ORDINANCE NO. AN ORDINANCE DISCONTINUING TERRITORY FROM WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT WORTH; PRESCRIBING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That the following described territory within the corporate limits of the City of Fort Worth is hereby discontinued as a part of the City of Fort Worth; The City of Fort Worth also relinquishes all extraterritorial jurisdictional authority over such area under the provisions of the Municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, Regular Session 1963, compiled as 970a, Revised Civil Statutes of Texas) said tract of land being described by metes and bounds as follows: Beginning at a point in the easterly right-of-way line of the Gulf Coast and Santa Fe Railroad Company, the southwest corner of Lot 22, Block 1, Edgecliff West Addi- tion Unit No. 1 as said lot appears on the map of record in Volume 388-26, Page 61 of the Tarrant County Deed Records; Thence South 87057' East along the southerly line of said Lot 22 a distance of 150 feet; Thence South 2003' West 1239.95 feet; Thence South 89*51' East 838.25 feet to a point 200 feet west from the west right- of-way line of State Farm to Market No. 731; Thence South 0*34' East 200 feet west from and parallel to the west right-of-way line of F.M. Hwy. No. 731 a distance of 426 feet; Thence North 89051' West 1007.75 feet to a point in the easterly right-of-way line of the Gulf Coast and Santa Fe Railroad; Thence North 2*03' West 1670.93 feet to the place of beginning and containing 14.04 acres. SECTION 2. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3. If any section, subsection or provision of this ordinance shall be held invalid or unconsti- tutional by a court of competent jurisdiction, the portion so held to be invalid or uncon- stitutional shall not affect any other part of the ordinance, which shall remain in full force and effect. SECTION 4. This ordinance, after it has been duly passed, shall be entered as an order on the minutes and permanent records of the City of Fort Worth, from and after the date of its entry, the territory hereinbefore described shall cease to be a part of the City of Fort Worth. SECTION 5. That this Ordinance shall become effective and shall be in full force and effect from and after its passage and it is so ordained. � Passed and adopted this ' day of / , 1965. L. Trimble for the annexation of a 13.8 acre tract of land adjacent to the Hallmark Addition. The tract of land, formerly a part of Edgecliff Village, was disannexed by that city on August 17, 1965, in anticipa- tion that an equal portion of Fort Worth would be released to Edgecliff Village. A map showing the areas proposed for exchange between the municipalities is at- tached to this communication. Deletion of the tract by Edgecliff Village and the requested annexation by Fort Worth will establish a common city limit line to follow rear lot lines in a pro- posed additional subdivision platting of Hallmark Addition, and thereby avoid problems which could arise where two cities have jurisdiction and control over the same homeowner occupied lot. The area proposed for disannexation by Fort Worth borders an addition now under development in Edgecliff Village where the city limit line lies near the south curbline of an east-west residential street. In both the Hallmark and Edgecliff Village residential developments, the new city limits will follow rear lot lines rather than arbitrary survey lines which now form the municipal boundaries. Occupants of the completed subdivisions, if the exchange of land is approved, will live on streets where fronting property is in the same city thereby simplifying calls for emergency service. Adjustment of boundaries between the municipalities has been under discussion for a number of months. After consideration of many alternatives, the only ex- change of land which was agreeable to Edgecliff Village, the developers, and the Fort Worth City Plan Commission is the proposal herewith submitted. Ordinances have been prepared annexing the 13.8 acres disannexed by Edgecliff Village and disannexing 14 acres from the City of Fort Worth. The City Plan Commission has reviewed the proposed exchange and recommends adoption of the ordinances adjusting the boundaries as described.
