPKINS SURVEY) TO RIVERSIDE DRIVE, to be improved with seven-inch thick hot-mix asphaltic concrete pavement on a six-inch thick cement stabilized subgrade, seven- inch high concrete curb and eighteen-inch wide concrete gutter, so that the finished roadway will be forty feet wide from the south line of Tract 2-C, S. B. Hopkins Survey to within 170 feet east of Riverside Drive and forty-four feet wide from that point west to Riverside Drive and by constructing four-foot wide concrete sidewalks and six-inch thick concrete driveways where specified. Project Description Name: Construction of Glen Garden Drive and Belzise Terrace Project No. 104-24000-212 Contractor: Texas Bitulithic Company Contract Awarded: March 15, 1971 (M&C C-1945) Work Order Issued: May 24, 1971 Work Order Effective: June 3, 1971 Work Began: June 2, 1971 Date of Final Inspection: September 13, 1971 Working Time Bid: 65 Working Days Working Time Used: 55 Working Days Project Cost and Financing Original Bid Price: $78,083.15 Change Order-96. 1: - 4,498.80 (A.R. 1-15., 2.2, 4/20/71, M&C G-1725) Revised Bid Price: $73,584.35 Final Contract Cost: $68,826.00 Partial Payments Previously Made: 3 Amount: $59,172.69 Final Payment Due: $ 9,653.31 Sufficient funds are available for the final payment to be made from Project Number '104-24000-212. Deviation from Bid Price: The final contract cost of this project is $4,758.35 under the revised bid price. A major portion of the savings, $2,250 resulted because six inch metal pipe subdrain was found to be unnecessary,, and a savings of $1,300 was realized because it was not necessary to adjust as many utilities as anticipated. The remaining cost difference, $1,208.35, is attributed to minor variations between quantities estimated in the contract documents and quantities actually measured and used at the job site. Compliance with Specifications Tests made during construction show that materials used and required thicknesses were in compliance with contract specifications. Recommendations It is recommended that the project described be accepted by the adoption of an ordinance and that final payment of $9,653.31 be authorized to Texas Bitulithic Company.
