ORDINANCE NO. 6 2J
AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
WEISENBERGER STREET
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public-places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
UNIT 1: WEISENBERGER STREET From Carroll Street to Vacek Street,
known and designated as Unit 1, Project
No. 104-24000-211, to be improved with six-
inch thick reinforced concrete pavement on
a six-inch thick lime stabilized subgrade
with seven-inch high concrete curb and
eighteen-inch wide concrete gutter, so
that the finished roadway will be thirty
feet wide and by constructing six-inch
thick concrete driveways where specified.
UNIT 2: FOCH STREET From Whitmore Street to White Settlement
Road, known and designated as Unit 2, Pro-
ject No. 104-24000-211, to be improved with
six-inch thick reinforced concrete pavement
on a six-inch thick cement stabilized sub-
grade with seven-inch high concrete curb and
eighteen-inch wide concrete gutter, so that
the finished roadway will be thirty-six feet
wide and by constructing six-inch thick con-
crete driveways where specified.
UNIT 3: LITTLEPAGE STREET From Blackmore Avenue to Libbey Avenue,
known and designated as Unit 3, Project No.
104-24000-211, to be improved-with six-inch
thick hot-mix asphaltic concrete pavement on
a six-inch thick lime stabilized su_ bgrade
with seven-inch high concrete curb and eighteen-
inch wide concrete gutter, so that the finished
roadway will be thirty feet wide and by con-
structing four-foot wide concrete sidewalks
and six-inch thick concrete driveways
where specified.
III.
A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any interest in any such property. Such hearing shall be
given and held on the 14tla day of December , 19 70 , at 9:30 A.M,
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice ,of the
time and place of such hearing and of. other 'matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session-of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365,, Chapter 176, Section 1,
emergency effective May 12, 1967. Such notice, shall be by advertisement inserted
at least three (3) times in a newspaper published in the -City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before -
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United.States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names bf such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be improved is listed as "unknown" on the then. current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown,' no notice need be mailed. In
those cases where the owner is shown to be in estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the_
properties to be as,sessed,, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses 'determined as aforesaid of the respective owners and those perms

sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy ,of the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con-
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

that the finished roadway will be forty feet
wide.
UNIT 5: BROADMOOR DIRVE From Highway 80 to West Elizabeth Lane,
known and designated as Unit 5, Project
No. 104-24000-211, to be improved with
seven-inch thick hot-mix asphaltic con-
crete pavement on a six-inch thick lime
stabilized subgrade with seven-inch high
concrete curb and eighteen-inch wide con-
crete gutter, so that the finished road-
way will be forty feet wide and by con-
structing four-foot wide concrete side-
walks and six-inch thick concrete drive-
ways where specified.
together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with TEXAS BITULITHIC COMPANY ;
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
UNIT 1: WEISENBERGER STREET From Carroll Street to Vacek Street,
known and designated as Unit 1,
Project No. 104-24000-211.
The estimated cost of improvements is $ 20,148.43 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.58 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 11.51 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ .90 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $ .14.09 plus the cost incurred for concrete driveway construction
where specified.

The estimated cost of improvements is $ 17,833.75 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.67 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 14.60 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .90 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 17.27 , plus the cost incurred for concrete driveway con-
struction where specified.
UNIT 3: LITTLEPAGE STREET From Blackmore Avenue to Libbey Avenue, known
and designated as Unit 3, Project No. 104-24000-211.
The estimated cost of improvements is $ 10,255.85 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.58 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 6.54 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for 4 foot wide concrete sidewalk is $ 3.05 ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .90 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 12.17 plus the cost incurred for concrete driveway con-
struction where specified.
UNIT 4: SLOCUM AVENUE From Joyce Drive to Highway 183, known and
designated as Unit 4, Project No. 104-24000-211.
The estimated cost of improvements is $ 14,927.55 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.58 the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is_ $ 9,01

the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ -0- per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 11,59 , plus the cost incurred for concrete driveway con-
struction where specified.
UNIT 5: BROADMOOR DRIVE From Highway 80 to West Elizabeth Lane, known and
designated as Unit 5, Project No. 104-24000-211.
The estimated cost of improvements is $ 15,120.32 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 2.58- ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 10.07 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for 4 foot wide concrete sidewalk is $ 3.05 ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $ .90 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 15.70 , plus the cost incurred for concrete driveway con-
struction where specified.

A Neighborhood Hearing was tz--,.-.6,ucted by the Engineering Division of the Public Works
D�--p8rtment at Crestwood Elementary School on October 26, 1970, at 7-30 P.M. for the
Asscy6L meat Paving At 5 Lccatior.-s,, orn the West Sideo
pr„ dare concering owner particip,-;tion in, the cost, method and policies of determin-
ing assessments, street standard's and methc,d:s of payment were explained
by Mr. Schmidt to the sixteen �16) people present.
'"'nit 1 Weisenberger Street from Carroll Street to Vecek Street, Mrs. Virgie Mae
Boardman, -Lots 4 & 5, Block 13, W&i.: enberger Addition, at.,ited that she bought this
property from her brother and that slit and 'her husband are in the midst of moving
back to Fort Worth due to her hugban-4's haalth and that some credit should be due
them, She was assured that they u,,,ould get owner occupied credit on Lot 4, but Lot 5
,would remain as is,
Mrs. Ruby Thompson, Lot 13, Block 8, Wei8enberger Addition, questioned the amount of
her assessment, After explaining to her that her property is rent property and zoned
tndu triad, she :Ilnderstood.
ltir, Earl E. Mitchell, Lots 1 & 1, Block 13, Weisenberger Addition, stated that he is
pleaded tliat the street is being paved. however, he requested that something be done
about his driveway since it wa8 brckan by the contractor (general Construction Company)
,�7hen Weisenb8rger Street from Cariroll to Wimberly was paved. A maintainer was turned
arcund in his driveway breaking it. The contractors representative told him it would
be repaired but so far nothing nab been, done, This happened in 1967

Unit 3, Littlepage Street from Blackmore Avenue to Libba AvenueZ No Comment,
Uln-It 4, Slocum Avenue from Joyce Drive to Highway 183! Mr, W. G, Champion, Lot 1, Block
24, Alta Mere Addition, stated that the paving of Slocum Avenue would not benefit his
property since Joyce Drive north of his property is unpaved and dust would still cover
his yard when the wind is from the north, He was told that he is the recipient of the
fairest assessment in the project in that he is assessed under the old $5.40 rate and
that the City-at-large is paying for 75 feet of his side lot, He said he understood
this but wanted to make it a matter of record that he is not in favor of paving at
this time,
Unit 5, Eroadmoor Drive from 'Highway 80 to Fleet Elizabeth Lane- Mr. Eli R, Merrill,
Lot 11 8, Ea z of Lot 12, Block 2, B roadmoor Addition, requested the driveway be
deleted from the side of his property since his garage faces Elizabeth Lane. The
gate in his yard is for fire safety only duce to the condition of commercial property
at the rear of his lot, He also stated that he was against the sidewalks since a
good percentage of the property north on 1Broadmoor Drive is vacant.
Mr. Johan P. Williams, lots A.-R and B-R, Eroadmoor Addition, requested some credit
be given for the six-inch thick hot-mix asphaltic concrete driveways he was required
to construct in conjunction with his building permit, Also, he is definitely opposed
to sidewalks. Mr. Williams was informed that his permit would be received and if
driveways as stated were required, they would be cored, and if credit is dose, adjust-
ments will be made, He agreed.
After general discussion the: meeting was adjourned.

Nature of Work: Assessment Paving of 5 Locations on the West Side.

Petitions were received from the property owners for the paving of Units 1, 2,
4, and 5. A poll card survey was conducted for Unit 3 as a result of a request
from several of the teachers at Como Jr.-Sr. High Schools.
Sidewalks
Sidewalks have been included in Units 3 and 5 for the following reasons:
Unit 3, Littlepage Street: Sidewalks are included in Unit 3, (Littlepage
Street) , which leads to and ties in with sidewalks adjacent to Como Jr.-
Sr. High Schools.
Unit 5, Broadmoor,Drive: Sidewalks are included in Unit 5, (Broadmoor
Drive) , which ties into a major thoroughfare (U.S. 80 West) and has
commercial establishments abutting the east and west side of the street
in addition to vacant property zoned for apartments.

Project Cost and Financing
Based on the low net bid, approximately _$40,804.55 will be assessed against
abutting property owners. The cost to the City-at-large will be approxi-
mately $38,000. Funds are available from Design Engineering in the amount
of $1,000, and a Bond Fund Transfer in the amount of $37,000 from Unspeci-
fied Funds is proposed to provide for the remaining portion of the City's
cost of the project, including engineering expenses, inspection, and miscel-
laneous expenditures.

It is recommended that:
