AN ORDINANCE ABOLISHING THE CLASSIFICATION IN THE
FIRE DEPARTMENT of FIRE MARSHAL; CPXATING THE CLASSIFi- TEX_
CATION IN THE FIRE DEPARTMENT OF DEPUTY CHIEF FOR FIRE
PREVENTION; FIXING THE NUMBER OF POSITIONS AT ONE(l);
AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
1.
That the classification in the Fire Department of Fire Marshal
be and the same is hereby abolished.
2.
That a new classification be and is hereby created and established
in the Fire Department to be known as Deputy Chief for Fire Prevention
and that the number of positions in said classification shall be one (1).
3.
Should any section, clause or provision of this ordinance be de-
clared by a court of competent jurisdiction to be invalid, the same shall
not affect the validity of this ordinance as a whole or any part thereof
other than the part so declared to be invalid.
4.
That this ordinance shall be in full force and effect from and
efter its date of passage as provided by law.

The City XhaX�Fx„ Chapter 12, Section 7, provides that the Fire Chief shall be
the exofficio Fire VarshAland that there shall be no separate office of Fire
Marshal'. This section of the Charter also authorizes the City Council to
establish a Fire Prevention Bureau, which is to be operated under -the supervi-
sion of the Fire Chief.
Ordinance No. 2470, adopted by the City Council on October 15, 1947, established
a Bureau of Fire Prevention in the Fire Department, and provided for the Fire
Chief to designate an officer or member of the department to serve as Chief of
the Bureau of Fire Prevention. This ordinance, commonly known as the Fire
'Prevention Code, also outlines the duties to be performed by the Chief of the
Fire -Prevention Bureau. However, this classification has never been established
and for a number of years the individual appointed to the classification of Fire
Marshal has performed the duties in the Fire Code relating to fire -prevention
and inspection.
Since the incumbent Fire Marshal is scheduled to retire shortly, and there is
an inconsistency between the Charter provision and the current classification
of Fire Marshal, it is proposed that the Fire Marshal classification be
abolished and a new classification of Deputy Chief for Fire Prevention be
established. The salary range for the new classification is to be the same
as for the Fire Marshal classification ($683-735'per month).
Adoption of an ordinance by the City Council establishing the classification
of Deputy Chief for Fire Prevention is recommended.
